This application is a variance request to allow the construction of a garage 5' from the side property line. The project is located in a TM -40 zone which has a 25' side yard setback: The parcel is located on the southeast side of Forest Ranch Rd.. approximately 1,200' west of Hwy. 32 and 2 miles north of the commercial center. The subject parcel is 2 acres in size, A building site lias been cleared in the western 'half of the parcel in a crowned, level area. The garage location was chosen to be near the proposed home site. Parcel to the north has been developed with a home that is approximately 75' from the property line. There is some findings of hardship with this parcel due to its size. Normally a zoning that allows 2 acre parcels will have a 5' to 10` side yard setback not 25'. The parcels directly to the south of this property are generally 3 to TO acres in size and are zoned FR -5 which has a 1'0' setback. Section 24-37.10 of the Butte County Code allows for the reduction of side yard setbacks for parcels tliat, because of their size, do not conform to the zone. However, the side yard setbacks can only be reduced until a 75' wide building envelope is achieved. ""his parcel has it 105' to 110' wide building area, but the southerly 40' to 50' has slopes that would require grading to create a level building ,pad. There are other locations on the parcel that can accommodate the garage and still meet all of the setback requirements most of the locations are 100 to 300' away from the home location. However there is one location that is still near the homesite.. This location is directly to the east. of the home site on the eastern edge ofthe cul-de-sac as shown on the plot plan. The 40'x22' garage could be situated here with the removal of 1 or 2 trees and some manzanta shrubs, RECOhSMENDATIONS A Note that this project is categoricaily exutl apti review, and B.
