REGULATIONS FOR SENIOR CITIZEN ®WELLING UNIT'S
BUTTE COUNTY PLANNING DEPARTMENT
The following conditions shall be applicable to all Senior Citizen Dwelling Units as defined In section 24-202 of the
Bute County Code and located within the unincorporated area of Butte County. It is the applicants responsibility
to leisure that these conditions have been or can be met prior to the application for an Administrative Permit. The
applicant shall be ;responsible for providing, as requested by the County, Information or proof of compliance with
the conditions.
(1) The lot or parcel on which the senior citizen dwelling unit is proposed contains an existing single-family dwelling
unit:
(2) The "living ar,,a", meaning the interior habitable floor space area of a dwelling unit including basements and
attics, but not including a garage or any accessory structure, shall not exceed 1,200 square feet for a detached
senior citizen dwelling unit. The 'living area" of an attached dwelling unit shall not exceed 640 square feet or
30% of the existing sinrie-family dwelling unit living area, whichever is greater,
(3) The senior citizen dwelling unit Is intended for the.sole occupancy of one (1) adult 62 years of age or over or
two (2) adult persons, one of whom iq&Lyears of age or over. An affidavit of compliance with the age
requirements of this section shall be recorded in the office of the Recorder prior to issuance of building permAs.
Said affidavit shall include the legal description of the lot or parcel and shall constitute a covenant running viith
the land, bindinr, upon the originalowners and their heirs, successors and assigns, limiting the occupancy of
the senior citizen dwelling unit to the conditions described in this section.
(4) The senior citizen dwelling unit shall not be sold as a separate unit unless a parcel containing the unit is created
in compliance' with the existing zoning and subdivision ordinances and the resulting density is in conformance
with the General Plan.
(5) Two off-street 'parking spaces shall be provided for the senior A�IItlzen dwelling unit In addition to the parking

(6) Adequate sewer and water facilities shall be provided subject to the approval of the Environmental Health
Department.

The Board of Supervisors has found that for the health, safety, and welfare of the people
of the County that it has often become necessary for the care of persons who by reason
of old age, disease (e t1her mental or physical), infirmity or other cause, are ►�nabla
unassisted, properly to manage and take care of themselves, or would benefit froin
familial assistance; to allow mobile homes to be placed on smaller parcels than present
County codes or ordinances permit so that such persons will not have to be
institutionalized but rather can reside near their close relatives who cal help care for
them. The ability to care for one's clos-- relatives will not only result in better care for
citizens, but will also negate in many situations the necessity for public assistance which
many citizens find degrading and damaging to the pride of the persons concerned and
their immediate relatives. This will also provide privacy and dignity for the relative as
well as independence, .of which these people are deserving.

There were no problems with this application.
Mr. Sanders stated: I make a motion recommending that the Planning Director approve an Administrative
Permit to allow a ,Senior Citizen Dwelling Unit for Stanley Bracy on AP 56-29-34 subject to the eleven
conditions listed in the mento to the Development Review Committee,
(1) The "living area", meaning the interior habitable floor space area of a dwelling unit including
basements and attics, but not including a garage or any accessory structure, shall not exceed 1,200
square feet.
(2) The senior citizen dwelling unit is intended for the sole occupancy of one (1) adult 62 years of age
or over or two (2) adult persons, one of whom is 62 years of age or over. An affidavit of compliance
with the age requirements of this section shall be recorded is the office of the Recorder prior to
issuance of building permits. Said affidavit shall include the legal description of the lot or parcel and
shall constitute a covenant running with the land, binding upon the original ownert� rind their heirs,
successors and assigns, limiting the occupancy of the senior citizen dwelling, unit to the conditions
described in this section.
(3) The senior citizen dwelling unit shall not be sold as a separate unit unless a parcel containing the
unit is created in compliance with the existing zoning and subdivision ordinances and the resulting
density is in conformance with the General Plan.

parking 'spaces required for the primary dwelling unit.

receipt of a substantiated written request by flea applicant. Prior to such approval, verification shall
be made by each Department or Division that the modification is consistent with the application, fees
paid and environmental determination as conditionally approved. Changes deemed to be major or
significant in nature shall require a formal application for amendment.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Stanley Bracy is hereby granted an Administrative Permit in
accordance with application filed: 5/26/93 to allow a senior citizen dwelling no larger than
1200 square feet for one or two persons age sixty-two years or over on property zoned TM5
located at 5296 Deer Trail, Forest Ranch.
1. Failure to comply with the conditions specified herein as the basis for approval
of application and issuance of Permit, constitutes cause for the revocation of said
permit in accordance with the procedures set forth in the Butte County Zoning
Ordinance, including Butte. County Code Section 24-62,
2. Unless otherwise provided for in a condition to an Administrative Perritt all
conditions must be completed by the permittee within 12 months of the delivery
of the countersigned permit to the permittee:
3. If any use for which an Administrative Pormit has been granted is not established
within one year of the date of receipt of the countersigned permit by the
permittee, the permit shall be come null and void and reapplication shall be
required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns of
the Permittee,

2. The senior citizen dwelling unit shall be for the sole occupancy of one (1) adult 62 years
of age or over or two (2) adult persons, one .of whom is 62 years of age or over. An

the legal description of the lot or parcel and shall constitute a covenant running with the
land, binding upon the original owners and their heirs, successors and assigns, limiting

containing the unit is created in compliance with the existing zoning; and subdivision
ordinances and the resulting density is in conformance with the General Plan.
4; Two off-street parking spaces shall be provided for the senior citizen dwelling unit in
addition to the parking spaces required for the primary dwelling unit.
5. Adequate sewer and water facilities shall be provided subject to the approval of the
Environmental Health Department.
6. All site development standards as required by the zoning district in which the unit is
located shall be met.
1. The Senior Citizen Dwelling unit shall be a conventionally constructed building or a
mobile home that complies with the National Manufactured Housing. Construction and
Safety Standards Act of 1974, except that in the "A", "FR", and "TM" series of zones a
mobile home, as defined in Section 24-21,28, may be used. Travel trailers and.
recreational vehicles shall not be allowed as a Senior Citizen Dwelling Unit.
8. The second dwelling must meet the fire safe regulations of PRC 4290
9: The approval of this permit constitutes approval only to the extent that the project
complies with the Butte Count Code and all other applicable regulations.

Mr. Bracy has built a fine home which enhances our properties
On Deer Trail. I cannot forget that Mr. Bracy told us, his
neighbors, that he was building into his basement an apartment
for a Senior Citizen dwelling. Do you allow a person to have
two such dwellings? Ibelieve his total property is under 3
acres, that our dead-end road is impacted already by excessive
traffic and noise, and would alter the intention of TM -5 zoning.
I believe that our zoning requirements protect from excessive
draining of our water tables. Mr. Bracy has a large family
already and is on a shared well at about the same depth as a
lot of wells in our area, including mine. Please review this
permit carefully as we need protection from overdevelopement
in Forest Ranch!

Dear Planning Director,
As residents of Forest Ranch and Property Owners along Deer
Trail we oppose the Bracy's application to add a "Senior Citizens
Dwelling" to their property.
The Bracy's built a house last year that contained a "Senior
citizen Dwelling" within theirresidence.
Properties in this area are zoned TM --5 allowing for one
dwelling per Five acre parcel. The Bracy's property is less than
Five acres as it is. Water is scarce and the Bracy's get theirs
from their neighbor's well. The neighbor's well is five hundred
feet deep and only pumps 1.0 gpm.
The roads are dirt and gravel. and are subject to washing out
or icing over in the winter and they are affected by every
vehicle which passes over them. Adding two paerking spaces is
hardly a solution to anything.
Please do not grant their application. The Bracy's Have more
than adequate room in their current residence. We purchased our
property many years ago with the intention of retiring in a
community which is not packed with multiple dwellings per parcel.
And if you start to grant exceptions to this zoning, there is no
way to prevent these exceptions to other parcels.
The Stacy's knew the zoning when they moved here last year.
That is why they put in extra room in the house they built.

We, -the below signed residents, of butte County who own
property fronting on Deer Trail, oppose the granting of an
Administrative permit for a Senior Citizen dwelling unit to
Stanley Bracey of 5296 Deer Trail, Forest Manch. (Assessor "s
Parcel.. #056-290-034)
Problems connected with this permit include:
inadequate water source
Increased sewage and septic
Increased road use
- Increased noise
Thin current residence at 5296 Deer Trail., was constructed
only last year by mri Bracy. The parcel upon which it is
constructed is itself a variance of a variance. The residence was
constructed on a 3 acre parcel and does not have its own well..
instead, its water source is the neighbor's (the soules) well on
the adjoining property owned by the Soules.
The soules obtained an administrative permit in order to
sell the above property to the Bracy's. The Soule's well, which
supplies water to the Bract's as We11 as the occupants of the
Soule's property, barely meets the minimum pumping requirements
for a shared well. introducing additional users into this system,
senior citizens though they may be, is not.good planning.
This area is zoned TM -5 for good reason. Water is an even
more scarce commodity here in Forest Ranch than it is in other
parts of California.: Wells in this area typically must be sunk
500 ft. or more to achieve year. -round results. Limiting the
number of people per area to compensate for this is only gond

when Mr. Bracy built his house he took great pride in the
fact that he had thought ahead while constructing the garage
underneath the main living area. This area includes an adjacent
apartment within the main house as a soparate "..bother -in-law"
apartment on the :Lower level, to accomodate his older relatives.
Now he propoEes to build, as a separate structure, that which he
already supposedly built in the main house.
Something seems wrong here. How many senior citizen
residences does Mr. 6racy need? Mr. Bracy works as a full time
missionary for his church and I applaud his personal dedication.
But often, judging from the noise and traffic, the Bracys have
additional people staying at their residence. Building an
additional. residence wo+xld allow more overnight guest
accomodations no matter what the original intent of the building.
And the central question remains. Why does 'Tr. Bracy need to
construct something (a senior citizen residence) when he already
has one?
-Mr. Bracy"s property is essentially a ravine with both
walls relatively steep. Almost no part of iL is level. Because of
the physical characteristics of Mr. Bracy`s property his septic.
system currently sits just beyond the minimum allowable distance
from my wF"'= In fact, l am not sure that it is the minimum
allowable ctxstence from my well. I can only assume than since the
county granted the permits that the distance from my well was
taken into consideration and not just the distance from the
Soule's Well
Deer Trail itselr i, a narrow, sometimes impassable in
winter (due to snow and ica), steep dirt road. it is not
maintained by the countyi it is maintained by the residents. It
is impacted by overy vehicle that uses iti one or two additional
vehicles or drivers will affect the road surface and subsurface.

This is a request for an Administrative Permit to allow a detached Senior Citizen
Dwelling Unit on a 3.32 acre parcel located at 5296 Deet 'frail in Forest Ranch. The !%
j parcel is zoned TM -5. The applicant proposes to place a 1,142 sq ft. mobile home
approximately 409 feet west of the existing dwelling. The site meets all setback
requirements for the zone. The project appears to meet all of the conditions required
for a Senior Citizen Dwelling Unit as listed in section 24-202 of the Butte Winty Code.
The following conditions are recommended
(1) The "living area", meaning the interior habitable floor space area of a dwelling
unit irk,�':uding basements and attics, but not including a garage or any accessory
structure, shall not exceed 1,200 square feet.
