The Commission waived the presentation of the Staff Report. ? Mr. Hogan said Code Section 24-40(e)(8) allows staff to refer projects to the Planning Commission from the Development Review Committee if there is a policy question. He said this is a request to allow one senior dwelling on two parcels each. He said that there is an existing single family residence on both parcels. He said the potential for hazard _ in this areei is high. He said the questic-- r- the Intent of the Senior Citizen Ordinance: He said this is a policy question to be dealt with at the Commission level. He noted the material submitted by Gary Wilson, attorney for the applicant, at the break; The hearing was opened to the public. Mr. Wilson wishod to address whether there is a policy question. He said this was addressed in Code Section 24-Z2(a)(c). He said the code does not say the renters must be related to the property owner, just 62 years or older. He said the Board adopted a ;.policy stating that senior citizen dwellings shall be allowed in all zones that allow ,:residential uses, He said tinder Government Code Section 65852.2 8u`-section, A-8, :second Units created shall not be considered to limit residential` growth. He said the area is zoned from 1-M-1 to TM-406 ,Commissioner Lynch said the question is whether these units are appropriate and what ,guarantees the housing will be affordable? Chairman Lambert asked if both parcels are zoned TM -57 Mr. Wilson said yes. He said the character of the zone will not be efrected. Chairman Lambert said there areother areasA where a second unit is allow. She said this area Is inappropriate and approval of these permits are not automatic. Mr. 'Wilson said he thinks approval is automatic as long as the applicant meets the criteria and conditions 'as set forth. Mr. Hogan said the staff report does not refer to growth, but the overall plan for the land. He said this land is for timber use: Chairman Lambert said the problem could be handled through a rezone to TM -2 1/2 Mr. Wilson said this request would meet the criteria being proposed that quality, affordable housing be allowed to be developed. He said even if the Commission finds they are not forced to approve these permits, this request will not change the character of the area. Commissioner Nelson said approving these permits in this area would set a precedence the Mould change the character of the area. Hogan, Planning Manager BY; Stephen Lucas, Planner DATE: August 24, 1994 REQUEST: Two Administrative Use Permits for one Senior Citizen Dwelling Unit on each parcel for Don_Doerschlag on APN 056-280-041 and APN 458-280-042 in the TM -5 (Timber Mountain - 5 acre) zone at 15970 Wintergreen Lane; Forest Ranch, in the TM -5 zone at 4899 Wanda Lane, Forest Ranch. RELATED ITEMS; Both Administrative Permits were reviewed at DRG meeting on 15 August 1994. The DRC elected to have the Commission review the projects: FOR: Planning Commission Meeting of September 24, 1994 ABSTRACT, Butte County Code Section 24-40(e) (3) allows for the Planning. Manager to "refer- any Administrative Permit proposal to the Planning Commission for a decision if he determines that the nature of the project, or the existence of a policy question, requires such referral:"- Based upon this authority, the Planning Manager has referred these Administrative Use Permits to the Planning Commission for a decision, no action, other than referral to the Planning Commission was taken by the Development Review Committee. These requests for Administrative Use Permits for Senior Citizens Dwelling Units on AP#055-280-041 & 05-0-280" 00, meets all the requirements of Section 24.202 of the Butte County Code, but are not consistent with the TM -5 zoning or General Plan designation of Agrioultural Residential. Staff recommends that this application be rQv"served and if the Commission finds that tha appiicants request represents the intent of the Senior Unit Ordinance, approval with conditions is recommended. PROJECT CHARACTERISTICS: These requests are to allow one Senior Citizens Dwelling Unit p acre p p at 15970 i' Wintergreen Lane,hFo est Ranch and parcelP042 Parcel 041 is acre parcel located at 48-99 Wanda 9 P Lane, Forest.Ranch. The parcels are approximately 300 feet apart and Loth parcels are zoned TM -5 with a General Plan designation of Agricultural -Residential. There are existing single family dwellings on each parcel served by private wells and septic systems. Access to both parcels is via Wintergreen Lane, a unimproved road, in a poor state of repair. Wintergreen Lane joins with Schott Roadoff 8R32.. Over the last three years, the applicant has requested similar permits for properties which he owns in the same vicinity. The follow -Ing list represents applications submitted by applicant and action taken by the County. 9 July 1991, 056-280-041 UP for permanent second dwelling unit: (WITHDRAWN) ■ Oct 1991, 056-280-045 UP for permanent second dwelling unit (DENIED) ■ April 1994; 056-280.045 AUP for senior unit (APPROVED) ■ May 19940 056-280-042- AUP for senior unit (PENDING) ■ June 1994, 056-280-041 AUP for senior unit (PENDiNG) In 1991, when applications were made for sect I units, they met with substantial concerns from the community. As a result, one application, denied by the Planning Commission and the other withdrawn by the applicant. In both of L-,rse cases, the applicant has resubmitted an application for a senior unit. A third senior unit has also been applied for on parcel 042. Section 24-202 (a) states: Purpose and intent - 'rhe purpose and intent of this section is to facilitate the provision of quality affordable housing for persons sixty-two (62) years of age or over in conformance with Section 65852 et. seq (emphasis added) of the California Government Code` while still preserving the character and integrity of single family residential zones throughout the County and in conformance with the policies of the Butte County General Plan (emphasis added), In the issuance of an Administrative Use Permit a determination is made as to whether the application meets all of the criteria applicable to the proposed use. The criteria, or standards and conditions in this case, are specifically li5led In Section 24-202 (d) of the Senior Citizen Dwelling Unit Ordinance, The question which staff is raising goes beyond simply meeting the standards and conditioris of the Senior Dwelling Unit Ordinance. it is our belief that the ,Witte County Department of Development Services - Plahning Division ill 2 AC;ENDA 1T�M applicant could meet those requirements. The question which we believe the Commission should address relates tothe purpose and intent of the Senior Citizen Dwelling Unit Ordinance. Should the County pennit these two senior citizen dwelling units in this area? If these units are permitted are they in character with the single family zone? Will they disrupt the integi'lt1 of the zone? It is our belief that the request for approval of these Administrative Use Perrrilts could change the single famih/ character of the zone and could disrupt the integrity of the zone. The Zoning Ordinance, Section 24-20 (b) (2) states: f (b) This chapter is adopted to promote and protect the public health, i safety and general welfare for the -following more particularly specified purposes: r; (2) To protect the character (emphasis added), social and economic stability sof agricultural, residential (emphasis added), commercial, industrial and other areas within the county, to insure orderly and beneficial development of such areas (emphasis added); and more particularly, to provideadequate i light and air; to avoid undue concentration of population (emphasis added); to facilitate the adequate provision for transportation, water, isewage,,...... This requests are in the Timbor Mountain zone with minimum 5 acre parcel sizes. This is a zone with large lot sizes in an area where there is management, raising, hatvosting and removal Services; such as public transportation, medical hos ital services,oma dist;, ^.e from normal i �s ees. The location of the properties are also rpemote and some and ; food sto3h�es � tr , .acted � to, be utilized by seniors. The concentration of senior units in this area is poor platin nig.:an.d counter to the protection of the residential character of the zone. The intent of the 'iirriber Mountain zone is avoid undue concentrations of population. Adding additional units to these existing sites is counter to that intent. He said the staff report characterizes him as a ' os)ey grubbing somewhat sleazy landlord wanting to enhance his rentals at the expense of the anvt';,onment. The staff report also discusses the history of his properties in Forest Ranch. He said the �fyiould respond to that history as well as his own intent regarding the properties. aAAr. Doerschlag explained that two of his neighbors obw',, d rezones, which resulted in three 5 acre parce;`Is ,being downgraded to TM -1 zoning. Mr. Doerschlag said that he was encouraged by discussions with Planning staff hat the area was earmarked for development so he applied for a Use.. Permit for a second dwelling for his parcels. He was not aware of any problems with his a pprxation until he received the staffreport which recommended denial. Mr, _ Doerschl'ag said hz arpgrejs wasting his money and feels than he was not treated with honesty and integrity by the P,ienning staff, 'He said that when he asked Planning staff why his application was accepted since ftviaKa known at the outset that denial would be recommended, he was told "budgetary crisis." Mr. 1Doet,;.chlag said he was told by Planning staff that it be would alright to rent the second dwelling to anyone 62, gears of age or older, not necessarily a family member, although that i's the not t11 --re p:r mery focus of the ordinance: Mr,. Doerschlag sald he was confused by the comment in the staff report about fire safety, 'in ta�Wng the CDF staff at the Forest Ranch fire station and also to his tenants he still does not know vibat the problem is. He said that PRC 4290 requires removal of debris prior to getting a "final" but mobile home installations do` not get "finaled" until installation. Mr. Doerschlag said that he did not receive the Agenda Report along with the notice of the 'hearing :grad he had to pick it lip personally the Thursday prior to this hearing, althi.lugh the Agenda Report ,eas ,dated 8 days prior to the notice of the hearinq; Mr. Doerschlag went over the zoning 'and General Plan issues discussed in the staff report and explained why he disagreed with the arguments presented: Mr. Doerschlag said the staff report discusses his intent. His intent is to invest his money wisely and provide rentals for seniors at reasonable rates: He discussed the et0homlcs of providing mobile homes for seniors. The recommendation of the Planning Man,gger's Report is to exercise the authority, under the code, of the Planning Manager that these itwtmr be referred to the Planning Commission. Mr. Hogan said that nothing that Mr. Doerschlag saws. here will change his own opinion or his report. Denial is not being recommended, but rather refierral' to the Planning Commission because of a policy issue. M�r, Doerschlag said that the policy issue is moot. r. M, :Hpgan thought that the policy issues; is not moot. He said that the Planning Commission and tkDe .Board of Supervisors felt that senior citizen units were intended as an extension of tho family rr;ther than a way of providing rental units. He said that Mr. Doerschlag has made several applications for rental purposes. The Planning Division does not think that providing rental units is the intent of the ordinance,. and that is why the recommendation for referral on to the Planning �Comr mission has been made.
