IITHIS DECLARATION OF GRANT OF EASEMENT AND WELL SHARING
AGREEMENT is made and entered into•this 21st day of February,
1980 by ROBERT A. COWAN, an unmarried man, who owns that certain
real property in the County of.Butte, State of California, as
more particularly described as follows:
Parcels 1, 2 and 3 of that Parcel Map filed on the 5th
day of April, 1979, in Book 70 of Parcel Maps, at page
86.
and who is,hereinafter referred to as "DECLARANT".
DECLARANT does hereby declare for the purposes of
establishing a plan.for the use and development \of the above-
described property which shall be held., occupied and conveyed
subject to the following easements and well sharing agreement,
and shall be binding on all parties having any right, title or
interest therein, or any part thereof, their heirs, successors
and assigns, and shall inure to the benefit of each owner thereof,

plus all costs of maintenance and repairs necessary to keep said
wells in a good operIating condition. The owner of each lot
shall
pay monthly, its pro -rata regardless of usage. Each of the
ovmers shall agree upon reasonable 'expenditures to be made and
each shall submitreceiptsfor all monies received and all
expenditures made-within.thirty-(.30) days.
4. DECISION AS TO DIVISION OF COSTS AND WELL
MAINTENANCE:
Each of the three lot owners,
their successors and
assigns, shall be entitled
to one vote with, a

6. MODIFICATION:
This Agreement may be modified or terminated•at any

which is the subject of this Declaration of Easement and Well
Sharing Agreement.
7. COVENANT -TO RUN WITH THE LAND:
