The Highway 32 BIR referred to by lira. Green In her letter was certified by the Board of Supervisors on April 10, 19844 One of the mitigation measures adopted, to mitigate possible impacts to study area roads, was to form an assessment district to maintain project area roads. Asses�lment Districts can only be used to finance construction of facilities which are to be given to a public entity for public use. They cannot be used to maintain private ,facilities. Since the roads within Mrs. Greents project are to be private r+aads, an Assessment District will not accomplish the intent of the mitigation.measure. We did talk to Mrs.. Green's consultant regarding a method of obtaining monies to maintain private roads. An Assessment District was dismissed for I the reasons stated above. A. County Service Area was discouraged sine..; Public Works does not wish to be involved in or responsible for. the main- tenance of private roads. We do not recall. advising Mrs. Green's consultant that we did not wish a Community Services District to be formed to maintain project area roada. We feel this would be the best of the three altet,na- ti'ves, since control of the district would rest with an elected Board of Directors who would be residents sof the district. The property falls within that area served by the Altatina public road Approach at Highway 32. The road approach was approved by the California Transportation Commission after the Board of Supervisors certified the Hii3hway 32 Environmental Impact Report (EIR), Ms. Green was notified by tail February 12th and again on April 30, 1986 that the map is subject to the mitigation measures and requirements of this EIR. The specific. mitigation measures were restated in the transmittal letters. The Inter to your Board questions two of these mitigation measures: Formation of an assessment district and assessment of the potential impact on law enforcement, These mitigation measures are taken, verbatimfrom the certified EIR page 31 as follows "For an Assessment district to maintain all project area roads to County standards.": ':Land development applications should: a; sets a potential impact on traffic accidents and estimate the impacts on law enforcement.' Dan Hays requested one final continuance to June in order to prepare the botanical survey and complete all other mitigation measures. The continuance was granted only because the applicant agreed that all mitigation measures would be met and agreed if for any reason they were not that the map would be denied and not contested. To date the botanical survey has not been received, and the applicant is now object.i.ng to two mitigation measures before the Board. The Adviaory Agency has not yet acted on this ma13. County Code establishes a process whereby maps are heard and decided by the Advisory Agency. It would only be on appeal that the map would come before the Board for a decision.
