The present zoning is TM -5 (Timber Mountain, 5 p p Land Use Plan Map of the Butte acre yarcels adopted in 19.;76. The La as Agricultural -Residential;. Count General Plan designates this area There are no specific or community plans for the area. The TM -5 zone predates the Land Use Element by three years. Under the circumstances, the policies 'of the Land Use Element are reviewed to determine the appropriate parcel size. The Agricultural. -Residential Genera ' n s 0 g � p as consistent. Since the Board of Supervisors has not adopted the recommendations of the Department of Fish and Game, they recommend that Butte (. -y deny the Tentative Subdivision Map: The Subdivision Map Act established criteria for denial of the map, Section 66474(e) requires the denial of a map where it can be found that division and development will impact wildli.fe and migratory patterns. A second State Agency, CalTrans, maybe affected by division and development of this land. The property fronts on Highway 32. The envirohmental documents are being circulated by the State Clearinghouse to solicit their comments. Clearinghouse review will close August 19 1988. To insure Cal-Trans concerns are addressed, a general condition is recommended to read "Meet the requirements of CalTrans concerning any possible improvement to the intersection of Highway 32 and Platt Mountain Road". The one outstanding issue identified in the initial study is impact to archaeological resources: A records search was requested from the Northeast information Center, California State University of Chico. The staff had recommended that an Archaeological Survey be prepared, An Archaeological survey has been conducted by Jensen & Associates, clearance is recommended The applicant is concerned with the Department of Fish and Games` recommendations and questions whether the Department of Fish and Game made similar recommendations in the past. The Department of Fish and Game has made their recommendations based' on the habitat maps and "development zones" as subma�tted to the Board of Supervi ors in. April consistently applied of 1987. The Department of Fish and Game has , those maps to make a recommendation for approval or denial of land divisions. in preparing the maps, the Department of Fish and Game assumed that all Tentative Map applications currently in progress, or recently adopted, not recorded, would eventually be recorded. The parcel immediately east of the Hardy parcel had a Tentative Map application in process. Therefore, the Department of Fish and Game recognized the application and designated the property as a development zone. For this reason, the Department of Fish and Game did not recommend denial of division of the adjacent parcel: RECOMMENDATIONi Pursuant to C %rnment Code Section 66.474(e), and the Policies of the Agricul.tural-l.,�:sidential General. Hardy Tentative subdivision Map (TSM), a proposal to divide 39.16 acres into six par-cels of 6.5+ acres each, Butte County (AP 56-41=05). The T$M site is located on Platt Mountain, northeast of Forest Ranch. The property lies in the designated' winter range and is Within a migration corridor Of the Bast Tehama deer herd. Subdivision of land into small parcels has an adverse impact on migratory deer. AS lands within a migration corridor are divided into parcels smaller than 40 acres, deer movement becomes affected. As lands are divided into parcels less than 20 acres,' deer use becomes impaired, movement is adversely affected, and forage and Spade needs drop below the level necessary to sustain the herd. subdivisions have adverselyaffected. over 40 ercen+- of the East p Tehama deer herd's designated winter range. in an effort to resolve the subdivision/deex conflict in Butte CoUhty the Department to a series of actions for the Board of supervisors (Board) to implement. Although most of the TSM lies outside of a !)DZ, a portion of the project along Highway 32 (Parcel 1) is within an identified "Transportation Corridor" that was included in a bDZ. Therefore, the Department would not object tot l) development occurring along the highway (Parcel. 1) provided it is limited to within 660 foot or the road and is subject to the deer mitigation fees recommended to the Board; and 2) the rema�.ni,ng lands (parcels 2, 3, 4, 5, and 6) be retained as one parcel. However, until the Board has the opportunity to review and adopt our recommendations, the Department recommr�-nds the TSM be denied. i - Introduction In order to assess the archaeological itnpacts of a propool subdivision involving approximately 40 acres of land above i:ores' inch within butte County, (;elifornia, the property owner, Lynn Hardy, acting through R.F.C. Surveyors, Inc., contracted for a records se6rcr7 and on -foot reconnaissance of the parcel in compliance withrecomm endations received from the. Butte County planning Department. Accordingly, on Saturday, August 6, 1988, the author conducted an intensive, on -foot reconnaissance of the project area for the purpose of locating and recording any evidence of prehistoric or significant historic use and/or occupation. The Hardy parcel is located adjacent to Highway 32 at thO state Division of Forestry's Platte rlountain Station, approximately 4 miles northeast of Forest Ranch. The current proposal calls for subdivision of the parcel into six lots, each approximately 6,6 acres In size, r with subsequent sale and eventual development of the lots for residential use, In view of the potential adverse effects of this proposed action to cultural mmurces which might exist within the area, and in consideration of the general archaeological sensitivity of the region, Butte County Planning Department regulations required that cultural re��auroes be fully inventoried and formalin assessed prior to o °oject approval, pursuant to Section 106 of the Nation ii Historic preservation Act of 1966, a�,,, amended (16 470), procedures of the Advisory Council on Historic Preservation (36 CFR 8OO)„ and other legislation and orders. Within the northern half of the parcel, much of the slash and deadfall had been raked and piled, exposing more of the surface for direct irispec#ion. The uppermost headwaters of Little Chico Creek originate near the center of tle Har' parcel. After completing the transect examination of the area, both sides of the shallow drainage system were Walked.
