ThL11 Planning Commission heard the Rezone on this parcel in August of 1990 and while they could not support the apptiitants trig nal request for a'TM-5 zone; they made a recommendation to the Board of Supervisors for a 10 acre, zoning. The Board adapted a Conditional Rezone to TM -10 ih Fets of 1991. The property is bisected by BlackberryRoad. Th%area westerly of the road contains very steep slopes while the easterly part of the parcel has more gentle slopes. The proposed lot has a cleared area that appears to be suitable for a homesite. The surrounding parcels range in site from 80 acres to the south to a 5.8 acre parcel that abuts on the north. The project will involve approximately 19 acres of land located in Little Chico Creek Canyon, immediately north and west of Crown Point Road. Land. use change, involving future residential development, will follow Butte County approval of proposed parcel map. ,According to State and County definitions, the proposed project constitute,5 an '"undertaking" which. could adversely affect cultural resources which'might be located within the area of ;potential effect (APE). Accordingly, a cultural resw, , les inventory coupled with an assessment of the National 'Register eligibility status of any recordedsites, as well as a review of potential project impacts and a list of mitigative measures, is required pursuant to County requirements, and in compliance with Section 106 of the National Historic Preservation Act of 1966, as amended (16 U,S.C. 470), and Procedures of the Advisory Council on Historic Preservation (36 CFR 800). The remainder of this report details the results of the archaeological survey and provides a professional assessment of the cultural resources which might be affected by the project. All field work procedures followed guidelines provided. by the State Historic Preservation Office (Sacramento) and are in conformity With accepted professional standards. Location; The proposed Bruce Oliver land split pares -4 is roughly rectangular in shape and consists of apptdXimatcly 19 'acres located within a portion of the southeast quarter of Section 24 of Township 23 North, Range 2 page .1 East, of the USGS Paradise West, California (1980), 7.5' Series Quad. The parcel is located immediately north of Crown .Point Road's crossing of Little Chico Creek, and involves lands located on both sides of the creek, although c. 80% of the parcel is located on the creek's west side.. The land is currently undeveloped, and has been only moderately disturbed in conjunction with past tyre suppression activities, minor access road grading, and recreation. Records Search, and Project Context Prior to going into the field the archaeological records maintained by the Northeast California Information Center at Chico were examined for any existing recorded prehistoric or historic sites. Tn addition, the. National Register of Historic Places was also consulted (USDI 1989).. No sites were found to be, recorded within the Oliver property, although cleati archaeological sensitivity was indicated by the presence of Little Chico Creek, as well as on the basis of the positive findings which have accompanied previous archae-ological survey within this general area (e.g.� Jensen 198$). As regards ethnographic affiliation, the project area is located within northernmost Northwestern Maidu, or, Konkow Indian territory (Riddell 1978: - Figure 1). The Maidu are believed rto have occupied the east side of the Sacramento River wit "Uri the vicinity of Chico, extending southeasterly into and east of both Chico and Oroville.. For the Maidu within this canyon area, the expected .range of prehistori;y site types, based on the results of previous archaeological surveys and ethnographic studies, included (1) small aboriginal middens} occasionally associated with house pits and other surface features located close to water sources; (2) surface scatters of lithir artifacts and debitage resulting from short- m occupation and/or specialized economic activities,, (3) bedrock milling stations and petrogtyphs where suitable bedrock exposures exist; (4) rock shelters and small caves associated with exposed layers of lava within both _Big and Little Chico Creels Project 90439 F Paget . The Butte County General Plan as agricultural designates the entire area residential. The Agricultural Residential General Plan policies require that certain conditional criteria be present before zoning less than 2(l acres can be considered.. The criteria are. L compatible with neighboring agricultural activities. 2. Evidence of adequate water and sewage disposal capacity. 3. Availability of adequate fire protection facilities.- 4. Adequately maintained approved road, access with sufficient capacity to service area. S. Reasonable accessibility to commercial services and schools. The proposed rezone clearly does not meet criteria 3 through 5 and is questionable with regards to criteria I :Should this rezone be approved it will set precedent for the area, inducing growth and encouraging a higher population concentration away from existing urban areas. 13a,c,f,14e. The potentia$ will exist for the construction of two additional dwellings which will generate between 12 and 16 vehicle trips per day. This is not, by itself, significant. However, - the Crown. Point Road is in such poor condition that any additional traffic will impact the road.
