ABSTRACT: Attached please find a copy of our letter of approval for a detached Senior
�Qitizen Second Unit in the Forest Ranch area.. AS we have discussed before there is a
lot of concern by the residents in this area regarding the location of Senior, and Second
Units. We received many letters in opposition to this request stating that it was a violation
of the CC&Rs for Forest Ranch. We approved the request, after approval by the
Development Review Committee. The reason fora p the
approval �s based upon
requirements of state law and our local ordinance. State law, Government Coda Section
65852.1 etseq., indicates that 'no other local ordinance, policy, or regulation shall be the
basis for denial of a building permit or a use permit under this subdivision,... No additional
standards, other than those provided in this subdivision or subdivision (a), shall be utilized
or imposed, except that a local agency P P g cy may require an applicant for a permit. issued .
pursuant to this subdivision to be an owner."
Essentially, we have no authority sunder state law and the way our current ordinance is
viritten, to -deny this request. It shouldbe noted that there is an amendment to the
ordinance now before the Planning Commission, which, if adopted by the Board as

AGENDA ITEM
ANALYSIS, In this :application, Chris Johnson is asking to build a 1197 square foot stick built
dwelling. The purpose of this dwelling is to house the applicant's paramts, Albert & Shirley
Johnson. The purpose and intent of Section 24-202 Senior Citizens DwelOng Unit is to provide
for housing for persons 62 years of age or older. This request is in conformance with Section
65852 et se?. of the California Government Code. The purpose of a TM -5 (Timber Mountain
5 acre minimum) and General Plan designation of Agricultural -Residential is to provide for low
density rural residences in a mountain environment, while protecting the rraral characteristics
of the area. This project will not jeopardize the purpose and intent of this zoning and General
Plan designation. The surrounding parcel sizes are very similar in shape and size (5 acre
minimum) with the applicant's parcel. There are no second dwellings on nearby parcels.
There is adequate access to the site. All setback requirements have been met on the
submitted Site Plan, Water will be supplied by on-site well which is approximately over 200 feet
from the proposed septic leach lines.

1. The "living area," meaning the interior habitable floor space area of a dwelling unit
including basements and attics, but not including a garage or any accessory structure,
shall not exceed 1,200 square feet.
2. The senior citizen dwelling unit is intended for the sole occupancy of one (1) acquit 62
years of age or over or two (2) adult persons, one of whom is 62 years of age or over.
An affidavit of compliance with the age requirements of this section shall be recorded
In the office of the .Recorder prior to issuance of building permits. Said affildavit shall
include the legal description of the lot or parcel and shall constitute;a covenant running
with the land, binding upon the original owners and their heirs, successors and assigns,
limiting the occupancy of the senior citizen dwelling unit to the conditions described in
this section.
3 The senior citizen dwelling unit shall not be sold as a separate unit unless a parcel
containing the unit is created in compliance with the existing zoning and subdivision
