on this question and reviewing>the enclosed application, it appears that
the proposed use by Mr. Ted Mann is simply that of parking his garbage
trucks on This property-
In view of the fact that the application states that the property
in question is zoned A-2, the question of whether this activity requires
a use permit would depend upon whether it was required under ordinance 522
enacted August 29, 1955 as amended-by Ordinance 676 enacted June 27,
1960.. Under these ordinances all uses are permitted in an A-2 zone
except certain speci ied uses for which a use permit is required.
Parking of garbage trucks is not one of those uses mentioned for which a
use permit is. required.
In a previous opinion from this office on February 5, 1973, some
doubt was expressed as to whether a use permit was required for the
operation of a garbage transfer site. In that particular question, the
activities went far beyond those of the present situation in that,
among other activities, garbage was apparently being brought to the site
and dumped into trucks,. as well as the compacting of trash on the site.
?although that opL-i on ultimately came to the conclusion that the county
ordinances should be construed as requiring a use permit for that particular
type of use,it is our opinion that where the only use involved is simply
that of parking garbage trucks on the property, a use permit is not
required by ordinance 522 as amended.by ordinance 676.:
