5. The following are limitations or requirements for timber operations conducted under a Less than Three Acre Conversion Exemption (Notice, Notice
of Conversion Exemption, Conversion Exemption):
A. Timber operations shall comply with all other applicable provisions of the Forest Practice Act and regulations, county general plans,
zoning ordinances, and any implementing ordinances; copies of the state rules and regulations may be found on CDF's web page on the
internet at http://www.fire.ca.gov.
B. All timber operations shall be complete within one year from the date of acceptance by the Director.
C. All conversion activities shall be complete within two years from the date of acceptance by -the Director unless under permit by local
jurisdiction. Failure to complete the conversion iequires"compliance with'stoekitig standards and stocking report requirements of the Act and
'board regulations.
D. The timber operator shall remove or dispose of all slash or woody debris in accordance with 14 CCR 1104.1' (a) (2) (D). The timberland
owner may assume responsibility for the slash treatment, provided the landowner acknowledges in writing to tlie Director such responsibility
at the time of submission of this notice. The specific requirements shall be'included with the acknowledgment. ,
E. Timber operations shall not be conducted during the winter period unless a winter operation plan or in lieu practices required by Forest
Practice regulations are specified within (attached to) this Notice.
F. No timber operations are allowed within a Watercourse and Lake Protection Zone unless specifically approved by local permit (e.g.
county, city).
G. No timber operations shall•be conducted until the Director's notice of acceptance is received and a valid copy of this Notice and the
Director's acceptance shall be kept on site during timber operations.
K No sites of rare, threatened or endangered plants or animals or sp. of special concern shall be disturbed, threatened or damaged.

within the scope of professional forestry practice, provide information documenting that the conversion
to the stated non -timber use is feasible based upon;'at a minimum the following:

Slash treatment shall be as follows (14 CCR 1104.1 (a) (2) (D)):
(1) Slash greater than one inch in diameter and greater than two feet.long, and woody debris, except pine, shall receive full
treatment no later than April 1 of the year following its creation, or within one year from the date of acceptance of the
conversion exemption by the Director, whichever comes first.
(2) All pine slash three inches and greater in diameter and longer than four feet must receive initial treatment if it is still on the
parcel, within 7 days of its creation.
(3) All pine woody debris longer than four feet must receive an initial treatment prior to full treatment.
(4) Initial treatment shall include limbing woody debris and cutting* slash and wood] debris into lengths of less than four feet,
and leaving the pieces exposed to solar radiation to aid in rapid drying.
(5) Full treatment of all pine slash and woody debris must be completed by March 1 of the year following its creation, or within
one year from the date of acceptance of the conversion exemption by the Director, whichever comes first.
(6) Full slash and woody debris treatment may include any of the following: '
a. burying;
b. chipping and spreading;
c. piling and burning; or
d. removing slash and woody debris from the site for treatment in compliance with (a) -(b).
(7) Slash and woody debris, except for pine, which is cut up for firewood shall be cut to lengths 24 inches or less and set aside
for drying by April 1 of the year following its creation. Pine slash and woody debris which is cut up for firewood shall be cut to
lengths 24 inches or less and set aside for drying within seven days of its creation.
(8) Any treatment which involves burning,of slash o; woody debris shall comply with all state and local,fire and,air quality
rules. 'Slash and woody debris may not be burned by open outdoor, fires except under permit from the'appropriate fire
protection agency, if required;'iiie local air pollution contr&district or air'quality management district. The burning must
occur on the property where the slash and woody debris originated
The Licensed Timber Operator shall be responsible for the cleanup of logging slash and woody debris.
In lieu of a winter operating plan, site specific measures to be followed are:
During dry, rainless periods where saturated soils conditions, as defined in 14 CCR 895. 1, are not
present. Erosion control structures shall be installed on all constructed skid trails and tractor roads prior
to sunset if the National Weather Service forecast is a "chance" (30% or more) of rain within the next
24 hours.
The ground conditions do not match the USGS map conditions very well as far as the topography goes. The
conversion area location is based on how the conversion area lays on the property.

you are in violation of the'Butte County Code at the above referenced loca-
tion: As of this date, the following violations still exist.
Living in a bus and camper on the above noted parcel in violation of
the Butte County Code as follows:

With reference to the above subject and your letter received on May 5, 1992, below
are the answers to your questions:
(1) The Department of Public works is designated by the Butte County Code
as the Code Enforcement Agency for buildings. Authorization for
.enforcement for mobiles is pursant to the California Health and Safety
Code 18300 which requires the local enforcement.
Butte County Resolution 74-158 directs the Department of Public
Works to enforce the regulations pursuant to Health and Safety
Code Section 18300.
(2) The original deed which created the parcel will specify the date of
creation and should include a described right of way to the property.
(3) Attached are copies of Butte County Code Sections 24-21.95 and 24-21.31
which you requested; however, you are in violation of Section s 24-112.3
and 24-38 as previously stated in my April 21, 1992 letter as you are
living on the property.
(4) Wells and septic tanks are the responsibility of the Environmental Health
Department (538-7281).
Please begin the resolution of these violations in a timely manner, so we do not
have to involve'our code enforcement program.

Dear Sirs,
I received your April 21 answer to my letter of the 13th, but I found nothing concerning what rights
we have as land owners here in Butte County. Neither did you tell me where your power to act in such
forceful manner comes from, what your jurisdiction is and how am I bound by it For instance, why is the
department of Public Works involved in the Private nondestructive use of the Conoow Outback? And why
is the Building Inspector inspecting where there are no buildings? These are very basic questions, so
please answer them.
I don't know who can answer your question concerning whether the parcel was legally created and
has 60'right of way to a public road? We have neither Public Works or Public Roads around here, so I am
asking Phoebe Davenport, from whom I am buying the property., if she can help with your legality question.
The Private Road being used was developed on Private Land with the consent of its owners, at the common
law, before I came here. I said in my previous letter there are no public water, sewer, gas or electric utilities
available at the property in question --so why do you require permits for them? The well is permitted.
Please provide a copy of the Butte County Code sections 2L431095 and 2421.31 cited i_ n_ your /
letter to determine whether living and working on private property is defined as camping in the lode. Note
that I am in compliance with section 24-38(b) and (c) in that I have not placed more than a combined total of
two trader coaches... nor are there more than two families on the property doing agricultural uses and home
occupations, permitted by code section 24112.3, which requires that the proprietor resides on the
premises. I have no more than one assistant in connection with such use.
I am very concerned about State of California complaints that septic tanks contaminate the water
table and their intent to eliminate them. Please tell me what aitematives are offered by the county.
I want to be reasonable and prudent If going along with the Butte County Code you advocate is the
best way -to handle this situation, III do that, but you must consider my limited time and resources. I need to
examine the information you sent and any other pertinent sections of the Code which you may provide. I am
makings arrangements for public grant for the fees you require of me. What els can I do -Peace?

As I was ordered by you, I am responding to a CORRECTION NOTICE issued on the
Thirteenth of April, 1992. I would also like to inform you of my situation so that we are both aware of
what is going on, and to inform you of the circumstances in which I live.
I am a disabled. Vietnam Veteran, living on government handouts. I would be happy to fill you in
on the details of how I am disabled, or the extent of my disability.
I live on a, Private Road in the Concow outback. We have no Public or County Road, nor any
county services, except building inspectors and helicopter over flights. The land where I live is land-
locked and isolated.
I also have. -no Public Utilities, nor do I want any. I try to get along on very little.
My energy needs are modestly provided by bottled gas and a gasoline driven generator for
electricity, I have considered using alcohol, instead of petroleum-based fuel, because they say it bums
cleaner and is renewable. Could you please tell me if the Butte County Department of Public Works could
supply plans for making a still for this project? But I hope to eventually use Solar Energy only, it's free
and plentiful. Any suggestions you may have concerning Solar Energy and how to harness it would also
be most welcome. Providing me this information ought to be very important to the County and to the
State since they are so concerned with Clean Air that they are making us "smog" our cars.
- Our water comes from an established well which was blessed by your department a long time
ago. We use it conservatively because it is so expensive to pump water, due to all the taxes which are put
on everything we buy, including fuel for our survival. I do all I can to keep the water I drink from being
contaminated, including chlorinating it periodically and preventing anything from going into the well.
We take care of our basic needs very simply, by eating whatever food we can get, as long as it is
clean, especially our water. Our output is composted, so that we may use it for growing things, like plants,
flowers and grass. I; must confess that we occasionally "pee" on a tree, could you give us some guidance on
how to do this safely. Also, please tell us what the rules are for defecating in the woods. In Vietnam we
did our thing in- 55 -gallon drums which we later burnt using Diesel fuel; this was acceptable to the Army
as a sanitary way of doing business, but the neighbors would object around here.
I do not want to install a septic tank because it is my understanding that the County is on a
campaign to get rid of them, because they say that they are contaminating the water supply and I wouldn't
want to do that. I think it might be better to wait until you install sewers in the Concow area and I'll hook
up to them then, if I can afford it.

I would like to pay whatever you require, but times are hard and I am too poor to pay these fees
and, like you, I will have to find somebody who will give me money for nothing. I need to find some
charitable organization, or a non-profit one like the County, State or Federal Government to help me. So"
please, if you possibly can, allow me some time to find a way of borrowing from them so I can pay you.
Otherwise you will have to waive the fees.
I wish to make it perfectly clear that I am a peaceful man, as my neighbors can testify. I have
talked to them about your visit and told them that you said that "if I do not pay the fees, or get off the land
within 10 days,, I would be thrown out for the lack of permits & departmental approvals required to
occupy the property (living in converted bus & or camper in this case)." Neither I or my neighbors
can understand this forceful approach, or where you get the power to do this, so perhaps you could clarify
it for me, so I can pass it on to them. Can you tell us where we stand and how we can find your orders
concerning this matter.
First, please tell me what rights we have as landholders here in Butte County. Do we hold the .
land in what they callfee, or allodium, or what? Is it our land, or is it yours? I am interested in knowing if
I am buying this land from the seller of it, or if I am renting or buying from the County. My neighbors are
under the impression that we own the land, or are buying it from someone other than the County, as a
freehold. Please tell me, in writing, at your convenience, whether our tenure here is as vassals, or as
freeholders of the land.
I would also like to inform you that our neighborhood is very jealous of both our privacy and our
property rights, and that anyone who comes upon private property is trespassing and is subject to
citizen -arrest and prosecution. So please observe our property rights. I would like to remind you that
protecting these rights ought to be important to you, as a government employee.
I understand that under the Common Law, a man's home, no matter how humble, is his castle.
Besides, if you have me dispossessed, as you have threatened to do, where would I go? Have you
considered that? If you wish to pursue this matter further, please notify me through the mails.
