for your mobile home.

this office together with your check in the amount of $21.00 payable to Butte County
Treasurer. We have. the necessary plot plans to process when application received.
For your information, we are processing a claim for a refund of the building permit
fees you paid for a new residence.

It was indicated to us, that we -.should hear the -decision on
our permit by Sept. 7, 1973•
when I called on that date, I still received no satisfaction.
I requested you to write to me as soon as possible about the
permit. If you cannot do this on or before Oct. 5, 1973
please refund all of are money.
We have gone to great expense -to -,obtain the easement deed
which you, requested. We still can't understand why this
can not be issued.
Would it be -asking -to much to ex11 ct an answer one way or
the other.

Jim Glander and- I reviewed your .lette.r of August 1.1, 1972, in which you advised
us • about the background of Mr Smiths• and `'Townsend' s property division. , After
extensive review �q'f the Califolnid ana Butte County land division ordinances, Gre
find that the pro bleu was created7in•�1,966 when'the.original division was made.
Our examination and interpertation oftthe law":ind_icates that this was an illegal
division if it did not.have a 601 right of way to a public road or if a parcel
�. map ,was not filed giving a variance from the 601 requirement.

'To our knowledge neither of these circumstances were provided. This does not �
make'the problem any easier for Mr. Smith; but; as you can imagine, it does not
make it unique as -there are many under the same circumstances. We know of several
that are trying to solve the same `circumsta.nce of providing a deeded right of way
to an indefinite prescriptive right of way. I recall seeing one. fel o e the
e t�--amerob���n—in�he—Glieok�rQjust this la TP k� He was fortunate to
obtain a deeded right of way from one of his neighbors. We would have to suggest
that solution in this particular case.

by and between KATHARINE G. BOLLES (hereinafter called "Bolles"), 0 �

PARADISE PAR,, RECREATION & PARKWAY DISTRICT (hereinafter called
"District"), and JACK L. SMITH and JO'ANN SMITH, his wife, (hereinafter
called "Smith"),
WHEREAS, Bolles is the owner of that certain. parcel of real
Property situate in the County of Butte described in ExhAbit "A" hereto; and
WHEREAS, District is the owner of that'certain parcel of real
proper situate in the County of Butte described in Exhibit "Bp hereto; and
WHEREAS, Smith is the owner. of that certain parcel of real
Property situate in the County of Butte described in Exhibit "C" hereto; and
WHEREAS, by this agreement the parties hereto desire to
establish and grant each to the other an easement 60 feet in width to be
appurtenant to and for the benefit of each of their respective parcels as
hereinbefore mentioned;
NOW, THEREFORE, each of the parties, by execution hereof,
hereby grants to the other a non exclusive sase"ment for road and public
utility purposes over so much of a strip of land 60 feet in width lying 30 feet
on each side of the following described road centerline as licss within the

of the properties described in Exhibits "A", "B", and "C", and shall inure
to and be for the benefit of, and may be used by all persons who may hereafter

greement shall not create any duty or obligation on any of the parties
hereto to construct or maintaLa any road greater in width than now exists

poses over a strip of land 60.00 feet in width lying 30.00 feet on each side
of the' following described road centerline:
BEGINNING at the Northeast corner of Section 15, Township 22 North, Range 4

of the Northeast quarter of said Section 15, North 89° 56' 00" ' r est for a
distance. of 1214.90 feet to a 3/4' inch iron pipe tagged IS 2843 marking the
Northeast corner of the Northwest quarter of the Northeast quarter of said
Section 15; thence South 21 12' 29" west for a distance of 481.12 feet to
