On February 28, 2007, the Department of Development Services made the finding that
the Lot Line Adjustment on the above referenced property is exempt from environmental
review, and approved the project subject to the conditions on the attached page.
Should you appeal the decision of the Dept. of Development Services, please submit your
appeal, in writing, with the appeal fee of $50.00, to the Clerk of the Board of Supervisors,
25 County Center Drive, Oroville, California 95965, prior to 4:00 p.m., March 13, 2007.
The conditions of approval must be met within thirty-six (36) months from the date of
approval by the Department of Development Services or the approval will be considered
null and void.

CONDITIONS OF APPROVAL
Amanda Pyle, Lot Line Adjustment, LLA06-0052, 058-190-005, 082, 202, 204:
Lot line adjustment between four existing parcels ranging in size from 8.2 to 207.7 acres, resulting in
four parcels ranging in size from 44 to 160 acres in the Jordan Hill/Concow area., located about 1/2
mile west of Nelson Bar/Buzzards Roost Roads, near the Jordan Hill/ Concow area.. Engineer:
Richard Roper.
New lot or parcel lines shall comply with setback requirements of applicable zoning and
building ordinances.
2. Deeds and plats (if required) shall be submitted to the Department of Public Works, Land
Development Division, for checking and approval prior to recordation and shall contain the
notes specified below. Include a legal description signed by a registered civil engineer
licensed prior to 1982 or a professional land surveyor.
3. Provide documentation from a title company on the applicant's choice verifying any deed of
trust affected has been partially re -conveyed or modified to reflect the lot line adjustment and
to prevent the creation of any additional lot or parcel.
4. Prior to recordation of deeds, provide documentation verifying payment of taxes as reguired
by Subsection (b) of Section 20-95 of the Butte County Code and as specified in Article 8 of
Chapter 4 of Division 2 of Title 7 of the Government Code, commencing with Section 66492.
5. Provide approved access to each resulting parcel in conformance with the Butte County
Code: a minimum RS -8 -LD -1 access road with a minimum 60 foot wide easement.

The purpose of this deed is to effect a lot line adjustment as approved by the County of Butte on
. The above described lands are to be combined with and become a part of
those lands as described in the deed to as filed for record in
Butte County Official records at Serial Number Book
at Page . No additional lots or parcels are created hereby. The scope of
review of said lot line adjustment was limited as specified in Government Code Section 66412(d), and
approval of it does not constitute assurance that future applications for building permits or other land
use entitlements on the modified lots or parcels will be approved by the County of Butte.

Dear Mr. Morrison:
The above referenced Assessor's Parcel numbers are shown as being owned by Amanda Pyle or the
Preservation Trust (same mailing address) in your area of concern. We have been investigating all
complaints and will continue to do so, however it appears at this time the California Regional Water
Quality Control Board has the most authority over the grading activities on th'_s property to date. It has
been determined that the excavation and embankment volumes were each less than one -thousand cubic
yards and therefore the grading was determined to be exempt from the Butte County Code requirements
for obtaining a grading permit.
A review of the building department records indicates she has not recently applied for a building permit.
Issuance of a building permit for a new single-family residence on any of these properties would trigger
the requirements of Public Resources Code (PRC) 4290, which may require improvement to the access
road/driveway. The Butte County Fire Department would make a determination after the application was
made and prior to issuance of a building permit. Enclosed for your reference is a copy of their handout
for general requirements. The fire safe regulations of PRC 4290 do not apply until there is a structure
requiring protection by the Fire *Department. The issuance of building permits is a ministerial act, exempt
from environmental review under CEQA and therefore not required to comply with the public notification
requirements of Public Resources Code 21092. If a discretionary permit is applied for the County will
comply with the appropriate notification procedures, by copy of this letter I am also asking them to keep
you in mind.

Dear Mr. Kuykendall:
We in the community, continue to be concerned regarding the development in the West
Branch of the Feather River Canyon by Ms. Amanda Pyle. I am formally requesting that
I be notified by your office when and if a building or grading permit is applied for by
Amanda Pyle for her properties (#058-190-204, #058-190-202, #058-190-103000, #058-
190-071000, and #058-190-082000) in the Feather River Canyon area.
I also am bringing to your attention an extremely dangerous situation whereby Ms. Pyle
has designated the road she has recently cut into the Feather River Canyon to be a Fire
Road. Fire and emergency access roads as well as private roads and driveways have
specific state requirements to ensure safety. Ms. Pyle's road completely fails these.tests
and if used as an emergency access road, let alone as a driveway, it could have tragic
consequences.State code requires that a road or driveway not exceed a grade or 16%,
have turn -outs every 400 feet if the road exceeds 800 feet, includes additional surface
width for curve allowances and be engineered to accommodate a fire truck or other
emergency vehicle weighing up to 40,000 pounds. The road in question at some points is
measured at an extremely dangerous grade of 27% and averages 20% of incline.
,Additionally, there is no visible engineering to re -enforce the structure of this road, nor
are there any turnouts. In addition, the dirt road is subject to erosion, which could
completely undermine it.
I would further draw to your attention the erosion's effects upon.1he adjacent growth,
which will likely place a large number of trees in jeopardy. The effect upon the riparian
integrity of the Canyon will be enormous.
Because this safety matter has not been addressed in response to earlier correspondence
to your office by Mrs. Cynthia Arrington, I feel it necessary to bring this matter to the
attention of Ms. Jody Loner an, District Director, CA Dept. of Transportation.

We as a neighborhood continue to be greatly concerned regarding the development in the
