You have not obtained building permits for the structure and have failed to install a water supply and an approved sewage disposal system. Section 26-1 of the Butte County Code states that the County has adopted the 1976 Edition of the Uniform Building Code. The Uniform Building Code requires that all persons constructing buildings within the County of Butte, except for agricultural buildings, are required to obtain a permit from the County Building Department. Section 26-6 of the Butte County Code states that: "It shall be unlawful for any person, firm, or corporation to erect, construct, -alter, repair, move, remove, improve, convert, demolish or equip any building or structure in the unincorporated areas of the County or to cause the same to be done contrary to or in violation of any of the provisions of this chapter. "The use or occupancy of any building in violation of any of the provisions of this chapter is hereby declared to be a public nuisance and may be abated in a manner provided by law." Sewage emptying, flowing, seeping or draining into any stream, spring, river, lake or other waters within the county. c. Sewage being accessible to rodents, insects or humans. It is provided, however, that when sewage is treated and disposed of in such manner that it does not constitute a hazard to the public health or does not create a nuisance, and that adequate require- ments for such disposal are set by the regional water pollution control board pursuant to Division 7, Department 4, Article 2, of the state Water Code, the health officer may by special permit allow such variation from this section as will prevent unnecessary hardship or injustice and at the same time most nearly accomplish the general purpose and intent hereof." Section 31-8 of the Butte County Code provides for refuse removal and states that: "The owner or tenant of any premises, business establishment or industry shall be responsible for the satisfactory removal of solid wastes accumulated by him on his property or his premises. Garbage shall not be allowed to remain on the premises for more than seven (7) days, to prevent propagation or attraction of flies, rodents or other vectors, and the creations of nuisances. Where garbage and rubbish are containerized together, the period of removal shall be that applied to garbage. "There is determined to be no mandatory refuse collection in the unincorporated area of Butte County and the determination of which method of safe, sanitary removal of such refuse is to be determined by the property owner or tenant generating such refuse. "All garbage shall be stored in suitable non- absorbent, leakproof,'structurally sound containers covered with close fitting lids which will prevent the entry of flies and rodents and prevent the escape of odors. February 1, 1983 "It garbage storage containers are furnished by the garbage collector, it shall be the responsibility of the collector to maintain the containers in a good and sanitary condition. Containers with a capacity of one cubic. yard or more, furnished by the collector, shall be clearly marked with the collector's name and telephone number. (Nothing herein shall be deemed to prohibit the collector from charging the customer special charges resulting from the requirements of this paragraph.)" Section 1-7 of the Butte County Code provides that any violation of any provision of the Code constitutes a misdemeanor or in the discretion of the District Attorney, be charged as an infraction. The penalty for a misdemeanor is punishment by a fine not exceeding $500.00 or imprisonment. The punishment for an infraction shall be a fine not to exceed the sum of $500.00. Therefore, you are to immediately cease occupying the dwelling on your property located on Granite Ridge Road in the Jordan Hill area, until you have obtained the proper permits, inspections and approvals from the Butte County Department of Public Works. DATE: January 13, 1983 This department has been involved with Diana Lee Palomares since March 23, 1982 concerning a dwelling unit built without permits on Granite Ridge Road, Jordan Hill area. She has not obtained building permits for the structure, failed to install a water supply and an approved sewage disposal system. She continues to live in the dwelling per information from the complainant. History: March 23, 1982 - Complaint received by Environmental Health - al! eg hazardous, unsafe dwelling on Palomares property - Granite Ridge,Road. April 6 1982 - Visit made to property. No one home. Structure ' consisting of wood, plastic sheeting, etc., and an illegal pit privy. observed. Dwelling not entered. April -8, 1982 - Letter mailed to Ms. Palomares to.cease occupancy of the structure and to arrange joint inspection of the structure. (see attached letter)., April 27, 1982 - Post office returned the letter to Environmental Health, Ms. Palomares did not respond to notices from post office on April 10,15 and 25, 1982.. May, 19, 1982 - Notice remailed. May 28, 1982 - Revisit made to the site by the undersigned and Philip Nelson. Ms. Palomares contacted, and original notice dated April 8, 1982 handed to her by the undersigned. June 10, 1982.- Copy of notice mailed 5-19-82, returned by post office. June 28, 1982 - No response to notice handed.Ms. Palomares on May 28, 1982. July 26, 1982 - Visit to property. Road chained. Posted No Tres- passing. Y. August 27 , 1982 - Visit to property. Car in road. Road chained. Posted. Appeared occupied. December 29, 1982 - Contacted complainant. She indicated Ms. Palomares still is occupying the structure. During this visit an accumulation of trash, dunk and garbage was observed on the parcel, along with an illegal pit privy, which are in violation of the Butte County Code, Chapter 19 -Sewage Disposal, Section 19-4 Unlawful Sewage Disposal Methods, Chapter 31 -Section 31-8, Refuse Removal. An inspection of the exterior of the dwelling revealed construction materials and methods in violation of the Uniform Building Code, Uniform Housing Code, and Uniform Plumbing Code.
