Alternative #2 would seem to be the cheaper way to go, provided you do the tear down and salvage as much of the material as possible. This would also require plans, and permits. Tearing.down the structure would have the effect of releasing you from the power of the county. The onsite inspection disclosed support bearing piers within two (2) feet of the septic tank and covered deck over the septic tank. This situation is in violation of Butte County ordinance chapter 19 setback requirements. The minimum setback between septic tank and weight bearing piers foundation is 5 feet. Options available to resolve this matter consist of the following: 1. Reconstruct the deck so that piers meet the minimum 5 foot set back requirement to tank and removed the portion of deck over tank. 2. In general, if a violation exists on a parcel, we do not issue additional permits until the violation is resolved, so this was a large concession on our part, made to assist you. 2) In numerous conversations and negotiations between myself and Mrs. Strawn since the permits were applied for, we have discussed the fact that the decks and ramada remained in violation, and the permit must be issued within one year from date of application, or the application fees would be lost, and we would issue a citation to appear in court. 3) Since your ramada and decks were built without permits and at this point continue to be considered a code violation, a refund of permit fees is not available.
