Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Nathan Miller is hereby granted a Minor Use Permit in accordance with application filed: Minor Use Permit to construct a second single-family dwelling on property zoned FR -2, on a 20 acre parcel. 1. Failure to comply s. ith the ::anditions specified herein as the basis for approval of applicatic;.n and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Minor Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established' within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respecive designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Minor Use Permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: 1. The second dwelling unit shall not exceed 1,200 square feet. 2. Provide two additional off-street parking spaces. An attached or detached garage or carport with a maximum exterior dimension of 20' by 24' is permitted. 4. Adequate sewer and potable water facilities shall be provided under permit as determined by the Butte County Environmental Health Division. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. No permits for any additional dwelling may be approved unless a Use Permit is granted by the Planning Commission. 7. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 8. Building identification and/or addresses shall be installed iii conformance wi`w ili`U11c Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 9. Stiles to Ten Seventy Corporation, a California Corporation,: recorded on December 27, 1967, Book 1499 page 313.- Michael Vieira, Manager Butte County Building Department March 28, 2002 PURCHASE OF THE GHIMENTI PROPERTY ON JULY 17, 1996 When the Ghimenti family purchased the Ghimenti property on July 17, 1996: 1. There was an old skid -trail scar on the property which was, and is, overgrown with brush and trees; Tom Wrinkle has identified trees which are growing within the old skid -trail scar which are at least 15 to 20 years old. 2. The old skid -trail scar was, and is, blocked at both ends, as follows: 2.1 At all times since July 17, 1996, there has been (and is) a fence across the old skid -trail scar at the southerly border of the Ghimenti property. 2.2 At all times from July 17, 1996, until approximately January 2002, there was a large brush pile across the old skid -trail scar at the northerly border of the Ghimenti property. In January 2002, that brush pile was removed in connection with the construction of an underground utility trench (for telephone and electrical service). At all times since then, the Ghimenti family has blocked the old skid -trail scar with a fence at the northerly border of the Ghimenti property. 3. The Ghimenti family did not have any knowledge of any alleged roadway easement across their property, when they purchased the property on July 17, 1996. THE CONSTRUCTION OF MICHAEL GHIMENTI'S HOUSE When Michael Ghimenti purchased his Building Permit Number 00-2898 from County of Butte, neither he, nor County of Butte, had any knowledge of any alleged roadway easements through the Ghimenti property. Michael Ghimenti has completed construction of his house. Apparently, toward the latter stages of construction, one of the neighbors asserted that there is an old roadway easement in the vicinity of Michael Ghimenti's new house. County of Butte has declined to issue a final inspection for Michael Ghimenti's new house "until the easement has.been resolved". 2 Michael Vieira, Manager Butte County Building Department March 28, 2002 A corner of Michael Ghimenti's new house (as approved by County of Butte) is in close proximity to the old skid -trail scar; it is impossible to know if the new house is on, or near, the old abandoned easement. SCRIPTION OF THE ALLEGED ROADWAY EASEMENT Subsequent to the commencement of construction, and the issuance of the Building Permit, it was discovered that the prior Grant Deed from Maurice Stiles and Grace D. Stiles to -Ten Seventy Corporation, recorded on December 27, 1967, contains two easements, as follows: "Together with an easement for road purposes 15 feet in width in the Southeast Quarter of the Northeast Quarter of the northwest Quarter as conveyed in the Deed from David A. Dion et ux to Maurice v. Stiles et ux as recorded October 3, 1960, in Book 1079, of Official Records, at page 254. Also together with an easement for road purposes 60 feet in width over and along an existing road, which road begins at the Southeast corner of the Southwest quarter of the Northwest quarter of said section 34 and runs thence in a Northwesterly direction to a point on the South line of the parcel herein described." Tom Wrinkle of Sierra West Surveying has determined that the first easement (15 feet wide) is not located on the Ghimenti property, but is instead, located upon Assessor's Parcel Number 58-56-11; it is not an encumbrance upon Ghimenti property. Tom Wrinkle of Sierra West Surveying has determined that the second easement (60 feet wide) is located on the Ghimenti property, but that it does not extend beyond the southerly boundary of the Ghimenti property. The current owners of the property which is located to the south of the Ghimenti property (the owners of APN 58-55-11) have asserted that there has never been a roadway across their property during their memory and they have never used any alleged roadway across the Ghimenti property. THE LEGAL POSITION OF THE GHIMENTI FAMILY The legal position of the Ghimenti family is the following: 1. The old abandoned roadway easement is a useless 3 Michael Vieira, Manager Butte County Building Department March 28, 2002 easement which goes nowhere (by its terms it terminates on the southerly border of the Ghimenti property), and it was abandoned through non-use many years ago. 2. The old abandoned roadway easement has been lost by adverse prescriptive use for substantially more than five continuous years. There are trees and shrubbery which belong to the Ghimenti family which are at least 15 to 20 years old which preclude the use of old abandoned roadway easement as a "roadway". 3. Even if there was an alleged roadway in existence in. 1967 upon the Ghimenti property, it would be very difficult to demonstrate the exact location of said old abandoned roadway in the year 2002. 4. I have advised the Ghimenti family that it will be necessary for them to file a quiet title civil action and declaratory relief civil action to ask the Butte County Superior Court to declare the rights, duties and obligations of the parties in connection with the old abandoned roadway easement. To the extent that County of Butte was continuing to refuse to issue a final inspection for Michael Ghimenti's house, it would be appropriate to include County of Butte within the civil action. REQUEST FOR ASSISTANCE It does not appear to me that there is any lawful basis for County of Butte to refuse to issue a final inspection for Building Permit Number 00-2898. Please advise me as to the legal basis upon which County of Butte is refusing to issue the final inspection for Building Permit Number 00-2898. Thank you.
