For your protection, -you should be aware that as "owner -builder" you are the responsible parry of record on such a permit. Building permits are not required to be signed by proper, owners unless they are personally performing their own work. If your work is being performed by someone other than yourself, you may protect yourself from possible liability if that person applies for the proper permit in his or her name. Contractors are required by law to be licensed and bonded by the State of California and to have a business license from the city or county. They are also required by law to put their license number on all permits for which they apply. The Uniform Building Ccde defines "structure" as follows: 11STRUCTUR- —s `LAwl- . L built Or L : constructed, an eaifice or building of any kind, or any piece of work artificially built up or composed of parts joined together in some definite manner." UBC Section 420. A building permit is required for a building or structure to be erected, constructed, enlarged, altered, repaired, moved, converted or demolished. UBC 301(a). No exemption is specified for signs. UBC .301(b) . Advertising signs are specifically allowed in various zoning districts. BCC 24-102(A)(4), C-1(Light Commercial) Zone; 24- 105(A)(2), 4 - 105(A)(2), C-2 (General Commercial) Zone; BCC 24-113.5(a)(6) L -I (Limited Industrial) Zone; 24-114 (a) (6) M-1 (Light Industrial) Zone and 24-117(a) (1) M-2 (Heavy Industrial) Zone. The Zoning Ordinance may subject to securing a use permit. H -C (Highway Commercial) Zone. also allow signs in some zones See for example BCC 24-113(b) (4) 2.30 May 1995 In addition, the provisions in the Butte County Code which. govern highway and street setbacks require a use permit for light poles or commercial signs within the setback area. See BCC 10-8 and 10-10. In view of the above code provisions, it is the position of County staff at this time that a building permit is required for outdoor advertising signs and can only be issued if i4gns are specifically allowed in the zoning district. In those situations where signs are allowed in the zoning district only,lf a. use -';permit is first obtained, then the building permit could not.issue until the use permit is obtained. There is a separate use permit requirement if the sign, is to be located within the highway or street setback area. Thus, assuming that the sign is permitted under the applicable zoning district, it is still necessary to obtain a use permit pursuant to Chapter 10 -of the. Butte County Code. I hope this answers your questions. Please give me a call if you would like to discuss the matter further. We would be open to receiving your suggestions regarding possible amendments to the County Code which could: 1) ensure that signs are constructed and placed in a safe manner and 2) streamline the permitting process. Although to date we have not adopted a sign ordinance, signs are not specifically exempted .by the Uniform Building Code, and fit the U.B.C. definition of a structure. ';'herefore, effective this date we will require a building permit for signs and light poles over ten (10) feet in height, and more than twenty (20) square feet in area. When repairing or replacing the advertising backing surfaces galy, we will require a written description of the work to be done, or a set of plans which we will review to .determine whether or not a permit is necessary. In general, if the advertising panels do not remain the same size, wind load and weight, or if support poles are changed, we will require a building permit and verification that the existing structure is adequate. Plans and calculations prepared by a qualified engineer or architect licensed to practice in the State of California will be required for the footing and pole, post, or column, and other components. Permit fees will be based on estimated or contract price when available. Light poles will be valued at $1000 for up to a twenty (20) foot pole, $2000 for up to a thirty (30) foot pole. As has been our policy in the past, electrical permits will be required for signs and light poles supplied by a branch circuit from a building, or by a separate electric service. Permit fees will be based on the current electric fee schedule for branch circuits:,for signs, outline lighting, and marquees. Existing law provides that every city or county that requires the issuance of a permit as a condition precedent to the construction, alteration, improvement, demolition, or repair of any building or structure shall, in addition to any other requirements, print certain declarations on any building permit issued, including a declaration verifying workers compensation coverage and a certificate of exemption from workers' compensation insurance, as specified. This bill would revise the form of the workers' compensation declaration verifying coverage or exemption from coverage. The bill would require the various declarations on the permit to be signed under penalty of perjury, thus imposing a state -mandated local program by expanding the scope of a crime. The bill would require the Contractors' State License Board to semiannually compile and distribute to city, county, and city and county building departments a list of all contractors who did not secure payment of workers' compensation, as required by the workers' compensation law, during any period for which workers were employed during the preceding six months. Existing law provides that every county or city that requires a permit for construction work on any building or structure shall require each applicant to have on file a certificate of workers' compensation insurance or a certificate of consent to self -insure, with specified exceptions. This bill would instead require that each applicant sign the workers' compensation declaration required to appear on the issued building permit pursuant to the above provision of law. The bill also would require contractors, at the time of permit issuance, to show their valid workers' compensation insurance certificate. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. The People of the State of California do enact as follows: SECTION 1. Section 19825 of the Health and Safety Code is amended to read: 19825. The clearance by the Division of Environmental Health will verify, before construction, that a proper sewage system can be established or that the construction will not interfere with an existing sewage disposal system or that the construction will not take place in an area that has been designated as a replacement leach field.
