AGRICULTURAL STATEMENT OF ACKNOWLEDGMENT
FOR RESIDENTIAL DEVELOPMENT
Section 26-8 of the Butte County Code required this acknowledgment to be recorded prior to issuance of a building
permit. The property described herein is adjacent to land or included within an area zoned for agricultural purposes,
and residents of this property may be subject to inconveniences or discomfort from the use of agricultural chemicals,
including, but not limited to herbicides, pesticides, and fertilizers; and from the pursuit of agricultural operations
including, but not limited to cultivation, plowing, spraying, pruning, and harvesting which occasionally generate dust,
smoke, noise, and odor. Butte County has established agricultural purposes and residents within said zones and on
adjacent property should be prepared to accept such inconvenience or discomfort from normal, necessary farm
operations.

The portions of the Southwest quarter of the Southwest quarter of Section 5 and the Northwest quarter of the Northwest
quarter of Section 8 all in Township 21 North, Range 4 East M. D. B. & M., lying Easterly of the parcels of land described and
designated Parcel AA (ORO -248) and Parcel BB (ORO -248) in the Deed from Pacific Gas and Electric Company to the State of
California dated December 21, 1965 and recorded in Book 1411 of Official Records at page 151, Butte County Records.
Excepting therefrom all oil, gas, other hydrocarbon substances, minerals and naturally created hot water and steam in and
under that portion of said real property lying within the boundary lines of the Northwest quarter of the Northwest quarter of
said Section 8 lying below a plane which is 500 feet below the surface of the ground; provided, however, that any exploration
for or removal of any such oil, gas, other hydrocarbon substances, minerals, and naturally created hot water and steam shall
be by means of slant drilling or tunneling from lands adjacent to said real property or other methods not requiring operations
on the surface of said real property and shall be performed so as not to endanger said surface or any structure which shall be

All that certain real property situate in the County of Butte, State of California and being an easement for ingress and egress
over a strip of land of a uniform width of 60.00 feet, the centerline of which is described as follows:
Beginning at the Northwesterly corner of that certain Parcel of land described as resultant Parcel 15 in that certain Certificate
of Merger filed for Record in the Office of the Recorder of the County of Butte, State of California under Recorders Serial No.
2002-0029548; thence leaving said point of beginning along the Northerly line of said Parcel 15, said line being also the
centerline of Nelson Bar Road, along the following courses and distances: South 880 40'30" East, 83.90 feet, along a tangent
curve to the right with a radius of 150.00 feet through a central angle of 360 55'00" for an arc length of 96.65 feet; South 510
45'30" East, 81.92 feet, along a tangent curve to the right with a radius of 200.00 feet through a central angle of 200 52'51"
for an arc length of 72.89 feet; South 300 52' 39" East, 138.04 feet, along a tangent curve to the left with a radius of 150.00
feet through a central angle of 320 26'34" for an arc length of 84.93 feet; South 630 19' 13" East, 135.20 feet; thence leaving
said Northerly line, South 260 40' 47" West, 30.00 feet to a point on the Southerly line of said Nelson Bar Road, said point
being the true point of beginning of the Parcel herein being described; thence leaving said true point of beginning along the
following courses and distances: South 850 40'34" West, 51.87 feet; North 730 35'52" West, 206.91 feet; South 880 38'48"
West, 138.60 feet, from a tangent bearing of South 680 49'23" West, along a curve to the left with a radius of 154.63 feet,
through a central angle of 430 53' 51" for an arc length of 118.47 feet; South 240 55' 32" West, 91.56 feet and South 300 05'
56" West, 27.72 feet more or less to a point on the Easterly line of that certain Parcel of land designated as Parcel 13 (APN

BUILDING PERMIT APPLICATION WITHOUT REQUIRED CLEARANCES
I request and authorize the Building Division to process this building permit application through the plans
examination process WITHOUT first obtaining all necessary, related permits and clearances from other
regulatory entities, including but not limited to, Planning, Environmental Health, Land Development,
County Fire, and Agriculture.

The Building Division will process the application through the plans examination process, as submitted,
without input from other regulatory entities that could prohibit issuance of the building permit or require
submission of amended building plans to the Building Division. Once the plans examination process
begins, there will be no refund of plans examination fees.' Any changes requiring submission of amended
plans to the Building Division will incur additional fees.
Within one year from the date of application for a building permit, all other required permits and clearances
from other entities must be obtained for the permit to be issued. Failure to obtain these permits/clearances
will void the application.7
Typically other required permits/clearances include, but are not limited to, verification the parcel was
legally created, adherence to. all mitigations and conditions imposed on the parcel at time of creation, as well
as zoning requirements, legal access, and applicable set -backs and environmental issues (fire, agriculture
buffer zones, and habitat/species).

Parcel Creation Deed
• If your parcel was not created by a County -approved map, you may be requested
to submit a "deed of creation".
• Creation deed(s) can be obtained most economically and quickly from the title
company that handled your escrow for the purchase of the parcel.
You may simplify and expedite the review process by submitting a deed of
creation for the project with your application or as soon as possible after your
application has been submitted.
A creation deed is the deed that created a piece of land, into its current configuration.
This process is commonly called a subdivision. Prior to March 41' of 1972, a parcel of
land could be divided by a grant deed, and gift deeds were recognized until February 91h
of 1993. Note: documents that create real property are not limited to grant and gift
deeds.
Staff is required to review each division to ensure that it was created in compliance with
the State Subdivision Map Act, and Butte County Code. A creation deed is required to
determine that the legal description matches the current configuration, the parcel meets
applicable zoning requirements, and that the parcel has the appropriate access to a
publicly maintained road. The exact date of creation and type of deed will also be

trees and brush now or hereafter on said easement area and the further right
from time to time to trim and to cut down and clear away any.trees on said real
property to said easement area which in the opinion of first party may
be a hazard to first party's facilities by reason of the danger of falling
thereon, or may interfere with the exercise of first party's rights reserved
herein; provided. however. .that all trees which first party is hereby
authorized to cut and remove, if valuable for timber or wood, shall be the
property of .second party, but all tops, lops, brush and refuse wood shall be
burned or removed by first party;
(c) to install, maintain and use gates in all fences which now cross or
shall hereafter cross said easement area; and
(d) to mark the location of said easement area by suitable markers set in
the ground. provided that said markers shall be placed in fences or other
locations which will not interfere with any reasonable use second party shall
make of said easement area.
First party.,agrees to indemnify second party against any loss and damage
which shall be caused by the exercise of said ingress and egress or by any
wrongful or negligent act or omission of first party or of its agents or
employees in the course of their employment.
Second party shall have the right to use said easement area for purposes
not inconsistent with first party's full enjoyment of the rights hereby
reserved; provided that second party shall not erect or construct any building
or other structure, or drill or operate any well, within said easement area.
