A.P. -72-0-018 Sir. You sent us a notice dated 10-14-99 stating; "FAILURE TO OBTAIN THE REQUIRED PERMITS, INSPECTIONS AND APPROVAL FROM THIS OFFICE FOR -THE CONSTRUCTION OF A TWO STORY RESIDENCE. I have a problem with your "FORMAL NOTICE" against us for several reasons. FIRST; I replied to your original "COURTESY NOTICE dated 05-21-99 in a timely manner. I addressed the questions you raised to the best of my knowledge. I also requested that you contact.me, in writing, if there was any problem with my assumptions. YOU NEVER DID. This led me to believed the problem to be resolved. Then, almost five months later, you threaten me with a citation., SECOND; You say that construction. residence was purchased the I failed to get the required permits for I explained in my original response. The in place, exactly as it is now, when we property. Mr Rutherford, the only work we did on the house was repair and maintenance. In fact, before any repairs were done, we contacted Butte County Building Division in person and requested.that an inspector come to our property. In the summer of 1985 two Butte County building inspectors.came to the property. They told us we could repair the exterior trim, fix broken stairs, repair the front porch and paint the house. They said we needed a permit to add a bath and construct a rear porch. We never did any additions or construction work. THIRD; Bias and uneven enforcement of codes. It appears to me and others with knowledge of code enforcement, there may be a bias in your code enforcement. Mr. Brown aggressively pursues us after we complained of an illegal business operating on an adjoining property., then, just "WINKS" at the preponderance of credible evidence showing that Mr Pejsa is operating a salvage business. Mr Brown did have Mr Pejsa "string" some unattractive blue tarp in the woods. When a neighbor commented on the ugly tarp, Mr Brown laughingly said; "I like ,it. It really looks good to me." Mr Brown never addresses the .true problem; An illegal, dangerous and toxic business operating in a retirement community. Mr Brown took what he thought was the. easy way and aggressively attacked the complainant. With that said; I contacted your office upon receipt of the FORMAL NOTICE, dated 10 -15 -99, -Mr Brown telephoned me and advised that I obtain all documents and see you before proceeding any further. Mr Brown also mentioned you had some pictures of the house being built. If in fact you have pictures, I would like to see them. I mentioned to Mr. Brown I was leaving on a trip shortly. Mr Brown said it would be all right to delay our meeting and to contact you on my return. I look forward to our meeting. Your "courtesy notice" is more than just a bit odd. I say this because: 1. The two story residence you mention was constructed about twenty-five to thirty years ago. Enclosed is a copy of my 1985 Title Report. I was given that report when' I purchased the property and two story structure. Notice that our two story building is clearly identified in the Title Report. In addition, Butte County has taxed the building - exactly as it is - each year since I bought the property.. J believe that it has been on the tax roles for at least twenty-five years. 2. There is no patio cover on the property. None. However, there does exist a free standing pole shed. The nearest pole shed is twenty-five or thirty feet from our residence.. It was built in 1988 as a rain cover for a camper shell and miscellaneous gardening supplies. - Free standing pole sheds, of course, do not require a permit. At least that's what your office told us in 1988. 3. There is nothing courteous about your notice. In fact, it threatens me with CJ RE: You May 21, 1999 "courtesy notice" regarding A.P. ##058-72-0-018 5/30/99 citations, fines, and so on. It is particularly galling that you threaten me for building a two story building that I did not build. That is clearly NOT courteous. The most polite thing I can say' is its nuts! You "courtesy notice" was evidently generated after my neighbors and I complained about the existence of an unlicensed and un regulated dump and commercial junk yard in our community. Our area is zoned FR -10. That does not include commercial dumps or junk yards. Evidently you "courtesy notice" was generated as a perfect example of "shifting the attack onto the victim." That, by the way, is a classic - if reprehensible - defense attorney tactic used in rape cases. As a matter of fact, I do not have construction drawings for my two story home. Nobody gets construction drawings, copies of the original Butte County permits, etc. when they buy an older home. All a buyer gets is a Title Report, which is based on Butte County's records. That's just the facts of real life. If any one owes you a permit fee, and I doubt that this is the case, it would have been the original contractor and/or owner(s). As a matter of interest, I doubt that a jury would find it credible that Butte County could collect twenty five years of property tax on my house and then try to claim in court that the County Building Division did not know the house was there. I recommend that you re- examine the County's records and (if necessary) re -visit the property. I recommend that you then close your case out. Once you have done so, please so advise me in writing.
