He said it was apparent.from th_s that the parcels had already been surveyed before the lot was bought. (6-2-000) Mr. Lenhard stated that people often invest_.in property with a vision of future development, and that few people could afford to hold onto large parcels. Mrs. Blair stated that there appears to be a violation on 7 parcels created .by Frank Wilann and moved to file Notices of Violation on. the subsequent property, which would have been in violation from that point (L�5) . After discussion with Brian Rix, she changed her motion to state that there was a violation of the Sub Map Act. There were further questions from the audience concerning procedure, and why some.. -:.permits had been issued and others were now being held. . Mrs. Blair restated the motion to find the resulting parcels of AP 62-X45-02 in violation of the Sub Map Act, her motion was seconded by Mr. Toussaint and the decision was unanimous (138)..(Parcels included AP 62-45-13, 27, 26, 18, 25, 24, 29, 28, 17, 16, 15, 149 21, 20 & 06, those north of Big Bend Road). There was then discussion of access to those parcels. Mr. Toussaint and Mi -r. Vanhart stated that most of the lots were. large enough for .septic tanks. Ivirs. Blair then stated a motion -to issue Certificates of Compliance on those parcels, subject to:. 1. Verify deeded access and the right to use. o46 -et��>'� aff 2. Provide traversable access (defined as being traversable by a standard two -wheel vehicle in all weather except snow) .&,o,*49y - Pair. P+iendonsa stated that private roads must be maintained by the property owners. It was the unanimous'decision of the Committee to issue the Certificates, subject to the above conditions. (212) There was discussion of the resulting parcels from -AP 62-45-05. Mrs. Blair stated that AP 62-45-37 appeared to have been separated after 1%'larch 4, 1972, and would be in violation. There was then discussion bet%-.een Mr. Reynolds and staff of unrecorded contracts of sale. Brian Rix asked if the parcels had been surveyed before March 1972 and was told yes. Mrs. Blair stated that she would like to continue this portion of the hearing pending. an opinion from County Counsel concern- ing unrecorded contracts of sale. There was further discussion of this parcel and whether or not a Certi�i.cate of Compliance could be issued if the parcel was brought up to standards. Mrs. Blair stated that a Certificate of Compliance could be issued upon filing of a parcel map.
