AP# 058-720-037 SYNOPSIS At the time the citation was issued, Mr. PEARSON had not obtained the required permits, inspections and approvals for the trailer -with -addition that he and is family are living in or for the utilities. Since the citation was issued, Mr. PEARSON has paid the application fee for the required permits but has not paid the required penalty fees. He stated to. me that he has only mailed one letter using this procedure and he remembers placing the letter in the mailbox. 12-13-89 Citation issued to Mr. PEARSON. 01-18-90 Mr. PEARSON applied for the required permits from the Building Department. THE CHARGES On 12-13-89 Mr. PEARSON was issued a citation at his residence for the following Butte County Code violations which were charged as infractions: Charge One. Butte County Code Chapter 28A, Section 28A-1 adopted the Mobilehome Parks Act, of Title 25 of the California Code of Regulations by reference. Section 28A-2 is the charging section for violations of Mobilehome and Mobilehome lot standards. (a) Section 1018. - Permits are required for mobilehome utilities and building construction. The Butte County Building Department has required Mobilehome Utility Permits since 4-21-72. (b) Section 1048 - Inspections are required for mobilehome utilities. (c) Section 1324 - Permits are required for mobilehome installation. The Butte County. Building Department has required mobilehome installation permits since. I- 20-75. (d) Section 1326 Inspections are required for mobile home installations. Charge Two. Butte County Code Chapter 41, Section 41-2(d), "Failure to Comply with 2nd Notice". The Building Department sent a letter to Mr. PEARSON dated 11-23-88. This letter (called the ten day letter) advised him, in general terms, that violations had been noted on his property and that he needed to obtain the required permits. The Building Department sent the second warning notice, with proof of service, to Mr. PEARSON on 10-5-89. This letter advised Mr. PEARSON that he had not cleared the violations and listed the violations in very specific terms and directed him to apply for the required permits within 30 days or he might receive a citation. HISTORY Mr. PEARSON stated to me that he obtained the property from a Mr. Donald R. MANN via an unrecorded gift deed in 1971. Donald R. MANN was held to answer in the Butte County Superior Court on charges of illegally subdividing land. The matter was resolved in August of 1977, Case # 64162. This case included the subdivision that Mr. PEARSON lives in and the parcel that he obtained from Donald R. MANN. Donald R. MANN was ordered to pay $16,070.15 with respect to the "subdivision of property in Butte County without compliance with the Subdivided Land Act or the Subdivision Map Act". Former Deputy District Attorney, George ROBISON, stated in a Case #.64162 document: "The People, therefore, did not become aware of the creation of such sibdivisions or the offer or sale of parcels created in such subdivisions until 1976.". The Building Department can require that an applicant provide a "Certificate of Compliance" prior to any permits being issued or finaled. Butte County Code, Chapter 20 - Subdivisions, Article 7 - Violations and Certificates of Compliance, Section 20-160, in part: "no county officer, department or employee shall issue any permit or grant any approval necessary to develop any real property which has been divided, or which has resulted from a division, in violation of the provisions of the State Subdivision Map Act or the provisions of this chapter if the development of such real property is contrary to the public health or the public safety." Section 20-160 also states, in part: "such permits shall be issued or approval granted if development of such real property is not contrary to the public health or the public safety and a certificate of compliance is issued pursuant to this chapter. Mr. PEARSON told me that he could have recorded the gift deed in 1971 but that he didn't get around to it. Mr. PEARSON told me that because he had not recorded the gift deed in 1971 that the property was in dispute when Donald R. MANN and Mrs. MANN were going through there divorce. Mr. PEARSON wrote on his "application for determination" (certificate of compliance application) : "Property was given as a gift in 1971 but title was not delivered & recorded untill 4- -78 as title was tied up in divorce of Don MANN". The divorce of Donald Ray MANN and Darlynn Lee MANN was Butte County Superior Court case # 55099. The interlocutory judgment of dissolution of marriage was heard on 3-23-73 and this document was recorded in book 1848 and page 464. This document listed how the Mann properties were to be divided. The final judgment of dissolution was signed on 8-3-73. The ownership of the property was further complicated around the time of the MANN divorce because the property had been in the name of Clarine . K BRANNON and she claimed that the property was hers. In the Donald R. MANN judgment in case # 64162 it stated: Defendant (MANN) shall immediately cause all real property of which he is the owner, located in Butte County, to be deeded into his own name or the names of those persons who are the actual owners. The judgement was dated in August of 1977. A gift deed was finally recorded in April of 1978. The gift deed stated: "Don Mann, who aquired title as Clarine IC BRANNON hereby grants to Frank D. PEARSON and Shizuko PEARSON". Mr. PEARSON finally obtained a Certificate of Compliance for parcel # 058-720-037 on 3-1-89 and this document was recorded as #89-09706 on 3-20-89. Mr. PEARSON did not have any obstacles for his obtaining Building permits and approvals once he obtained the Certificate of Compliance in March of 1989. Prior to the citation being issued Mr. PEARSON had still not applied for the required permits. On 1-18-90 (after the citation was issued and prior to court) Mr. PEARSON came in and applied for the required permits. Mr. PEARSON paid $637.70 for the permit applications. This did not include the penalty fees that have not been waived and are still due. On 6-29-82 the Butte County Board of Supervisors passed Resolution # 82-110 which became effective on 7-1-82. This resolution established fees to be charged by the Building Division of the Department of Public Works and included item #10 -Penalty Fees which reads as follows: "Penalty Fees When work for which a permit is required by the Butte County Code is started or proceeded with prior to obtaining said permit, the permit fees specified in this resolution shall be tripled, but .the payment of such triple fee shall not relieve any persons from fully complying with the requirements of the Butte County Code in the execution of the work, nor from any penalties prescribed therein. This penalty provision shall not apply to emergency work when it shall be proved necessarey and that it was not practical to obtain a permit therefor before the commencement of work. In all such cases, a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such a permit, a triple fee as herein provided shall be charged." The Butte County Building Official, Jim GLANDER, advised me in this matter that once a 2nd warning notice has been mailed that a violator has. lost any possibility of not having penalty fees imposed. In this matter Mr. PEARSON did not apply for the required permits until after a citation had been issued. The.Building Official stated that the permit fees and penalty fees are required by resolution and hopes that the Court would not consider eliminating or reducing these fees in a judgment. (f) This section shall remain in effect only until January 1, 1994, and as of that date is repealed, unless a later enacted statute, which is enacted before January 1, 1994, deletes or extends that date.
