If you plan to do your own work, with the exception of various trades that your plan to subcontract; you should be aware of the following information for your benefit and protection: o If you employ or otherwise engage any persons other than your immediate family, and the work (including materials and other costs) is $500 or more for the entire project and such persons are not licensed as contractors or subcontractors, then you may be an employer. o If you are an employer, you must register with the state and federal government as an employer and you are subject to several obligations including state and federal income tax withholding, federal social security taxes, workers'' compensation insurance, disability insurance costs, and unemployment compensation contributions. o There may be financial risks for you if you do not carry out these obligations, and these risks are especially serious with respect to workers' compensation insurance. o For more.specific information about your obligations under federal law, contact the Internal Revenue Service (and, if you wish, the U.S. Small Business Administration). For more specific information about your obligations under state law, contact the Department of Benefit Payments and the Division of Industrial Accidents. If the structure is intended for sale, property owners who are not licensed contractors are allowed to perform their work personally or through their own employees, without a licensed contractor or subcontractor, only under limited conditions. A frequent practice of unlicensed persons professing to be contractor is to secure an "owner-builder"=Building w permit, erroneously implying that the property owner is providing his or her on labor and material personally. Building permits are not required to be signed by property owners unless they are performing their own work personally. Information about licensed contractors may be obtained by contacting the Contractors' State License Board's automated telephone information system at 1-800-321-CSLB (2752) or by accessing their website at www.CSLB.ca.gov. Please complete and return the enclosed owner -builder verification from so that we can confirm that you are aware of these matters. The building pen -nit will not be issued until the verification is returned. Sincerely, 4ut t e'L Scott Rutherford Manager, Building DiviVion NOTE: This Owner -Builder Information is required by Section 19830 of the California Health and Safety Code. The structure was constructed by you without an underfloor framing, plumbing, and electrical inspection, and there seems to be ; some question as to whether or not the SIP panel connections to the underfloor cripple walls, and cripple wall shear panels were inspected.- However, there is no question that a number of other items were covered without inspection. ?Partially as a result of this lack of inspections, there are a number of items that simply cannot be overlooked. After a review of the corrections written on the 12th, and our subse6ment site inspection and review, I must agree with the corrections already written and woule add the following items. 1 You do not have approval to insulate or sheetrock until these items are resolved and signed off on your job card. Sincerely, Scott Rutherford Manager, Building Division srutherford@buttecounty.net 2 Apr 28 07 03:26p george donoho 5305338626 p.1 ,r To: Scott Rutherford, IIead Building Inspector Butte County Building Department 7 County Center Drive Oroville, CA 95965 Fax(530)538-7785 From: George A. Donoho 13499 Vista Ridge Road Yankee Hill, CA 95965 Licensed Architect #16334 (original issued in 1962) Permit #0612 r&PKQ A' D0'CA NO. C 16334 C V i Dear Mr. Rutherford: 06-_ X?12 ' &I The first thing we did when we purchased parcel #058-800-030 was have it red - tagged because transients refused to leave the premises (we called the police on them months before but they would not protect our community and respond to the call because we did not own the property, as owners were deceased. Butte County is teaching us that we need to handle these affairs ourselves.) We then demolished the buildings and logged the premises. We removed what stumps we could and ground down the ones we couldn't. It wasn't -feasible to remove the large pine stumps because a significant amount of ground matter would go with them. We positioned the house so that the stair step perimeter foundation was in solid ground, free from any tree stumps. Currently, we have drilled holes in the stumps that are within our construction, filled these holes with potassium nitrate, saturated with water and then cover with 6 ml poly. We called for a framing inspection in September 2006, but after no one responded, we looked at the job card and found that framing inspection and sheer had been signed off. Naturally we thought that we had missed the inspector but we had proof that he was here and signed off, so we told our crew to proceed with construction. On March 20 we called for a plumbing and electrical inspection. On March 21, 2007 not one but two inspectors came to the job site in separate cars. The woman of the two frantically searched for the job card and wrote at her signature garage only. We are building this spec house in accordance with the permitted plans and it is your job to make sure of that. Occasionally it is overlooked that a worker doesn't do something right and we appreciate it when your department catches this. Obviously everyone is capable of making a mistake but one must take full responsibility for such a mistake and not put tremendous burden on another. George A. Donoho is fully responsible for the design and building of each of his houses. As much as you want to prove him wrong, he .has proven his expertise by creating houses in Sacramento, Cameron Park, Eldorado Hills, Placerville, Redding, Chico, Gridley, Yankee Hill, Shingle Springs, Riverside and Fresno since 1955! Making us tear apart this spec house, to show you what George confirms was done, because your inspector forgot what he or she signed off is placing an insurmountable burden on us. On March 21, 2007 Richard Nixon spent two hours, not checking off everything that was done, but looking meticulously for everything he could question. George A. Donoho has cooperatively built houses for fifty years, so why would he, change course now? In explaining that the plumbing/electrical trench had to be filled up because the rain was causing the conduit to float to the top, Nixon said that we would have to dig it up to A r 28 07 03:26p george donoho 5305338626 p.2 show him. We did just that and when Nixon returned to inspect he said that was fine. Once again, we got no credit for that because all he wanted to do was find fault on the job site. We took his list and explained or corrected each item and brought this to 7 County Center Drive on March 23, 2007, but in your last letter you gave us no credit for complying with the nineteen items on Nixon's list. We will fax this, also. In response to your letter dated April 19, 2007, we have answered it as follows: 2. See roof framing plan on sheet 5 (shows 2x4 wall to +64" for bedroom wall) Detail D shows glulam beam. My cale's indicate beam set 48" into this wall will be satisfactory. 3. Moss Lumber has'provided the requested certifications. 4. S.I.P. panels are screwed to ridge beam and outside walls with 12" long screws @ 6"o.c. (these are visible) The interior wall is not a required structural support, therefore these 12" screws are at 12" o.c. as per SIP Builder engineer. 5. This conduit was exposed @ 32" depth with 2" water line and 1/4" phone conduit. After you looked at it, I back filled it to avoid an accident. 6. I used Simpson S T 6224 @ 48" o.c. horizontally. I had no roof rafters to attach to so I used the rimboard and 2x4's in overhang using 16d nails(18 ea.) See attached detail. 7. This has been corrected. We cut out the roof O.S.B. for req'd. inch clearance. 8. Done. All vents and cleanout are to code. Test was done. 9. Done. There are no openings or voids at joint between foundation and siding. 1.0. Ducts are 4". Air flow requirement is 53 cfm for each ceiling outlet. See cale's. 11. Done. I installed the requested through floor drain. 12. Done. We provided the 6'8" headroom at stair. 13. Done. We installed shear panels above 2"d floor to carry assumed potential Ioads. 14. There are no window openings close to any vents. 15. Done. All items have been completed as noted. Cj; ty® Nixon Corrections: 3-21-07 list v ` 1. Verify roof straps and screw @ 8"o.c. rso. e ica3A A See as built detail for Simpson St6224 2. Verify shear ?' It is conceming just one aspect of this project, the Structural Insulated Panels for the Walls and Roof. Our company, sipbuilder, has been working with SIPS for 2.o years and would like to explain how the panels were connected to each other, ridge beam and to the subfloors. First, the soleplate was set back 1/2 inch from the edge of plywood and glued to the subfloor with adhesive. it was then nailed, In rows of three 16 D every -16 inches to the Joists and every 8 Inches at the rim. The wall panels were nailed -With 8D nails at 4 % into the soleplate on both sides and at all seams; both sides and at the top plate as well. This is true -for the upper walls on the gable ends. The roof was nailed on the seams and where lumber was installed at the same 4 % with 8D nails around the entire panel perimeter. The screws were Installed as per the manufacturers recommendations. The ridge and eave connections were at 6 with factory screws. These screws are designed to make an i ile penetration into iridgebeam and lumber at the floor Ifne at eaves. We did use longer screws at the eave location for better attachment. The screws at the ridge were i2' and at the eaves.were 1.11 New Mohawk Road Nevada City, California 95959 530-265-6027 Fax 530-265-4477 Apr 28 07 03:35p Ceorge donoho 5305338626 p.1 04/23/2007 16:10 5302654477 SIPBUILDER INC PAGE 02 14'. Specifically, the violations include: 1. The keeping of junk and inoperable vehicles in public view. This is an advisory notice that these uses are in violation of the Butte County Code, as follows: Butte County Code, Chapter 24, Section 24 110 -The FR -10 (Foothill Recreational, 10 acre minimum parcel) zone does not "specifically authorize" large accumulations of junk. The storing of more than 100 square feet of "junk" on a parcel is one of the items used to determine that a "junkyard" condition exists. A "junkyard" is not an allowed use in the zone without a Use Permit. "Automobiles and other vehicles, dismantled, in whole or in part" are considered to be "junk." Chapter 11, Section 11-4 forbids people, whether at a licensed junkyard location or not, from storing junk in public view. The determination that these violations exist on the property is based on the following definitions in the Butte County Code: Butte County Code, Chapter 24, Section 24-305.240 - Junk. Any worn-out and discarded material in general that may be turned to some use including, but not limited to, any old iron, wire, copper, tin, lead, rags, paper, bags, lumber, empty bottles, bones, parts of bicycles, tricycles, baby carriages, automobiles, and other vehicles, dismantled, in whole or in part, kept, stored, located, situated or piled in public view, and all other similar personal property ordinarily defined and classified as "junk" kept, stored, located, situated or piled in public view and not screened from public view by a fence. Rev'd 11/4/2004 Butte County Department of Development Services ADMINISTRATION' BUILDING • GIS = PLANNING 7 County Center Drive Oroville, CA 95965 (530) 538-7541 Telephone (530) 538-2140 Facsimile OWNER -BUILDER INFORMATION Dear Property Owner: An application for a building permit has been submitted in your name listing yourself as the builder of the property improvements specified. For your protection you should be aware that as "owner -builder" you are the responsible party of record on such a permit. Building permits are not required to be signed by property owners unless they are personally performing their own work. If your work is being performed by someone other than yourself, you may protect yourself from possible liability if that person applies for the proper permit in his or her name. Contractors are required by law to be licensed and bonded by the State of California and to have a business license from the city or county. They are also required by law to put their license number on all permits for which they apply. If you plan to do your own work, with the exception of various trades that your plan to subcontract, you should be aware of the following information for your benefit and protection: 0, If you employ or otherwise engage any persons other than your immediate family, and the work (including materials and other costs) is $200 or more for the entire project and such persons are not licensed as contractors or subcontractors, then you may be an employer. o If you are an employer, you must register with the state and federal government as an employer and you are subject to several obligations including state and federal income tax withholding, federal social security taxes, workers' compensation insurance, disability insurance costs, and unemployment compensation contributions. o There may be financial risks for you if you do not carry out these obligations, and these risks are especially serious with respect to workers' compensation insurance. o For more specific information about your obligations under federal law, contact the Internal Revenue Service (and, if you wish, the U.S. A frequent practice of unlicensed persons professing to be contractor is to secure an "owner -builder" building permit, erroneously implying that the property owner is providing his or her own labor and material personally. Building permits are not required to be signed by property owners unless they are performing their own work personally. Information about licensed contractors may be obtained by contacting the Contractors' State License Board in your community or at 1020 N Street, Sacramento, California 95814. Please complete and return the enclosed owner -builder verification from so that we can confirm that you are aware of these matters. The building permit will not be issued until the verification is returned. Sincerely, -zz I Scott Rutherford Chief Building Inspector NOTE: This Owner -Builder Information is required by Section 19830 of the California Health and Safety Code.
