Richard and Pat Hall_ AP 58-25-85, northeast quarter of Section 3, T22N R4E. off of Kirby Creek Road, Concow area..'(cont'd from 11-1�-79) Mr..Mendonsa mentioned that he had talked to Mr. Rich Shipley on the phone and explained to him that this property was in the Ben Culet area.. Mr.. Rich Shipley, representing Richard Hall, said that he has talked to the perspective purchaser's agent and the people do intend on applying for. building permits for the.property, but they do not know when this will be. Mir: 14andonsa said that `this could be acted on and then the new .purchaser could take over title to the property. However, if there is another action taken on this property later, it would have to be_c®naidered as a new applica- tion and another $100 application fee would need to be paid. .He mentioned that a canditional Certificate of Compliance could be granted today and this might help with the sale of the. property,, :Mr. Gaiser asked what the conditions would be. i Mr; Meridonsa replied that a condition would be to do the roadwork. This roadwork has to . be completed by Mr. Ben Culet because this is part of his court judgement. Mr. Mendonsa mentioned that there had been a probation hearing for Mr. Culet this last Monday. He thought that Mr. Culet had until August 1, 1980 to complete the work. Mr. Shipley asked, "With the conditions being what they are right now and if we were to come back in two weeks with a new owner applying for a building permit, would there'be anything to prevent myself --representing the Halls -- from applying for that?" Mr. Mendonsa replied; 'To, as as the application was made. The appli- cation goes with the land; it does not go with a specific property owner." Mr. Reid said that Phil Nelson (of Oroville Environmental Health Department) had told him there were areas.'lor.nae iage and areas for water wells. He also said that whoever scants to develop the property will need to get all the necessary permits so that a well is not located in.the area to be used for leach lines, Mr. Mendonsa said that he could not see why a conditional Certificate of Compliance could not be issued now to the current owner. Mr. Shipley erentiored that the property itself does not border on the upper road. Mr. Mendonsa indicated the location of the roads on the map. Mr. Shipley thought that the property pins may be set back from the roadway. Mr. Mendonsa said that if property pins are found,.the parcel probably fronts that upper road. Air. Mendonsa. said. that the same conditions as Mr. Culet has to do on the court Judgment are the condi,tirns that will be placed on the conditional Certificate of Compliance. He also .menticned that the committee should note that the road is traversable at this time and that this parcel is in an area where these is a court judgment. He further mentioned that another motion will be made to permit the issuance of a building, permit an the property. - Mr. Reid roved to Irant a conditional Certificate of. There is a fifteen -day appeal period before this conditional Certifi- cate of Compliance can be recorded unless a waiver is signed waiving your right to appeal the Committee's decision. Since you have already signed the waiver, we will go ahead and record your conditional Cer- tificate of Compliance. The Subdivision Violation Committee also authorized County departments to issue permits for one residence on AP 58-25-85, noting that a con- ditional Certificate of Compliance was issued and that allowing the issuance of a single dwelling permit will not be detrimental to the public health or safety of the people of Butte County. These requirements are minimums and will be superseded by Butte County local regulations which equal or exceed these standards. Field inspections will be made by the Butte County Building Department for compliance. ] 1272.00 Maintenance of Defensible Space. To ensure continued maintenance of properties in conformance with these standards and measures and to assure continued avail- ability, access and utilization of the defensible space provided for in these standards, annual maintenance must be provide for by the land owner. Driveway Standards �) 1273.02 Surface. All driveway surfaces and structures (bridges, 1273.07 culverts and other apparte-i-ant structures which supple- ment the roadway bed or shoulders) shall provide unob- structed access to conventional drive vehicles, includ- ing sedans and fire apparatus weighing up to 40,000 pounds. [�] 1273.03 Grade. Not to exceed 16 percent unless paved. 1273.04 Driveway Radius [�] 1. No roadway shall have a horizontal inside radius of curvature of less than 50 feet and additional sur- face width of 4 feet shall be added to curves of 50- 100 feet radius; 2 feet to those from 100-200 feet. ] 2.
