All non-current., carrying metal parts of the mobilehome (aluminum siding, gas line, water line), including fixtures and appliances, shall be tested for continuity from such equipment and the grounding conductor. 6. Upon completion of the above procedure, the power supply cord or feeder.assembly conductors, shall be connected to the site service equipment. A further continuity test 'shall then be made between the grounding electrode and the chassis of the mobilehome. Upon satisfactory completion of the electrical tests, the lot or site service equipment may be approved for energizing. 10. Is job card signed by Health Department for water and sanitation? 11. McCorkle have undertaken and constructed; at their cost and expense, a sewer line in the easement described in exhibit "A" attached hereto and incorporated herein; said works completed in accordance with specifications approved by the County of Butte. A WHEREAS, each of the Parties hereto owns land that will be bene- w fitted b � said works; NOW THEREFORE, it is mutually agreed by the Parties hereto as follows; r 1. For so long as the above mentioned works shall exist in private ownership, the Parties hereto, their successors and assigns, shall bear the expenses of maintaining them in good repair. It is agreed that the cost of maintaining said works shall be paid by the Parties hereto, their successors and assigns, in proportion to the number of land parcels owned by each owner and/or their successors and assigns, and each owner will, upon written demand, contribute.and pay his proportionate share of any monies paid out by any of the several owners or of any ob- ligation incurred for the reasonable maintenance or repair of said works. 2. "Reasonable maintenance, or repair" shall not include the en- largement or improvement of said works and this agreement,shall not be -1- w LOW C=« construed to require any owner to contribute to the cost of any enlargement or improvement of said works. 3. • This agreement shall not relieve any owner or person from. lia- bili.ty for substantial damage to said works when such damage is caused by their fault or neglect. Any owner may bring action in any court of compe tent jurisdiction in the County of Butte on behalf of all owners to colt" ct the cost of repairing such damage. , 4: Any owner may bring actions in any court of competent jurisdic- tion in the County of Butte to enforce collection of any monies due from any owner as their proportionate share of the cost of the reasonable mainten- ance or repair of said works, and in any such action or actions the prevail- ing. revail-ing parties shall be .entitled to recover. a reasonable attorney's fee to be "fixed by the. court in such actions. r 5. For the purposes of. this agreement, the decision of the owners of a majority of the parcels -to the effect that specified repair or mainten- ance work is necessary shall be conclusive on the remaining owners and the decision of said majority as to the reasonableness of the cost of any such r.epair or maintenance work shall be conclusive on the remaining owners provided that said cost does not exceed the average of three inde- pendent cost .estimates secured not more than 60 days prior to commence- ment of the work. 6. The owners of a majority of the parcels may authorize the crea- tion of a maintenance and repair account in a savings and loan association or bank. Monies deposited therein shall be expended only for maintenance . and repair of the above referenced works and the number of signatures re- quired to withdraw monies shall'be specified at the time said account.is authorized. -2- CV 0 WWI UO 7. Receipts for all monies received and of all expenditures made shall be preserved and made available for inspection and copying by any owner, in person or by agent, for a period of one year. 8. The word "owner", as used herein, shall mean one person in whom sole title is vested'. It shall also mean two or more persons who hold a unity of interest as joint tenants, as tenents in common, as'part- ners, or as husband and wife with title vested "as their community prop- erty:' For the purpose of determining if the owners of a majority of the parcels are in favor of a proposal, the affirmative vote of any spouse, joint tenant, or tenant in common shall constitute approval by that parcel. 9. This agreement may be terminated at any time by the vote of the owners of two-thirds of the parcels. Upon termination of this agree. - e rxient, any monies remaining unexpended shall be distributed to the then owners of all parcels in the same proportions as received. ke 10'., This agreement is to be construed as a covenant running with the land, and it is further understood and agreed that this agreement shall inure to and bind the' successors in interest of the parcels owned by all the parties hereto, whether -by way of sale, assignment,. inheritance or other- wise, and it shall be applicable to such smaller parcels as may be created by subsequent divisions of said parcels.
