Box 104 - Stirling City, CA 95978 RE: Butte County Code Violation Vacant lot between 17207 and 17221 Manzanita Street, Stirling City, CA AP#059=087=002 Dear Mr. & Mrs. Ewton: This is a courtesy notice to notify you that you are in violation of the Butte County Code, as follows; at the above -referenced location. Butte County Code Section 24-64 Applicability of zoning regulations. All uses of land within a zoned district not specifically authorized or permitted by regulations are prohibited. Pursuant to Chapter 24, Section 24-64, "All uses of land within a zoned district not specially authorized or permitted by the regulations are prohibited". The "U" Unclassified) zone, (Section 24-195), does not "specifically authorize" large accumulations of junk. The storing of more than 100 square feet of "junk" on a parcel is one of the items used to determine that a "junkyard" condition exists. A "junkyard" is not an allowed use in a "U" zone. "Automobiles and other vehicles, dismantled, in whole or in part" are considered to be 'junk". Chapter 11, Section 11-4 forbids people, whether at a licensed junkyard location or not, from storing junk in public view. Butte County Code Section 31-8 - The owner or tenant of any premises, business establishment or industry shall be responsible for the satisfactory removal of solid wastes accumulated by him on his property or his premises. Garbage shall not be allowed to remain on the premises for more than seven (7) days, to prevent propagation or attraction of flies, rodents or other vectors, and the creation of nuisances. Where garbage and rubbish are containerized together, the period of removal shall be that applied to garbage. GARBAGE: Shall include all kitchen and table food waste, and animal or vegetable waste that attends or results from the storage, preparation, cooking or handling of foodstuffs and shall include bottles, tin cans, and other containers and papers contaminated with garbage. RUBBISH: Includes nonputrescible solid wastes such as ashes, paper, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery, plastics, rubber by-products and litter: REFUSE: Includes garbage and rubbish. No person shall place or park or allow the placing or parking of any trailer coach, recreation vehicle, tent trailer or tent or otherwise occupy or allow the occupancy of any parcel for the purpose of camping on public or private property within the county for a period in excess of nine (9) days in any one (1) calendar year. In order to comply with the Butte County Code, you are hereby requested to: 1. Remove all garbage, rubbish and refuse from your property and maintain a regular removal schedule in accordance with Butte County Code, Section 31-8. 2. Cease and desist in the operation of an auto repair/auto dismantler business at the above - referenced address and that you remove all inoperative/junk vehicles from your property. 3. Cease and desist in allowing persons from camping on your.property in accordance_ with -Butte County Code Section 24-38(a). The Department of Public Works advises that the public right-of-way is located 40 feet from the center line of either side of Manzanita Street. Vehicles that are parked within this area are required to have license plates and current registration property displayed. The public right-of-way, whether or not the entire area is actually used for highway purposes, is not to be encroached upon. The term "encroachment" includes any structure or object of any kind or character placed, without the_ authority of law, either in, under or over any County highway. Although parking of properly registered vehicles is allowed within the public right-of-way, the intent of this policy is to preclude the permanent parking and or storage of vehicles which are not operable on the public right-of-way, which may create a safety hazard. In order to comply with the Butte County Public Works policy, you are hereby directed to remove your vehicle(s) from the public right-of-way. Butte County Code Section 19-3 - Sanitary Sewage Disposal System Required. It shall be unlawful for any person to maintain, occupy or use any building not provided with a sewage disposal system which disposes of sewage in a sanitary manner. Butte County Code Section 19-4 - Unlawful Disposal Methods. It shall be unlawful for any person to construct, maintain or use any sewage disposal system which results in any of the following: (a) Sewage overflowing any lands whatever. (b) Sewage emptying, flowing, seeping or draining into any stream, spring, river, lake or other waters within the County. (c) Sewage being accessible to rodents, insects or humans. Butte County Code Section 19-5 - Permits Required. (a) No person shall begin or cause to have begun construction of any building or any sewage disposal system without first submitting plans of the means of sewage disposal to the Health Officer and obtaining a permit therefore from the Health Officer. (b) No person shall construct an auxiliary sewage disposal system for a building presently served by a sewage disposal system without first submitting plans of the proposed means of sewage disposal to the Health Officer and obtaining a permit therefore from the Health Officer. Ewton July 2, 1993 Page 3 s (c) No person shall extensively alter, repair, relocate, add to or replace any existing sewage disposal system without first securing a permit therefor from the Health Officer. In order to comply with the Butte County Code, you are hereby requested to submit plans of the proposed means of sewage system repair and or disposal to the Health Officer and obtain a permit from the Health Officer. It is the County's goal to obtain voluntary compliance with the Butte County Code. However, you should be advised that Butte County has an active Code Enforcement Program which provides an effective means of enforcement if voluntary compliance is not -obtained. Enforcement may be pursued through the issuance of citations, fines and the -recording of a Notice -of. Violation including a description of the action necessary to abate the violation.
