Tuttle 7 County Center Drive Oroville, CA 95965 Dear Ms. Tuttle: 1 have received the copy of the l.otLor prepared by maul C. Jensen, dated September 4, 1984, concerning my proposed division of AP #61-08-136. Apparontly Mr, Jensen is tieating the "panel re qr-1►` as though it had been adopted by the Board of Supervisors and constitutes the later of Butte County. r believe that that is incorrect. T h e map proposed complies With ell of the zoning applicable to the property and complies with the general. plan. Further, as x indicated in a prevl:ous letter, there is no evidence on the property itself that the property is affected by any de -,,r herd.. 1 have made a specific study of the property, as compared to the broad brush used by the Dept. of Fish and Came. As you no doubt are a% -,are, the Dept. of Fish and Game identifies Bald. Rock itself as critical reinter deer range. They have identified the entire area rather than specific areas. Regardless of the numberof parcels that are .f made on this parcel mnp, the act is that close to half of the property will be left in its original. state. As I indicated previously, 1 really don't see any possible impact on deer herds. As 1 indicated previoilsly, l believe that some consideration should be given to the termination of hunting as a means of reducing pressure on the deer population, rather than terminating places for people to live. I person ado not hunt and 1 beIJ.eve that it is unreasonable for the Dep L-. of Fish and Game, or anyone else, to expect me to buy land to devote to their desire to hunt. The bulk of this parcol i, covered by manzhnita growing from granite, Tha;, is .he portion rehash would Hast likely be developed for residential use. Since deer do not eat either manzanita or granite it should be expected that the forage for deer M Y Page 2 September 13, 1984 will be improved as :Lawns and gardens are planl:.uu, rather than decreased. Very truly yours;, George Robison GRrcar cc Ron Graves i . . GEORGE ROBISON Buffa Co. Planning COMM. EP 121981 ATTORNEY AT LAW P.O. Ms. Tuttle: I have received your letter dated September 5, 1984, and Appendix F attached thereto. n. rosponse thereto I hereby offer the Following comments. During the Past year I have traversed the subject ,property and the parcel immediately adjacent thereto on many occasions, In fact, I have crawled through the man— zanita and brush, which is evidenced by the ribbons that I tied in the brush as I went along, and cut several. trails across the property. in addition to my Personal examination of the property I have met 1vith several other people who hove examined the property, including the surveyor. Several of those people are avid hunters and I would consider them to be experts on deer habitat and migration routes, I don't expect ativ Sir, I.,nificant chatir- in either topography or ground surfttUa relief features. .1 new road of approximately 1,000 -feet w:11.1 be required for the division but that road does n0i' Mluire significant cut or fill, The route takes a very gentle upgrade to the higher elevation of the property; the result being that there is v( ry little in the way 0." earth movement except on the ro,_idway it— self. The existing -road serves federal land lying to the South )E this property and the Department of interior, Porest Service, has refused to abandon the easement. Thereforr,j that roadway is being 'Upgraded and slightly real.igned. The realignment results in less earth movement than wwild have been required had the road been rebuilt it its original location. There no doubt will be some increase in wind or water or sion of soils on site. There should be no impact off ,. te, 110"Ver 1 it 18 expected to be minimal in view of Lhe fact that large Parts of the Property already are covered faith exposed granite, The chances are that development of the Property will result it, some reduction Page 2 September 11, 1984 RE: Tentative Parcel Map 0 of water erosion because it can be expected that anyone developing the property would attempt to preserve or incronse chi available sail. I expect to build on one Parcel aly,.301r, and expect to bring soil in rather than do anything which would reduce the soil. There is nothing on the property which would indicate any potential for landslides, mud slides, ground ,failure or similar hazards. I -would say that it would be virtually i m,t o s s i b I e for there to be a mud sI i de on -Phis property and that it is highly unlikely that there would be a landslide. The northerly facing portion of the property has a very gentle slope and the Southerly facing portion of the property includes massive granite shelves and massive granite Outcropings with very substan— tial trees growing therefrom. There is no indication that; there has ever been a landslide on the property, including the Southerly Portion of the property which has a very steep slope. It, would be impractical to con— struct any improvements in the steeper areas so a change in that topography is not expected. My sever al months observance of the property indicates that there is no wildlife livilig year ground on the property, apart from squirrels and lizards, There ,is virtually no food on the property of the type cnnsumed by deer, although there is evidence that deer have passed through the property: There is . n I o indication that deer are in the area at any time Of the year on a continuing basis. In fact, the only sign of deer is on the roadways and some, of the more open areas through wh-''4ca any type Of aniWili or human, can easily traverse. There is no sign that deer have even bedded in the area or done anything other than simply migrate across the propertt. So as to facilitate that migration, ,Tr)po8, to limit fences. I I I — With With respect to deterioration to existing fish of Wildlife habitat, this observation obviously does not Pertain to fish. My observation is that the wildlife which would be most affected by development of this property is ligard8 and bear. It is clear from looking over the property that there are bear in the: area during the period that bear normally eat me ft 9a ft i ta berries, However, boat does not seem to be a major concern of the wildlife peoplej As to the migratory deer, I intend to Post the property with both no trespassing and no hunting Sighs, I do not Page 3 September 11, 1984 RE: Tentative Parcel Map intend to hunt on the property or to permit anyone else to hunt on the property. if there has been any wildlife hunted in the area be'f'ore•, this action will reduce that pressure rather than Cause a deterioratioll. 1'urther, prthe property is developed it can be expected tlitit some manzanita ential and brush will be removed w roomed th he '1'Iro r. result that grasses and other shrubs will be imp will be an improvement of elle habitat. In summary, we propose une ] ud..Luw4-5 any potential adverse impact. 1. All earth movement to be done n a time other than during the rainy season of the Year, 2. Any cuts or displacements necessary for road improvements will be kept to a minimun and appropriate ditching will be provided so as to reduce potential soil erosion 3 Any site preparation for improvements will be made at a time of year other than the rainy,se son anature pre- cautions will be taken to minimize any of any water runoff. 4 Every effort will be made to reduce thn the use of approved soil erosion reducti present erosion by on techniques. This may inctrucLion of berets include the cons te faces that serve as runo. across some of the grani° chan►>✓ls. 5. All construction will comply with the require- meats of the Butte County Public Works Dept. G. Although for property,of this size a harvest plan is already required for timber harvest, we would be glad to indicate on the map that the Planning p would be re, <ired to be given notice of any proposed timber thee, we would be glad to place a note on harvest, the map th. any development pian would have to shoe the location n ,y mature trees that. are intended to be removed. and that a .r,py thereof t,e provided to the planning fcpir ry at the same time that a building, permit is app I We would be glad to show fencing restrictions on the map, .%it as pointed out above, there is no indication. on the prod ty that the property serves as a winter habitat of any kind for deem vt 1e propose to past the property no Lrespassing no hunting, which may actually result in less pressure on the dad if there are any there, because i.~ there Page 4 September 11, 1984 RE: Tentative Parcel Map have ever been any shot on the properly in the past there will not be any shot there in the future. 9. The it movement of this properly should help in reducing any f'ir'e hazard to adjacent property, For instance, there are homes under con strucroOrtin wthe ill immediate area. and the development of t, is p ' y facilitate access to the area and incrc-:ase the potential fire breaks.
