The reason for this question is that our office represents the Michael Gray Trust and Spirow Nicholaw, residents of Butte County, residing along Oro Quincy Highway in the vicinity of Mountain House. Their properties adjoin Sheltering Pines Road and they have addresses on Sheltering Pines Road. They are currently involved in a dispute with a landowner, Michael Rowe, who owns Assessor's Parcel Number 61-34-05 shown on the attached map. Mr. Rowe has, or so he tells us, been assigned an address on Sheltering Pines Road by your office. However, as you can see from the attached Parcel Map; his parcel has no legal access to Sheltering Pines Road which, incidentally, is a private road. His parcel does have an easement to Oro Quincy Highway directly to the west between APN 61-34-23 and 22. Normally, we wouldn't be too concerned about the address established for any parcel, recognizing that in many cases it simply represents a convenient spot for mail delivery. However,•Mr. Rowe has now, apparently, taken up the argument that because the county has given him an address on Sheltering Pines Road, he must, ipso facto, have legal access to Mike Vieira October 16, 1998 Page 2 r" N Sheltering Pines Road via a long unused logging skid road over my clients' property, a position with which we strenuously disagree. First, Mr. Rowe does not have any legally described right of way from the parcel which he purchased to Sheltering Pines Road. Second, no such rights have been established. While he has argued that there may be prescriptive rights and/or rights reserved in prior deeds, those arguments, in our opinion, are totally without merit. In addition, Sheltering Pines Road is a private road and it is not a publically dedicated access road and would not be available to Mr. Rowe in any event. Again, normally we wouldn't care, but in this particular case, Mr. Rowe is apparently attempting to take advantage of the county providing him an address at the intersection of Oro Quincy Highway and Sheltering Pines Road to somehow claim that is confirmation of his legal access over my client's property to Sheltering Pines Road. I am enclosing a copy of the A.P. Map which depicts both of my clients' properties, the property of Mr. Rowe, and the intervening parcels. After you have had a chance to review this matter and can confirm just exactly how Mr. Rowe's claim of an address on Sheltering Pines Road was established, I would appreciate a communication from you at your convenience to discuss this. matter further. If it would be of assistance, Mr. Nicholaw and I can make arrangements to be at your office to discuss it. We trust that Butte County would certainly not like to see what appears to be an accommodation to a landowner for a mailing address turned into a lever that somehow the county has granted some sort of an implied right of way over private property. While normally we could not imagine someone attempting to make that argument, we would certainly like to clear it up at the earliest possible date so that we can disavow Mr. Rowe of his notions in this regard.
