I personally went to this property and inspected same. I measured from the building set back line along Bald Rock Road up to the apparent building site. (Batter boards, foundation, trench, etc.) Taking into consideration the vertical angle slope correction, I can state that the building as presently laid out is 300 feet plus or minus from Bald Rock Road. % The far side of the building would be a few feet beyond the 300 foot limitation. It is quite obvious why this spot was chosen. It is on top of the hill offering an excellent view. The well is back towards Bald Rock Road. The neighbor's home immediately to the north of my client is quite a bit further from Bald Rock Road than Mr. McKeown, making his building 400 to 500 feet from the road. The present site may not meet the "letter" of the law but it certainly complies with the "spirit" of the law in that if it takes a surveyor and vertical angle, slope, correction, etc., etc., to determine compliance, then certainly the man has in essence complied with the intent of the restriction.
