That right-of-way was described in deed to Clayton E. Patenaude. Unfortunately, when Patenaude sold to you, a portion of the right-of- way description was omitted from the legal description contained on the deed. We had Bidwell Title Company provide us with the chain of title document from 1963 to the time you purchased the property. There is no doubt that the right-of-way was acquired by a former owner and passed along as the lands were sold. Here is a brief synopsis of past title events: 1) In 1963, Leon sold to Brilliott (Book 1273 O.R. Page 643) what is now identified as AN 61-46-10,11,12,13,& 15. There is no mention in this deed of any augmenting road right -of- ways. 2) In 1970, Riggins granted Brilliott a 60 foot wide road right-of-way, running in a "general northerly to southerly direction" over a portion of the west half of Section 29. Said right-of- way started on Old Bloomer Hill Road and extended southerly to the north line of the Brilliott ownership, i.e. a point on the north line of Section 32. See Book 1.611 O.R. Page 683. . 3) In 1971, Brilliott sold the parcel you now own (AP: 61-46-12to Johnson. See Book 1713 O.R. Page 481. This deed includes a 60 foot wide road right-of-way along the existing road . over the west half of the northwest quarter and over the southeast quarter of the northwest quarter of Section 32 (AP: 61-46-11 &13). It also includes the right-of-way that Brilliott acquired from Riggins over a portion of Section 29. 4) In 1979, Johnson sold to you. This deed included the right-of-way over the lands located between your parcel and the north line of Section 32, but not over the lands located in Section 29. It appears to be a simple omission. Page 2 Ron Campbell May 29, 1997 An omission of an augmenting easement from the vesting deed does not mean that the right- of-way does not travel along with the conveyance. When you buy the dog, you also get the tail. The seller can make it so that the easement. does not travel with the sale, but to do so he must place specific language in the deed to make such an exclusion. We find no such language in'the deed from Johnson to you. It is our opinion that you have a 60 foot wide road right-of-way from your property northerly, along Black Bear Road, to Bloomer Hill Road. When Oroville Title Company insured your purchase in 1979, they insured only what was on the deed. This matter will come to the surface some time in the future. Past experience has showntthat it usually comes to the surface at the most inopportune time. At time of sale, refinance, etc. We would suggest that you go to Bidwell Title Company and purchase a title report that insures all the right-of-way that you own. That title report may eliminate a lot of confusion and time delay at.some time in the future. As a minimum, save this letter and the enclosed document so„that they may be presented to a future insurer of your title. He was informed at that time the right-of-way wasn't complete on the deed issued and recorded in Butte County in 1979. I contacted Bidwell Title Company and GDA both agreed the right-of-ways are in place. John Christofferson of GDA sent me a letter on May 29, 1997 with the supporting documents for the right-of-ways and a copy was delivered to your office. In late June 97 we reapplied and again were denied. on July 7, 1997 in our phone conversation you stated " there is no problem with the right-of-way but that we need a Metes and Bounds Survey ". It's not clear why a Metes and Bounds survey is necessary at this time when the existing road was named and recorded as Black Bear Road and is so indicated on the Assessor's Map No.6146 dated Janua 86, PG&E ran power lines over the right -of ways" .permits where issued to AP#61-64-1 for a well and septic system, and Home Building Permits for AP# 61-64-15 were issued, between 1983 and 1985. That right-of-way was described in deed to Clayton E. Patenaude. Unfortunately, when Patenaude sold to you, a portion of the right-of- way description was omitted from the legal description contained on the deed. . We had Bidwell Title Company provide us with .the chain of title document from 1963 to the time you purchased the property. There is no doubt that the right-of-way was acquired by a former owner and passed along as the lands were sold. Here is a brief synopsis of past title events: 1) In 1963, Leon sold to Brilliott (Book 1273 O.R. Page 643) what is now identified as AP: 61-46-10,11,12,13,& 15. There is no mention in this deed of any augmenting road right -of- ways. 2) In 1970, Riggins granted Brilliott a 60 foot wide road right-of-way, running in a "general northerly to southerly direction" over a portion of the west half of Section 29. Said right-of- way started on Old Bloomer,Hill Road and extended southerly to the north line of the Brilliott ownership, i.e. a point on the north line of Section 32. See Book 1611 O.R. Page 683. 3) In 1971, Brilliott sold the parcel you now own (AP: 61-46-12to Johnson. See Book 1713 O.R. Page 481. This deed includes a 60 foot wide road right-of-way along the existing road over the west half of the northwest quarter and over the southeast quarter of the northwest quarter of Section 32 (AP: 61-46-11 &13). It also includes the right-of-way that Brilliott acquired from Riggins over a portion of Section 29. 4) In 1979, Johnson sold to you. This deed included the right-of-way over the lands located between your parcel and the north line of Section 32, but not over the lands located in Section 29. It appears to be a simple omission. CHRISTOFFERSON P.L.S. x r� Page 2 Ron Campbell May 29, 1997 An omission of an augmenting easement from the vesting deed does not mean that the right- of-way does not travel along with the conveyance. When you buy the dog, you also get the tail. The seller can make it so that the easement does not travel with the sale, but to do so he must place specific language in the deed to make such an exclusion. We find no such language in the deed from Johnson to you. It is our opinion that you have a 60 foot wide road right-of-way from your, property northerly, along Black Bear Road, to Bloomer Hill Road. .When, Oroville;Titie Company insured your purchase in 1979, they insured only what was on the deed. This matter will come to the surface some time in the future. Past experience has shownf that it usually comes to the surface at the most inopportune time. At time of sale, refinance, etc. We would suggest that you go to Bidwell Title Company and purchase a title report that insures all the right-of-way that you own. That title report may eliminate a lot of confusion and time delay at,some time in the future. As a minimum, save this letter and the enclosed document so that they may be presented to a future insurer of your title.
