A., of this date the Land Development Division has accepted my legal access to the property above but now demands a Certificate of Compliance with a fee of $954. In addition, the Building Division continues to require structural changes that were not required as late as 1991 when I applied for the first building permit, su.,h as a furnace in addition to the wood stove, which was not required when it was built due to the 3,000 ft. elevation, and moving an outside door farther from the corner of the house, which will require rebuilding the wall, rewiring,. etc. I also have to pay an energy design consulting firm for a house that has already been built. The Environmental Health Department stated I would most likely have to dig up the septic system so they can inspect it, in spite of the fact that it was installed under the supervision of their former employee, Mr. Ed Overhouse. In addition, the Oroville School District is demanding school impact fees that did not go inti effect until some time after the house was built. In discussions with them they have refused to accept my proof (various receipts, photos dated by the processer, etc.) that the house was built in 1987. My- position is that all along I have wanted to obtain a building permit and meet legal requirements. My house was well-built and met the building codes at the time. This is not so true of structures on neighboring parcels, yet those property owners have not been required to obtain permits or bring their houses up to the present building codes. I have applied for the building permit and paid the fees. I do not understand why I shcwld have to pay $954 for a Certificate of Compliance when I was not the developer of this property in the firs: place. I an enclosing copies of a Complaint for Injunction, Civil Penalties and Other Relief and a Judgment filed in 1986 by the Butte County District Attorney's office against the developer of the property, Gerald N. DeRoco. Mr. DeRoco was fined $37,500 and ordered to make restitution to the owners of the property he illegally subdivided. Unfortunately, I was not aware of this until some time after the fact, and Butte County did not follow through to rectify the situation.' My fellow landowners and I were left without any recourse. I applying to have this matter placed on the agenda of the Board of Supervisors meeting of March 28, 2000. I am hoping.to obtain a waiver for the Certificate of Compliance fee, school impact fees and the unneccessary structural changes to my house, energy design consultation, etc. It seems to me that Mr. DeRoco has compensated Butte County sufficiently that I should not have to be paying for his responsibilities. Q Has he ever approached you to'ask you to look at a septic system on Stephens Ridge Road? A I did some inquiring. I don't recall Byron approaching me to look at a septic system on Stephens Ridge Road. I did some inquiring, and I ran into a fellow that Byron used to work with. His name is Jerry Faunce. And I asked Jerry if, if he and I had ever met on the property, and he said no, but he thought that Byron and I had met on the property. And I asked him specifically if he knew what was the issue with respect to this deposition, and he didn't know, much about it. But he said he thought that Byron and I and some other party, •and I don't recall the name, I don't remember who it was, met on a property, we reviewed it for a septic system. Q If you looked at a particular development, a lot that's going to be used with the septic system, would you have made a notation in your files at work or some kind of a record? A No. Q You wouldn't have kept any kind of a note pad or notebook? A No. Q Did you ever keep a notebook during 1987? A We filled out daily records which I think we no longer keep. I think they're thrown out. We record only the number and the type of calls we do. Whether it's a complaint about a water system or a review for a lot, so I. don't think those records would even be available . - Q Well, if, if someone were to tell you that a septic system installer had a practice of calling your office and ,requesting your informal review of a particular property on the Stephens Ridge Road, and that your practice was to examine the septic system for compliance with code, but not be able to give a septic permit, would that sound familiar at all? Now, you never got the permit, but you constructed it anyway. Could you tell us what changed your mind? A Well, I'm not sure it's illegal, illegal. I know it's not supposed to be done, you know. But when you have the county inspector telling you that, you know, to go'ahead and put it in, and he'll take notes when the road is able to be, you know, right-of-way, that.it's sort, you know, sort of dampens not to do it. If he tells you it's not okay to do it, but he says, you know, to do it and they would, you know, if in time they could get their permits then they would have a legal septic system. Q In other words the impression you got from Mr. Overhouse was that while it might be technically illegal because you couldn't get the permit, that this would be straightened out later and keep good notes and go ahead and do it? A Right. Q But he did say go ahead and do it? A I'm not gonna say he said go ahead and do it, but yes, but we talked about doing it. I'm not gonna say he said go ahead and do it. I don't believe he told me to do it. But he told me that this could be worked out in -the future when they got their permits. If 2 you can't get a permit, if they won't give them a permit, 3 you know, how can the -- I don't.remember his exact words. 4 Q How the powers that be would ultimately have to do it 5 anyway; is that it? 6 A If the people bought the property and they want to put 7 a septic system on, and the County won't issue them one even 8 though they're willing to. pay for one, how can they stop 9 them from having one. That's sort of the thought that I got 10 out of our conversation that morning. You know. 11 Q So if I understand, correct me if I'm wrong, while he 12 didn't specifically say go ahead and do the work without a 13 permit, he didn't say don't do it? 14 A Exactly. 15 Q Were Mr. or Mrs. Zufelt ever present at any time, you 16 know, personally present when you discussed any of these 17 matters relating to the property with either Mr. Overhouse 18 or any other..County people ever? 19 A Were they present when I was discussing it with any 20 County person. 21 Q Yes. I mean, they knew, I believe they knew, they let on to me that they knew they wasn't going to get a permit. And that they were only gonna build some kind of A -frame cabin up there to come up for the lake and stuff like that. 'You know, like a little summer cabin. They let on that they. knew. The true names and capacities, whether individual, corporate, associate 16 or otherwise, of Defendants named herein as Does 1 through 100 inclusive, are 17 unknown to Plaintiff, who therefore, sues said Defendants by said fictitious names. 18 Plaintiff will amend this Complaint to allege such true names when the same have 19 been ascertained. ... 20 7. On or about several dates in 1968 and 1969, Defendant, DeRoco, alone 28 or with other Doe defendants or others, acquired, or caused to be acquired, various —2— 1 parcels of real property in Butte County, California in Sections 30 and 31, Township 29 21 North, Range 6 East, M.D.B.&M.; Section 17,. Township 21 North, Range 5.East, 3 M.D.B.&M.; Sections 19, 30, .31, Town Ship 18 North, Range 5 East M.D.B&M.; Section 4 18, Township 14 North, Range 6 East M.D.B.&M.; and Section 29, Township 21 North, 5 Range 6 East M.D.B.&M. Such acquisitim were made in the names of various persons, 6 companies, or organizations, at the behest of defendant DeRoco. 7 9. Between 1968 and 1972, Defendant DeRoco, alone and/or with other Defen- dants and/or others, subdivided the real property described in Paragraph S. Such 9 divisions were created by instruments of conveyance through the use of fictitious 10 names, the names of straw persons, or other persons who had no equitable interest 11 in the lots of subdivided lands so created. -By this method, Defendant DeRoco, 1� created or caused to be created eleven lots from the real property in Sections 30 13 and 31, Township 21 North, Range 6 East, M.D.B.&M.; ten lots from the real property 14 in Section 17, Township 21 North, Range 5 East, M.D.B.&M.; sixteen lots from the 15 real property in Sections 19, 30, 31, Township 18 North, Range 5 East, M.D.B.&M.; 16 sixteen lots from the real property in Section 18, Township 19 North, Range 6 East, 17 M.D.B.&M.; and ten lots from the real property in Section 29, Township 21 North, 18 Range 6 East, M.D.B.&M.; for a total number of lots of sixty-three. No subdivision 19 maps, as defined by Government Code Section 66410 et sect., -were ever made, obtained, 20 and/or filed with regard to such subdivided lots. 21 10. Between 1968 and 1978, Defendant DeRoco, alone and/or with other 22 Defendants and/or others, sold or caused to be sold, the various lots of real pro - 23 perty in Butte County described in Paragraphs 8 and 9 above. Such sales were made 24 without notification to the Director of the Department of Real Estate, that the 9 25 lots were to be or were being, subdivided and sold, and no g public report, as define 26 by Sections 11000 through 11029.1 of the Business and Professions Code, was applied 27 for, obtained or presented to any buyer or prospective buyer of such lots. In order to convey title or execute instruments affecting interests in such subdivided lands shown in the official records of Butte County to be held in the names of fictitious persons, deceased persons, straw persons, and/or other persons, real and/or imaginary, Defendant DeRoco, appeared before notaries public and acknow- ledged under oath that he witnesses such fictitious persons, deceased persons, straw persons, -or other persons, real and/or imaginary, execute such conveyances or instruments. In order to effect the conveyance of title, or facilitate same, or to effect the execution of an instrument affecting interests in real property, or facilitate same, with regard to the subdivided lands described in paragraphs 8 and 9 above, Defendant DeRoco, recorded or caused to be recorded in the official records of Butte County, instruments conveying title or affecting interests in real property which purported to contain the signatuiies of bona fide holders of title or interest. lin real property, but which actually contained, and. In order to effect the conveyance of title or facilitate, or to effect the execution of an instrument affecting interests in real property, or facilitate same, with regard to the subdivided lands described in paragraphs 8 and 9 above, Defendant, DeRoco, recorded or caused to be recorded in the official records of Butte County, notarial acknowledgements, apparently valic on their faces, which he knew or should have known were false and fraudulent. FIRST CAUSE OF ACTION 12. The allegations contained in paragraphs 1 through 11, inclusive hereof, are realleged and incorporated herein by reference. 13. The division of the real property described in paragraphs 8. and 9' above into more than five parcels by the interdependent, intricate scheme of acquisitions, transactions, and purported conveyances- through the use of names of fictitious per- sons, deceased persons, straw persons, or other persons, real mWor imaginary, as described in paragraphs 9 and 10 above, has created a subdivision within the meaning of and subject to the requirements of the Subdivision Map Act (Government Code Sectio 664100 et seg., - initially found in the Business and Professions Code, repealed and re-enacted by Chapter 1536, Statutes of 1974) and the Butte County ordinances enacte pursuant•thereto, regarding the filing of tentative. and final* maps and the develop- Ilment of subdivisions. 14. Defendant, DeRoco, was required and failed to file, or cause to be filed or recorded, final subdivision maps in compliance with the Subdivision Map Act and the. Butte County ordinances enacted pursuant the describing the subdivisions Hand their design and improvements with regard to the subdivided lands described' in paragraphs 8 and 9 above. 15. Defendant DeRoco, knew or should have known that he had created or cause to be created, subdivisions subject to the requirements of the Subdivision Map Act, -5- .r 1 2 3 4 5 6 7 8 9 10 11 12' 13 14 15 16 17 and Butte County ordinances enacted pursuant thereto, and knowingly and willfully failed to comply with such statutes and ordinances, Defendant DeRoco, alone or with other Doe Defendants or with others, entered upon the schemes alleged in paragraphs 9 through 11 above to evade the potential difficulty, and expense of causing to be filed, approved; and recorded tentative and final subdivision maps, approval of which could be conditioned upon compliance with certain design, improvement, and other standards established by the Subdivision Map Act and Butte County ordinances pertaining to same. 16. The failure of Defendant DeRoco, alone or with other Doe Defendants or with other persons, to comply with the Subdivision Map Act and the Butte County ordinances enacted pursuant thereto, deprived innocent purchasers of the parcels created on the properties described in paragraphs 8 and 9 above and the.People of the State of California', especially those residing in Butte County, of, inter alia, proper provision for streets and roads, sewage disposal, utilities, environmental protection, and/or compliance with standards enacted by the State of California and Butte County to provide for and ensure the proper, sound, and orderly development and growth of Butte County. 18 17. Defendant DeRoco's offer and sale of subdivided parcels in the properties 19 described in paragraphs 8 and'9.above,without first filing for record a final sub -:- 20 division map in full compliance with the -Subdivision Map Act, is prohibited by Goverr. 21 Ment Code Section 66499:30. 22 SECOND CAUSE OF ACTION 23 19. The allegations contained in Paragraphs 1 through 11 of this Complaint 24 re realleged and incorporated herein by reference. 25 20. The division of the real property described in paragraphs 8 and 9 above 26 into more than five parcels by the interdependent, intricate scheme of acquisitions, 27 ransactions, and purported conveyances through the use of names of fictitious perso: 28 eceased persons, straw persons, or other persons, real and/or imaginary, as describ, Ma =�1 in paragraphs 9 and 10.above, created a subdivision within the meanie of 8 and subjec to the Subdivided Lands Act, Business and Professions Code Section 3.10009- et seg. 3 21. Defendant DeRocot alone or with other Doe Defendants or with others, 4 was required and failed to file with the California Commissioner of Real Estate, 5 as required by Business and Professions Code Section 11010, Notices of Intention 6 and Questionnaires setting forth the information required to be disclosed by the i Subdivided Lands Act concerning the subdivisions created in the properties described 8 in paragraphs 8 and 9 above, and consequently, no public reports have been issued 9 concerning said subdivisions. 10 22. Defendant DeRoco knew or should have known that he had created or caused 11 to be created, a subdivision subject to the requirement-9 of the Subdivided 'Lands 12 Act and knowingly and willfully failed to comply with such. law, Defendant DeRoco, 13 alone or with other Doe Defendants or with others, entered upon the schemes alleged 14 in paragraphs 10 and 11 above, because of the potential difficulty and expense in 15 complying with the regulatory and disclosure requirements of the Subdivided Lands 16 Act, thereby enabling the Defendant DeRoco to offer'for sale and to sell the parcels 17 created in the properties described in paragraphs 8 and 9 above without being require 18 to-inform potential purchasers of, inter glia, substantial problems concerning such -19 parcels and their lack of improvement and design features. 20 23. The failure of Defendant DeRoco, alone or with other Doe Defendants 21 or with others, to file.Notices of Intention and Questionnaires, to obtain from `-=the Commissioner of Real Estate public reports, or to provide such a report, to pur- 23 chasers or prospective purchasers of subdivided lots created in the properties 24 escribed in paragraphs 8 and 9 above, has denied innocent and prospective purchasers 25 of the subdivided lots on such properties of, inter alia, the disclosures of infor- tion and other protections which the Legislature, by enactment of the Subdivided 27 Lands Act, intended torovide to P purchasers of subdivided lots in California. 28 As a consequence, innocent and prospective purchasers have been misled, defrauded, -7- . 1 2 3 4 9 10 11 - 13 14 15 16 17 18 19 20 21 22) ?3 `24 `_'5 26 `_'7 281 �: 1 and have been denied the means by, which to make rational, informed decisions regard- ing the purchase of subdivided parcels and.lots in the properties described in para- graphs 8 and 9 above. 24. Defendant DeRoco's offer and sale of subdivided parcels in the propertie described in paragraphs 8 and 9 above without first obtaining public reports from the Commissioner of Real Estate and without providing such public reports to pur- chasers or prospective purchasers of subdivided lots in the properties described in paragraphs 8 and 9 above is prohibited by Business and Professions Code Sections 11018.2 and 11018.1. 25. By reason of the foregoing, defendant DeRoco, alone or with other Doe defendants or with others, has violated B»siaess and Professions Code sections 11018.2 and 11018.1. THIRD CAUSE OF ACTION 26. The allegations contained in Paragraphs 1 through 11 above are realleged land incorporated herein by reference. 27• Beginning'on an exact date unknown to plaintiffs, but some time in 1969 or 1970, defendant DeRoco, alone or with other Doe defendants or with others, with the intent to dispose of real property or to induce members.of the public within the State of California to purchase parcels. of real property made or disseminated statements which were or are untrue or misleading, or which were only partial disclosures of facts, or which failed to disclose facts which, in light of the circumstances, were necessary to make the statements made not misleading. Such statements partial disclosures, and omissions include, but are not necessarily Limited to, statements, partial disclosures, and omissions concealing, or tending to conceal, the true ownership of the parcels being sold, the fact that the parcels of property sold by defendant were created by illegally subdividing the property so sold, and that defendant failed to comply with the provisions of either the Subdivided Lands Act or the Subdivision Map Act, as set forth more fully in .y 1 Paragraphs 12 through 25 above. The defendant DeRoco, alone or with other Doe 2 defendants or'with others, failed to disclose any potential difficulty, expense, 3 or health hazards there may be in providing for proper disposal of waste, obtaining 4 or providing for utilities, obtaining or providing for fire protection, or obtaining 5 and/or maintaining.traversable roads.. 6 28. The representations, partial disclosures, and omissions of fact as. set I forth in Paragraph 27 above induced members of the public within. the State of 8 California to purchase parcels in the properties described in Paragraphs 8 and 9 9 above. 10 29. Defendant DeRoco knew of the representations, partial disclosures, 11 and/or omissions of material facts set forth in Paragraph 27 above, and knew, or by 12 the exercise of reasonable care should have known, that such representations, partial 13 disclosures, and/or omissions were and are untrue or misleading or failed to disclose 14 facts which, in the light of circumstances under which such statements were made, 15 were necessary to make such statements not misleading. 16 30. The commission by defendant DeRoco, alone or with other Doe defendants 1. or with others, of each of the acts described in Paragraph 27 above was and is in 18 violation of the laws and public policies of the State .of California which prohibit 19 false advertising in general, and false advertising iri connection with the sale of . 20 real estate in particular, which laws and public *policies are set forth in Business 21 and Professions Code sections 17500 and 17530 respectively. 2. 31. Was told that a Certificate of Compliance verifying legal parcel status required. 2000 - Letter from Stu Edell dated February 25, 2000 again reiterated the need for a Certificate of Compliance before a Building Permit could be issued. Sometime after this date Ms. Bowman requested a waiver of fees for the Building Permit and Certificate of Compliance. Beeler Sipervisor, District 1 1230 High St. Oroville, CA 95965 Dear Mr. Beeler I am writing this letter to inform you of a situation in your district that needs attention. In 1987 when living in the Bay Area I purchased a 5 -acre parcel off Stephen's Ridge Rd. I had title insurance and thought everything was legal. Subsequently, I obtained a permit and drilled a well. When I hired a contractor to put in a septic tank he said he was unable to get a permit, that residents in that area were unable to get all the permits for building because originally the land had been part of an illegal subdivision, and that the septic inspector, Mr. Overhouse, would check it unofficially. He said that eventually the county would straighten out the problem and that the dwellings would be grandfathered. The neighbors told me no one could get permits at that time but that it was not a problem because the county would eventually resolve the situation. None of the structures on these parcels had permits. So my husband and I decided to go ahead and build a vacation home. During later legal depositions I discovered the neighboring parcel to mine actually had a legal septic permit. In 1990 I received a "Correction Notice" from the county and responded by applying for a building permit. I submitted plans, which were approved after some changes requested by the building inspector. Then I was informed I did not have legal 604 access to a public road and could not obtain the building permit. We had legal access to a public forest service road that joins the Oroville Quincy Highway, but the county would not accept that road as a public road providing access. My neighbors and I formed a landowners' association and applied to the U.S. Forest Service for a road access easement. In the meantime, the Building Inspection Division absconded with my permit fees and destroyed my plans after telling me not to worry, the permit would be on hold until the easement was finalized with the forest service. I had to reapply with new fees, which I did. As the years went by I was refunded my fees and continued to be harrassed by letters from the Building Inspector threatening to take me to court and fine me. The Stephen's Ridge Landowners' . Association was finally granted the road easement in 1998 after intervention with the U.S. Forest Service by Mr. Wally Herger. I then reapplied for the building permit and paid the fees again. : I am continuing to be harrassed by the county even though I have tried to meet all their requirements. The Butte County Land Development division has agreed that the road easement from the U.S. Forest Service from my private road all the way to the Oroville Quincy Highway provides legal access except they now want the creation deed to show I had this legal access in 1970! This parcel is part of an illegal subdivision which used the forest service road for access. The county prosecuted the developer, Gerald DeRoco, fined him and forced him to build the private road. Then the county left the whole problem unresolved. Of course, I knew nothing of this when I purchased the land, and when I sued the title company and real estate agency who knowingly engineered the sale with no legal access I ended up with an incompetent lawyer who did not accomplish anything and. allowed the statute of limitations to run out. I have reams of papers with information pertaining to the problem, but cannot get cooperation from the county. I have access to the highway now and want to finish the building permit process. I also am being harrassed with the fact that since the house was built the building code has changed, and the plan checker is requiring energy design compliance and a structural change (moving an existing door) as if the house is a new structure. Previously to this, the building inspector had said that due to the fact the house was previously built in 1987 it would have to be "grandfathered", and I would not be expected to rebuild it to meet all the current requirements. There seems to be no communication between different divisions in the county, and they all claim it is not their responsibility. No one seems to know what is going on, and the building inspection division has no control over the septic division, the school district wants impact fees even though the house was built before they went into effect, the assessor's office is taxing the house at the current rate even though the building inspector is saying it is illegal, etc., etc. I am asking you to intervene and help resolve the access and permit problem for myself and my neighbors. It is not fair that we own land and pay taxes for structures that the county will not recognize as legal because of a technicality. I have tried every avenue I could find to meet county requirements, and it seems that no matter what I do there is always a new reason to deny the building permit. This was an illegal subdivision, but now there is an easement across forest service land to the county highway, and this needs to be recognized. There is no way to go back to the original creation of the subdivision. and change that. Please contact me and let me know you can help me. The initial payment is set at $30.00 for the remainder of the calendar year. Payments for each subsequent- calendar year shall be the amount of $34.00 adjusted using the Implicit Price Deflator -Gross National Product index (IPD-GNP), or other factor selected by the Forest Service, to reflect more nearly the current fair -market value of the use. At intervals to be determined by certain changes in the indexes used to establish the linear rights-of-way fee schedule, the fee shall be reviewed and adjusted as necessary' to assure that it is commensurate with the value of the rights and privileges authorized. In addition to the annual payment, the permittee shall pay its proportionate share of road costs prior to using the road for commercial,use. Failure of the Permittee to pay the annual payment, late charges, or other fees or charges shall cause the easement to terminate. Grantee shall pay an interest charge on any fee amount not paid by the payment due date. Interest shall be assessed using the.most current rate prescribed by the United States Department of Treasury Financial Manual (TFM-5-8020). Interest shall accrue from the date the fee payment was due. In addition, certain processing and handling administrative costs may be assessed int he event the account becomes delinquent and added to the amounts due. A penalty -of 6 percent per year shall be assessed on any fee amount overdue in excess of 90 days from the due date of the first billing. Payments will be credited on the date received by the designated collection officer or deposit location. If the due date(s) for any of the above payments or fee calculation statements fall on a nonworkday, the charges shall not apply until the close of business of the next workday. I. This easement shall terminate in the event an easement is granted subsequently by the United States to a public road agency for operation of this road as a public highway. J. Grantee shall pay the United States for all injury, loss, or damage, including fire suppression costs, in accordance with existing Federal and State laws. K. The estimated current cost for recording this Certificate is $10.00 without conditions, $13.00 with conditions.
