Marion L. Anderson (trustee) is the timberland owner for parceF561-460-005.' Tihe intent ,. is to put in an apple orchard and landscaping. A take tree mark was done with blue paint marks including butt mark. The marking was done with the owner and is intended to clear the area for the above mentioned use. The LTO will remove the trees. The LTO will also be responsible for treating the slash generated by the operation to the standards of Section 1104.1(2)(d) of the Forest Practice Rules. The exemption area boundaries are flagged in solid pink flagging. Access to the parcel will be by the existing road off Mann Avenue. One watercourse is present in the exemption boundaries. Watercourse is a class III watercourse that has been painted with blue paint and flagged with blue and white stripped flagging. Watercourse has a 25 foot ELZ protection zone. No equipment will be in the zone except at the existing road crossing. No endangered or threatened plant or animal species were observed. Habitat for such species was not noted. This project is in accordance with Butte County regulations and an assistant planner has signed off on its compatible use. A copy of the notice posted on the parcel at least 5 days before submission (copy of notice attached, posted (April 28,. 2006). A copy of the notice was sent to owners of record within 300 feet and the archeological contacts for Butte County (May 5, 2006). A list of the adjacent property owners are enclosed. No person shall place or park or allow the placing or parking of any trailer coach, recreational vehicles, tent trailer or tent, or otherwise occupy or allow the occupancy of any parcel (as defined in Section 24-305.310) for the purpose of camping (as defined in Section 24-305.095) on public or private property within the County for a period in excess of 9 days in any one calendar year, except in an outdoor recreational facility, campground, recreational vehicle park, or hunting/fishing camp, lawfully established and maintained pursuant to this Chapter. Butte County Code, Chapter 19, Section 19-3 - Sanitary Sewage Disposal System Required. It shall be unlawful for any person to maintain, occupy or use any building not provided with a sewage disposal system which disposes of sewage in a sanitary manner. Sewage, as used in this Chapter, includes any and all waste substances, liquid or solid, associated with human habitation; this includes what is commonly referred to as gray water. It is unlawful for any person to maintain, occupy or use any building not provided with a sewage disposal system which disposes of sewage in a sanitary manner. Specifically, the violations include unauthorized camping or otherwise occupying recreational vehicles, the keeping of junk and inoperable vehicles in public view and occupying a structure without a functioning disposal system on your property. This is an advisory notice that these uses are in violation of the Butte County Code, as follows: Butte County Code, Chapter 24, Section 24-65 - Applicability of zoning regulations. All uses of land within a zoned district not specifically authorized or permitted by regulations are prohibited. Butte County Code, Chapter 24, Section 24-230 - The "U' (Unclassified) zone does not "specifically authorize" large accumulations of junk. The storing of more than 100 square feet of "junk" on a parcel is one of the items used to determine that a "junkyard" condition exists. A "junkyard" is not an allowed use in the "U' zone without a Use Permit. "Automobiles and other vehicles, dismantled, in whole or in part" are considered to be "junk". Chapter 11, Section 11-4 forbids people, whether at a licensed junkyard location or not, from storing junk in public view. Butte County Code Chapter 11, Section 11-11 - It shall be unlawful for any person to engage in the business of junk dealer, junk collector, secondhand dealer, pawnbroker or peddler in the unincorporated area of the County without first having obtained a license to engage in such activity as provided herein. No person shall place or park or allow the placing or parking of any trailer coach, recreational vehicles, tent trailer or tent, or otherwise occupy or allow the occupancy of any parcel (as defined in Section 24-305.310) for the purpose of camping (as defined in Section 24-305.095) on public or private property within the County for a period in excess of 9 days in any one calendar year, except in an outdoor recreational facility, campground, recreational vehicle park, or hunting/fishing camp, lawfully established and maintained pursuant to this Chapter. Butte County Code, Ch"r 19, Section' 19-3 - Sanitary Sewage Disposal System Required. It shall be unlawful for any person to maintain, occupy or use any building not provided with a sewage disposal system which disposes of sewage in a sanitary manner. Butte County Code, Chapter 19, Section 19-5 - Permits Required. (a) No person shall begin or cause to have begun construction of any building or any sewage disposal system without first submitting plans of the means of sewage disposal to the Health Officer and obtaining a permit therefore from the Health Officer. (b) No person shall construct an auxiliary sewage disposal system for a building presently served by' a sewage disposal system without first submitting plans of the proposed means of sewage disposal to the Health Officer and obtaining a permit therefore from the Health Officer. (c) No person shall extensively alter, repair, relocate, add to or replace any existing sewage disposal system without first securing a permit therefore from the Health Officer. The determination that these violations exist on the property are based on the following definitions in the Butte County Code: Butte County Code, Chapter 24, Section 24-305.240 Junk: Any worn-out and discarded material in general that may be turned to some use including, but not limited to, any old iron, wire, copper, tin, lead, rags, paper, bags, lumber, empty bottles, bones, parts of bicycles, tricycles, baby carriages, automobiles, and other vehicles, dismantled, in whole or in part, kept, stored, located, situated or piled in public view, and all other similar personal property ordinarily defined and classified as "junk" kept, stored, located, situated or piled in public view and not screened from public view by a fence. r� r Christopher J. & Victoria J. Butte County Code, Chapter 19 - Sewage Disposal. Sewage, as used in this Chapter, includes any and all waste substances, liquid or solid, associated with human habitation; this includes what is commonly referred to as gray water. It is unlawful for any person to maintain, occupy or use any building not provided with a sewage disposal system which disposes of sewage in a sanitary manner. The Contractor shall verify all dimensions and details prior to construction and notify the Engineer of any discrepancies. 2. All construction and methods shall be in strict conformance with the applicable provisions of the Uniform Building code, 1997 Edition, and the latest edition of the UMC, UPC, NEC, and applicable municipal, state, and Federal regulations 3. All work is subject to building department field inspector's approval. 4. The contractor shall provide all measures necessary to protect the structure, workmen, and all other persons during construction. FOUNDATION: I. The Contractor shall be responsible for the location of all underground facilities or other buried objects which may be encountered but which are not shown on thpsA mans. Locations and depth; of any existing utilities that may or may not be shown on these plans they are approximate and may not be complete. 2. Clean footing excavations of debris and loose soil prior to placing concrete. 9.
