Mr. Reid stated: I make a motion to issue -a conditional certificate of
Compliance for a parcel owned by Terri Jean Peterith,'the parcel being
approximately the northerly 5.96 acres of AP 36-67-037 as described in the
deod submitted to Public Works, finding that the parcel was :created by
Sift deed on or about January 28, 1.992, at a time when parcels created by
other than map were required to comply with zoning, access, sewage disposal
and water supply requirements, but also finding that issuance of this
conditional, certificate will not be to the health, safety or
Welfare of the people of Butte County or other rp�n.,�-"Jes in the territory
Jn which the property is situated provided the required is
complied with.
1. Provide documentation from the public water company that public water
is supplied or can be supplied to this parcel and the gift deed remainder:
If verification is provided prior to recording the conditional certificate,
a "clean" certificate may be recorded.
Motion seconded by Ms Leasure and carried unanimously.
5 • Mak and Mary McGee, AP 61-56-19, 21 and 22, 3 parcels located on
the southeast corner of He-Le-�Ve Road and Cherokee Lane. Bloomer
Mountain area,
Bob Bramledge and Mr. and Mrs, McGee were present.
Mr. Edell said the parcels are in a Don Mann court judgement area. Two parcels
were created by deeds, with a remainder, on Jan. 19, 1972, There is access
to Encina Grande, which is access approved by the tc&d of Supervisors.
Tfiere were no problems with the Planning requirements
Mr, Reid said there would need to be soil tests. A clear certificate could
be issued on parcel 22, but the other parcels would need a condition.
The MtGees did not understand why the problems with the property did not
come up when they bought it,
Mr Edell explained the circumstances of the 'Don Mann court ,judgement areas, and that
there is no time limit for Mr. Manu to follow the court orders,
There was some old data that the Health Dept: would have to review regarding
soil tests,
it was rioted that two conditional and one ''clean' certificate- could be

for 2 parcels owned. by Max and Mary McGee, the parcels being Al- 61-56-19
and 21, finding that available evidence indicates that the parcels are
within a Court judgement area buy- that issuance of tIese conditional
certificates of compliance kr-11 not hi detrimental to the health, safety
or welfare of the people of Butte County or other properties in the
territory in which the property is situated provided the required caniition
is complied with
1. Provide verification that a ,suitable site for the installation and
replacement for a sewage disposal system for a single family resid6nce �

The motion is also made noting that there is evidence that well water
is available in the area, the parcels are provided with the required
access and meet zoning requirements. The motion also includes a;.pr6val to
issue "clean" certificates provided the condition, is complied with
prior to preparation and recording of the conditional certificates.
Motion seconded by M's. Leasure and carried unanimously.

Mr. Read said that it doesn't meet current requirements for usable area,
but it does have site for sewage disposal, and that as.al.l that is required
at the .time of parcel creation,
Mrs Edell said that the access was provided after creati:or of the parcel.
