When we purchased our property, it already.'had a home on it which soon became too small for our family after we moved in because of the birth of "'our son', Peter. After family discussions, we decided to remodel our home and together began a remodelling project orr October 15, 1977. I am sure of this date because it was the first weekend after I had my arm removed from a cast in which it was placed as a result of an injury I had received. - l- s .. 1 Our remodelling project included enclosing a porch to have 2 a dining area in the kitchen, addinga bedroom, bathroom and 3 attached garage, installing a picture window, building a new entry, 4 way and porch. All aspects of this project have begun anti work hasb! 5 -"to complete each and every aspect. The project is not finished 6 since it was brought to a standstill'as a result of me being 7 brought to court to*defend and protect my Constitutional Rights 8 to provide shelter for my family. Some parts of this project have 9 been completed,and in my estimation that which has been completed 10 is safe. I base my estimation on the fact that my present job is'' 9 11 that of a construction superintendent and I have fifteen years of .12 experience in carpentry and construction. What I build is safe 13 and I will not let my family live in something that is not safe. 14 I made several attempts to obtain a Building Permit from 15 the Butte County Building Department, after having been requested 16 by them to do so, but was never able to obtain a permit from them. 17 I first went to -the Building Department in November of 1977 after 18 my wife had been informed by a Mr.. Dale McKendrick that we would 19 need a permit. When I went to the Building Department I was in - 20 formed that I would have to pay triple fees. They gave me a list 21 of information that they wanted and I went home and got it all 22 together and came back the next day with the plans, which were 23 rejected by the Building Department. The Building Department 24 insisted that I use very costly methods of building. Without question, I would,have obtained a Building Permit if at all possible'. Since it was not possible to obtain a Building Permit, my wife and I recorded•a Declaration' ',-I, 0 and had it attached with our deed in the Butte County Recorders Office to declare that we have made some changes in our home and to notify any future purchaser of these changes so that if and when' title to our home is transferred the future buyer will be aware of our changes. 9 We sought to rectify the problem that we had with the Building Department in the best way we knew how -and decided, there- 'r fore, to record the document which has already been placed on file in this action. F. Glander, Butte County's Chief Building Inspector received information that one Keith Bymers, the defendant herein, was constructing an addition to his house without the required building permit. Defendant was known to Mr. Glander's department since correspondence had previously been directed to defendant concerning other work on the same house - such work also having been done without a building permit on or about October 27, 1977. Keith drove by defendant's house on June 23, 1978. From Bald Rock Road,.a public highway upon which defendant's house fronts, Inspector Keith was able to determine that an addition to defendant's house was in progress. Said addition was in the framing stage at that time and appeared to be ap- proximately twelve (12) feet by forty (40) feet and attached to the east end of defendant's house. The work apparently continued as Inspector Keith reported that on November 8, 1978 the addition was by then enclosed with exterior walls and roof. II DEFENDANT'S RIGHT OF PRIVACY IS NOT ABRIDGED BY ENFORCEMENT OF THE BUTTE COUNTY BUILDING CODE. As presently recognized, the right of privacy encompasses and -protects only items such as "the personal intimacies of the home, the family, marriage, motherhood, procreation and child- rearing." Paris Adult Theater v. Slayton (1973) 413 U.S. 49. jj To expand such protection of life's intimate personal relations Ito include the rather open and notorious act of constructing an addition to a building (without a building permit) is incon- ceivable. By analogy the U. S. Lindsey v. Normet (1972) 405 U. S. 56; Village of Belle Terre v. Boraas (1°-74) 39 L..Ed.2d 797. Therefore housing laws and zoning laws are subject only to traditional tests of "reasonableness" -b i.e. no "compelling" state interest need be established. However, even if the court should consider defendant's right of privacy is somehow involved in the case at bar, it must be noted the right of privacy is not absolute. Roe v. wade (1973) 410 U.S. 113. It "must bow to a reasonable exercise of police power." 62 Am.Jur.2d, Privacy, Section 17 (1972) at 701. The promulgation and enforcement of reasonable municipal (city and county) building codes are classic examples of the exercise of constitutionally valid police powers. Ex parte Stolenberg (1913) 165 C.789, McQuillan, Municipal Corpora- tions, Section 24.504. Also the governmental interests involved in uniform building codes such as the one involved here are of the highest and most "compelling" order - the "protection of the public health, safety, and general welfare of the occupant and the public . California Health and Safety Code Section 17921. Lefendant's short-sighted argument disclaiming any "compelling" need focuses only upon whether the structure he has constructed meets his own personal needs of health and safety. For the defendant to set himself up as the sole and exclusive authority as to what is a safe and healthful structure completely disregards the main interest of an ordered society in building code4. 3. 1 2 3 4 5 6 7 8 9 13 14 15 16 17 18 19 20 21 22 23 24 25 26 That interest is to prevent a person (perhaps less skillful and alturistic than the defendant) from putting an intolerable drain upon the increasingly limited resources of today's modern interlocking community. First, a structure that harms its occupants also harms the community when the community is forced to spend its limited police, fire, hospital and welfare resources in rescuing, caring for and maintaining those injured occupants. Second, a defectively -built structure is a clear danger to the neighboring community, not only in terms of fire and sanitation but also in the potential drain upon limited energy and water resources. Defendant's.alleged right of privacy must fall on the sands of his own selfishness when compared to the compelling public needs of health, safety and the general welfare. ZIZ BUILDING A HOUSE IS NOT FREE SPEECH Just as burning one's draft card is not considered "speech" but "conduct" undeserving of First Amendment protection (U.S. v, O'Brien (1968) 391 U.S. 367), so must the conduct of building a structure be so considered. The mere act of so building communicates nothing. DEFENDANT IS NOT SUBJECT TO AN INDEFINITE THREAT OF CRIMINAL PROSECUTION. Defendant in his argument evidently misunderstands the underlying basis of the instant case. Defendant is being prosecuted only for his acts of construction involving the addi- tion to his house without a building permit or inspection on or about June 23, 1978. No other construction or repair (such as that in October, 1977) is at issue. The June 23, 1978 act(s) is well within the misdemeanor statute of limitations. V. DEF^NDANT'S OCCUPATION OF HIS ADDI- TION IS NOT AT ISSUE. (See Point IV above). VI. o ` NO VIOLATION OF DEFENDANT'S FIFTH AMENDMENT RIGHTS ARE INVOLVED IN THE PRESENT ACTION. The People are at a loss to determine what manner of "injurious or self -incriminatory disclosures" defendant would have made as a result of filling out a Butte County building application and permit (an example of which is attached as Exhibit "A"). The cases cited by defendant are directed to the government compelling disclosures about activities which are initially criminal in nature. In direct.contradiction to defendant's rather curious inference that since the California Legislature promotes a free market place for housing it must therefore intend that b ilding codes not be enforced, the People note the direct policy stated in the 1970 amendments to the State Housing Law (Health and .Safety Code Section 1791^, et seg.) as follows: "The Legislature hereby finds and declares that the uniformity of codes throughout the State of Cali- fornia is a matter of statewide interest and concern since it would reduce housing costs and increase the efficiency of private housing construction industry and its production." Stats. 1970, ch. 1436, V, p. 2786. VIII. THE BUTTE COUNTY BUILDING CODE CONFORMS TO GENERAL STATE LATA. A consideration of various provision of the State Housing Law show clearly the Butte County Building Code conforms precisely with state law. 11 in part: Section 17921 of the Health and Safety Code provides "The commission Lof Housing and Community De_velo pmen� shall adopt . . . and . . . the Department Lof Housing and Community Development shall enforce rules and regulations for the protection of the public health, safety, and general welfare of the occupant and the public governing the . . . construc- tion . . . of all . . . dwellings and buildings . . . 6. 11 2 3 4 5 6 7 8 .9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 23 26 mk Section 17922 states in part: "(a) 'except as otherwise specifically provided by law, the rules and regulations adopted . . . pursuant to this chapter shall impose substantially the same requirements as are contained in the most recent editions of the . . . uniform industry codes . . . . " Section 17958 reads in part: "The governing body of every city or county shall adopt ordinances or regulations imposing the same requirements as are contained in the regulations adopted pursuant to Section 17922 within one year after November 23, 1970. If any city or county does not adopt such ordinances or regulations, the provisions of this part and the rules and regulations promulgated thereunder shall be applicable within one year after November 23, 197^." Section 17995 provides: "Any person who violates any of the provisions of this part or any rule or regulation promulgated pursuant thereto is guilty of a misdemeanor, punishable by a fine not exceeding five hundred dollars ($5nn) or by imprisonment not exceeding six months, or by both such fine and imprisonment."
