Vieira DATE: June 4, 2002 RE: Hubacek Letter dated May 20, 2002 I discussed the letter and construction project with the field inspector, Scott Rutherford and Stuart Edell. Field Inspector: The inspector, at time of foundation inspection, was advised by the builder and property owner (Calvo) that the property line was approximately 20 feet beyond the perimeter of the garage project. On 12/4/00, field inspector requested string line identifying property line from owner Calvo. On 12/12/00, Calvo complied showing 25-30 feet to property line. On 2/6/01, field inspector left correction notice that a corner record indicates garage has been constructed across property line. He also stated to please take steps to resolve prior to any further inspections. Scott Rutherford: Field inspector did not see corner markers. Surveyor Graves apparently told Hubacek that original corners were improperly placed. On 1/19/01 Scott discussed with Stuart Edell a map that had been submitted by Hubacek showing garage constructed across property line. Stuart indicated map was not appropriate. It did not contain needed information, nor was it signed and stamped by a qualified professional. A revised corner record map was received that contained appropriate information. Scott decided we could no longer continue field inspection and advised inspector to leave correction notice warning Calvo to seek remedy of situation. Field inspector left correction on 2/6/01. On March 28, 2001, Scott sent a letter to Calvo indicating a corner record had been recorded showing garage was encroaching 9.45 feet into Hubacek property. He stated that the building must be moved or the property line adjusted to provide setbacks. On 5/7/01 Mr. Calvo stated that attorneys are working out an agreement. Stu Edell: Points shown on the subdivision map (30-1,2,3) can be confusing. Corner points defining parcel lines on opposite sides of the street are slightly out of alignment. It is possible to reference a corner point across the street and appear to have setback. Land Development is currently processing a lot line adjustment to resolve the problem. The process is nearly complete. Copies of recorded deeds are all that is outstanding. Summary: The building division generally relies on property owners to identify their parcel boundaries. We have not taken the position to require parcel surveys prior to construction. We urge neighboring property owners to work together to identify parcel boundaries whenever possible. There is an occasional project that results in a situation such as this. It is unfortunate, but does it warrant that every project require a costly survey prior to construction? It is a very complicated and acrimonious story that we will spare you for the most part, but we would like to relate a few of the many things that have occurred during the resolution of this matter. There. finally has been a light at the end of the tunnel, (and this time it was not a train, as my Mother used to say!). Although we want this letter to be about the light, we really cannot do that without showing you the tunnel we have been through for the last 18 months. We wanted to send this letter long ago to express not only our dismay and anger concerning the cause of this incident, but our gratitude and praise as well for the help in it's resolution. We were advised by our attorney to wait until the matter was completed because sending the letter sooner might be seen as an attempt to influence the outcome. So, for those who should be praised we apologize for the delay. Prior to this event we were just your ordinary residents whose experience with the County departments was limited to a couple of permits over the years for a bedroom addition and a new leach line. Other than that our involvement with the County had been limited to such things as paying our taxes, getting our dogs licensed, etc. We had no idea what to do when we realized that someone was building on our land. We knew permits had to be involved, and so we called the County Department of Building and Planning. We explained the situation in detail to the person who answered the phone and were told someone would get back to us. No one called us back" Unfortunately, I had a disabling vehicle accident on the day the building began. My vehicle was destroyed and I needed frequent medical care. Our immediate focus was on this crisis. Having no experience with this type of situation we were not able to find out that Nve needed to take any action on our own until it was too late. We believed during this time that the County was investigating the matter and preventing any trespass on our land to build because we gave them the information. Nearly a month passed after our first call, and, after having had a relapse, I was finally able to call the Building and Planning Department to follow up. The next day I received a call from Scott Rutherford, Chief Engineer. It seems our original message had fallen through the cracks and this was the first he had heard of the situation. The man was nearly despondent! A simple check of the plot plan submitted for this project showed that the applicant claimed to own not just the entire area where he was building, but 54 feet beyond the finished project. A very obvious impossibility, even on paper when Mr. Rutherford just looked at it, and he said that he did not know how the Route To: D P B ❑ FA ❑ CS i i �i Inspector could have missed it! In our residential subdivision most lots are approximately 100 feet by 200 feet. Multiple lots would have to be involved for that much land and that was not even claimed to be the case by the permit applicant. How any Building Inspector even looking at a map of the parcels for our area and the plot plan submitted could not have seen this was beyond belief to anyone we spoke with on this matter. In addition, a bright orange survey marker and a long orange tape hanging from a tree limb, showing the division of our properties at the front, were between the parcels throughout the entire construction. (An existing survey point found and marked just prior to building by a surveyor hired by and paid by the permit applicant.) After getting our message Mr. Rutherford sent the Building Inspector out to check that very_ visible front survey marker that had been there the entire time, and I saw him as he made notes and measured. That one marker alone showed that the building was, if not OVER the property line itself, that it could not possibly have the 5 foot County setback or the 30 foot CDF setback that the applicant had been required to have. When asked by the Inspector the applicant simply walked the Inspector over about 20 feet and said he "really owned to about there" and we were "trying to steal my (sic his) property". (These are verifiable quotes.) In spite of the clearly visible survey marker, which should have at the very least cast doubt, and our almost daily complaints, the Inspector finalized the building on the basis of what the applicant simply told him! We thought that he would at least be required to complete a survey to show the back line and prove he owned the property where he was building. Even at this point he did not have a setback but apparently whatever transpired between the applicant and the Inspector was adequate to put the burden of proof on us. When we saw that the Job Site sign was down we called Mr. Rutherford and he told us that the property owner had walked the Inspector over to a point he said he owned and that the Inspector had finalized the project. Now we are in that tunnel I spoke of before. If we have a complaint with the County it is that; knowing an adjacent property owner is saying that a person is building on their parcel, no proof is required that a person owns the land they are building upon. We realize that you cannot make every person who applies for a permit provide a survey, but for Heaven's sake, when someone is jumping up and down saving it is happening, and there is a big orange survey stake as evidence, we would think you could require an applicant to show he owns the land where he is building! If we are upset with a County employee it is the Building Inspector who could have stopped this whole problem before it began. We are in a residential subdivision, not in an open area with large parcels of land. The Inspector is the one who was here and saw the site for himself and the plot plan. He knew about our claim, he saw the survey marker, he knew about the parcel sizes and that the plot plan was if not a "mistake", then at the kindest "inaccurate" and at the worst perhaps intentionally deceptive. To accept that someone just says they own a piece of property and allow them to continue building and finalize a project while there are complaints and doubts... how does this happen??? As a result, about $2,500.00 in survey and attorney's fees and an infinite amount of our time and stress later, we have reached that light at the end of the tunnel! The building was 9.5 feet over our property line not counting any setback required! Previous to building we had told this applicant that we were not interested in selling our land to him. We were put in the position of having to defend our property from a claim of adverse possession. It was built upon in an open and hostile manner and it was going to be taken from us if we did not hire an attorney. For the average one income family, the innocent citizen and property owner who tried in vane to have what should be protection from this kind of theft from their County, this was, and continues to be, devastating. Because we could not afford the amount of money it would have taken to go to court, and we are told judge's are loathe to tear down buildings, we were literally forced to sell him enough property for a boundary line adjustment. Although we were right and prevailed legally, we did not win anything. We merely had to fight to keep what we could of our own land! The last 18 months have been a huge trial for us, all caused by the stroke of the Building Inspector's pen. (Please relate to him that we were right and that his actions put our lives and our finances in turmoil. We hope that for whatever reason this happened, he does not do it to another property owner.) Now, for the positive. I said before that we had been just "ordinary" residents prior to all of these many months of battle. Now, if our names are spoken in the Department of Building and Planning or Land Development, there will be shudders and people scrambling for a good spot under a desk! I have been a frequent caller to say the least and have learned enough about real estate law, legal jargon, County regulations, names and titles of County personnel (not to mention all their phone numbers!) and just plain "pushiness" to perhaps begin a new career. So, as I wonder what to do with all the free time I'm going to have, I am writing this letter to thank the people who have helped us survive this the most. One of the first opinions from a real estate attorney we received about this case was that "the County is worthless". We changed attorneys. Although I have had my moments I will tell you that I have dealt with many capable, pleasant and obviously hard working County employees through this ordeal. This ranges from supervisors to secretaries. I have been impressed with their patience and I have realized that they have a very difficult job working with we "ordinary citizens" who complain and can be downright cranky. I cannot think of one person I have spoken with who has not been what I would consider a fine employee. However, two people have gone far out of their way and deserve special recognition. First we want to thank Scott Rutherford. I called this poor man so many times he began to recognize my voice and when I asked how, he said it was like his wife calling! Through the months he was always kind, always sympathetic, always knowledgeable and always patient. This is a man who cares about his job and cares about doing it right! As I said he was clearly distraught when he first got my message and realized such a huge mistake was too far in progress to fix in any simple way. He did his best. He stopped the Inspector and sent him out to check the survey marker. When he returned my call about the Job Site sign being down, he seemed as stunned as we were to find out the building had been approved and on what basis. It was from him that we learned what we had to do, to survey ourselves. We had hoped to avoid the expense of this since we were not the people building! But, that was the only solution and from surveying we found we had to hire an attorney or face adverse possession. Mr. Rutherford was an endless source of information and reassurance to us during this ordeal. It was a comfort to speak with someone who understood the matter in as much detail as we did (and didn't charge by the minute like our attorney!). Scott Rutherford is one of the best examples of that first attorney being wrong! The County, as exemplified by employees like him, is far from "worthless"! I hope that Mr. Rutherford is appreciated by his superiors, and by you, for his performance, dedication and the image he presents for his department and the County. And finally, although there are so many others in between, we must especially thank Kathy Parker in Land Development. She is another person who received endless phone calls from me and handled every one with patience; skill and accuracy. If we needed to know the status of any document or matter at any given time, she was on top of it completely. If she said she was going to call you back, you could bank on it! I know there are many competent people in Land Development, and some have helped us as well, but it is Kathy Parker who we dealt with to the point of almost considering her our personal secretary! I joked with her that the place must fall apart when she is gone and although she denied that to be so, I cannot imagine how things would function if she was even out a day sick! She too was always kind and sympathetic when I called and that was very important considering how stressful and frustrating this situation was for us. Ms. Parker is another example of the County at it's finest and we hope too that she is appreciated by her superiors, and by you, for the stellar image she presents for her department and for the County. We ask that you commend these employees and advise their superiors of our gratitude and appreciation for their exemplary service to us on behalf of the County. We hope that no other property owner will have to go through what we did to protect and keep his or her own land in Butte County. We believe the ordinary person has no idea about things like adverse possession. The ordinary person cannot afford an attorney to proceed legally to handle something like this. And we believe the ordinary person assumes the County, by virtue of the permit process and all of the requirements to build, will protect them from someone else building on their land.
