As we discussed in early February, it would be possible to use the structure on the above mentioned parcel as a storage building, but a storage building is not a building permit exempt structure. Therefore, to use the building in such a manner would require building permits. Given that the structure is not of standard construction, the plans must be prepared by an architect or engineer licensed to practice in the State of California. 2. As stated, all plumbing facilities would be required to be removed including fixtures and piping, and the sewer line permanently capped. 3. As stated. 4. If the building is a legal, permitted storage building, residential storage is an allowed use. It would also be possible to use the building as an agricultural exempt building, but the structure would have very specific and limited uses. In this case, Mr. Dutro would be required to obtain an ag. building permit for a fee of $60.00, and describe the exact proposed use of the building. Also, on closer examination the Uniform Building Code does not appear to allow a three story ag. building, so arrangements may need to be made to remove the third story or make it unusable, if a third story exists. CAMERON JODEA A. FOSTER I am writing to confirm what we discussed in our telephone conversation last week. You stated that your records show a power pole permit for the subject property in 1975, and in 1976 a tax assessment on the subject property showing the existence of a residence thereon, thereby establishing approximately when the structure on the subject property was erected. You informed 'me that 1976` was quite sometime before the K Code housing period, which was about 1982 to 1984, and 'that in any event, the K Code housing regulations did not apply to the area where the subject residence was built, having been limited to the Berry Creek/Brush Creek area. Although I have not yet personally verified the information you provided me, I have no reason to doubt its accuracy. Assuming the accuracy of your information, it appears Mr. Dutro will have to either demolish the subject structure or obtain the necessary permits. You stated that as long as Mr. Dutro starts the permit process in the next three to four months, that there would be no penalties, only the current cost of obtaining the permits. However, you said if nothing is done four months from now and a court citation is issued, Mr. Dutro would be looking at treble fees. Pursuant to that discussion I propose an outside deadline of December 3, 1997, for Mr. Dutro to begin the permit process or, in the alternative, demolish the subject structure or face the potential of court action. We agreed that at this time there was` no need` to convene a formal administrative hearing to hear Mr. Dutro's situation. The current tenants, Tony and Barbara Miller, have agreed to resolve the unlawful detainer case by vacating the property no later than April 7, 1998. That unlawful detainer case was filed against the Millers by Mr. Dutro in the North Butte County Municipal Court and is Case No. NC38018. In the meantime, the Millers sued Mr. Dutro in Butte County Superior Court, Case No. 121256. The property is the subject of Case No. 121256, and the Millers allege therein that they purchased the property. The Millers have always behaved as property owners, not tenants, and are still behaving in that fashion, and are still making that claim. That behavior continues to prevent Mr. Dutro from entering the property to make repairs, demolish the building, or conduct inspections to make either of those decisions. That action has since been settled and a copy of the settlement agreement filed with the North Butte County Municipal Court is included herein. Prior to your letter of 12-22-97, Mr. Dutro was unaware of any code violations being committed by the Millers regarding livestock on the property. Had he been, he would have taken appropriate action. Mr. Dutro's lack of knowledge is not necessarily his fault. The Miller's have refused Mr. Dutro the normal right of a landlord to perform periodic inspections of the property. The one inspection allowed by the Millers was limited to the structure only, not the grounds. The Millers are very serious about their privacy, employing guard dogs and detection alert systems. At this point, because of the Millers past history and the settlement agreement included herein, Mr. Dutro does not have the power to abate the code violations described in your letter. Clearly Butte County Code, Chapter 24, Section 24-305.541, applies to Tony and Barbara Miller, not Mr. Dutro. Mr. Dutro has absolutely no interest in the livestock owned by the Millers which is present on the property they are currently in possession of. Building permits have been required for single family dwellings in Butte County since 1962. 2) You also seem to infer that if a residence was constructed as "Class C Housing", conventional building permit requirements do not apply. I will attempt to clarify this point: a) "Class C Housing" does not exist, nor has .it ever existed in Butte County. b) Ordinance 2311 was adopted by the Board of Supervisors in October of 1982 for a period of two years, to allow'.the. construction of "K" Code housing in a designated area of the county on a trial basis. This ordinance allowed a somewhat relaxed enforcement of the building codes, but still required the issuance of a'building permit which included the submittal of plans, payment of fees, plan check, and inspections. As you are aware, we have no record of building permits for the above mentioned parcel with the exception of an electrical permit issued in 1975. c) This ordinance was experimental, and was carefully monitored by a citizens group and the Building Division. Your property is not within the area in which "K" Code housing was allowed, and this alternative was not available until 1982, therefore a conventional building permit was required. You also asked that we supply you with the requirements that would pertain to this particular structure at time of construction in 1976, and with specific building code violations. Our field inspection revealed the structure to be a single family dwelling which appears to be a pyramid, on a post and pier foundation. Given that "C" and "K" codes are not relevant, and building permits were required in 1976, permits, -inspections, and approvals are required for this structure. Present day Uniform Codes will apply and may be found in most public libraries. It is now in order for you to submit four copies of complete plans to this office including plot plans, foundation plans, floor plans and structural details, apply for the required permits, and pay the appropriate fees. The plans must be prepared by an architect or engineer licensed to practice in the State of California.
