Lee Drive,.identified as AP 63,-15"23, Forest Ranch Staff findings were read by Mr. Lawson A Statement: Regarding Negative Impact Maas filed with the County Clerk on February 24, 1975 and there were :no appeals. Proponents: Gover Jones, Box 26, Forest Ranch, explained that his proposal Was for a new, metal building on the site and that his present operation, which does not include washing cars, would not be changed. Tony Santos, P. O. Box 1.2, ,Fores.Manch, also spoke (34q`) in favor of thepro, ct, pointing out that Lots 1, 2, 3, 25, 26j 277 28 and 42 could be used for commercial purposes as per the deed restrictions on the forest Ranch Subdivision, Unit No. 1. Opponents: Mr. awson read correspondence from Barbara and Glan y Ostrander and Lyndon L. Keown (member of the Architectural Control Committee) objecting to construction of a metal building in the.area and access onto Forest Ranch Way from the proposed station. They g e expressed concern about a possible water shortage in the area. Mr. Jones agreed to the proposed conditions of approval.. The hearing was closed and motion made by Commissioner Moore, with a second by Commissioner Thebach, for approval of this use permit with conditions as suggested by staff, making the staff findings a part of the record and finding that conditions in the area will not be altered to any, degree by moving the station`a short distance and that such an operation would' not adversely affect the neighborhood. Leo give, identified as AP 63-15-23, Forest Ranch was held as advertised. Supervisor Richter questioned Mr. Lawson concerning the denial.. This was denied on a 5-3 vote, 1 commissioner absent. Mr, Lawson didn't see any hazard :Crone leaving this variance permitted, however he didn't see any hardship. in setting it back according to the lair either, Hearing opened to the public Appearing: Grover Jones, Forest Ranch. Mr. Jones explained that this is a lot he purchased with his mother-in-law. Each uses one end of the lott she runs an ice cream parlor and he runs a gas station. This variance is requested to allow a propane 'tank which will service his office and he will also be selling propane. If it were placed in the area where the topography would sallow, it would infringe on the parking lot of the ice cream parlor. To place it behind the station would require excavating of a six to seven foot 'bank. Mr. Jones presented a list of people approving the variance to the clerk. Earl Dunn, representing Baldwin, Construction, spoke regarding the deed restrictions on the property. They have informed Mr. Jones by certified mail. that he may be violating the deed restrictions. They request that the Board follow the Planning Cormeission's recommendation. Chait5nan Ladd stated that it is not the job of any county agency to get involved in the matter, of the deed .restrictions. Supervisor McXi.11op felt that when a variance is requested', the deed restrictions should be respected. Discus'si.on Mr. Dunn stated that if the tank were for Mr. ,Jones' personal use, it would be a different matter.
