The above referenced parcel is currently zoned TM -5 (Timber Mountain, 5 acre minimum). This zone allows for a single-family dwelling. This parcel is a 3.79 acre parcel which was created before the TM -5 zone, and is considered a legal pre-existing non -conforming parcel. Should the dwelling be catastrophically destroyed it may be reconstructed, provided it will not be placed within the required building setback areas and meets sanitation codes in effect at the time of reconstruction. The setback requirements for the TM -5 zoning are 50 feet from the center of the road and 10 feet side and rear yard property lines. This parcel is located within a (SRA) State Responsibility Area high fire hazard designated area. For parcels of (1) one acre or larger the building setbacks for the side and rear yard property lines shall be a minimum of 30 feet.
