I am pleased that we were able to determine that there is no improper use of the property owned by Columbia University and assume that the matter will be closed. Upon reflection it occurred to me that there are two distinct possibilities that might be clues to some of the confusion. Although it is impossible to be certain without a survey or surveying equipment, based upon where we left the car and the direction in which we hiked, I think it is possibile that the pump and the meter are not located on the property owned by Columbia University, but are on the adjoining Parcel 13. This conclusion is supported by the fact that the chain of the utilities account does not include the predecessor in title of Columbia University. Even if the pump and meter are located on Columbia's property, it is entirely possible that they are misplaced and should have been located on the adjoining Parcel 13. This also would be consistent with the difference between the chain of the utility service account and the chain of title to the property. It would not, of course, resolve the issue which would arise if someone had in fact been on Columbia University's property bootlegging power from the misplaced or properly placed but misidentified meter. Based upon our observation of the meter and pump, and upon the inconsistency between the chain of the utility service account and the chain of title to the property, I believe it is possible that the meter and pump are in fact on Parcel 13 rather than on Parcel 14 or that the meter and pump should have been located on Parcel 13 and are mislocated on Parcel 14. It is impossible to find the boundary line between Parcel 13 and Parcel 14 on the ground because of the dense brush, but based upon the distance up Village Drive which Jim and I travelled and the distance and direction in which we hiked from Village Drive to the meter and pump,.I believe that either one of the foregoing is entirely possible. Accordingly, I think it would be unwise at this time to assume that the :peter is located on the property owned by Columbia University, Parcel 14, or that if it is so located. Unless new developments occur, I believe this matter is now closed. In my analysis I have assumed that the account with Mr. Huer is current. If this assumption is not correct, please let me know.
