CHRISTINA SIMMONS et al BUTTE COUNTY SUPERIOR COURT CASE NO. 110229. Dear Mr. McCabe: The City of Chico is seeking to acquire by right of eminent domain approximately 1,424 acres of real property located in Butte County between Bid Chico Creek and the north side of Highway 32. As you are aware, to qualify as a legal subdivision, a map must first be recorded unless otherwise exempted or excluded. Government Code sections 66464-66468. Only after the necessary maps have been recorded may a subdivider sell, lease or finance the individual parcels created by the subdivision. Government Code sections 66499.30(b),(c). Our records indicate that the property has never been legally subdivided. Although it was divided for the purpose of drafting a federal survey map and issuing federal land patents, such division does not constitute a subdivision under the Subdivision Map Act ("Act"). John Taft Corporation v. Advisory Agency for the County of Ventura (1985) 161 Cal.App.3d 749. The City of Chico filed its action in eminent domain on April 30, 1991. A lis pendens was also recorded in the County Recorder's Office that day. Two days later, notwithstanding the pendency of the action, and despite the fact that there is no legal subdivision, Anthony and Sandra Santos recorded a Grant Deed against a portion of the property. The Santos' are now actively seeking building permits.
