TERRY A. FLODIN AND LOUISE E. FLODIN AGREE, PER THE ORIGINAL LAND
PURCHASDE CONTRACT DATED FEBRUARY 7, 1997 BETWEEN "FLODIN" SELLER,
AND "ODDY" PURCHASER, TO PROVIDE "ODDY" WITH AN OPERATING WELL, JET
PUMP, A 3 -HP. SUBMERSIBLE PUMP, A 240 GALLON PRESSURE TANK, A 1500
GALLON HOLDING TANK, ELECTRICAL WIRING, PIPING AND GATE VALERS,
WITHIN TWO WEEKS FOLLOWING THE INSTALLATION OF POWER LINES TO THE
WELL LOCATED ON LOT 12 OF THE FLODIN SUBDIVISION.
THE COST OF BRINGING THE POWER LINES TO THE WELL WILL BE AT
"ODDY'S" EXPENSE.

Declaration of Grant of Easement and Well Sharing Agreement
This Declaration of Grant of Easement and Well Sharing Agreement is entered into this 6th day
of May, by Terry A. Flodin and Louise E. Flodin, Husband and Wife (hereinafter referred to as
"OWNERS") who own that certain real property more particularly described on EXHIBIT "A" attached
hereto.
The Owners do hereby declare for the purpose of establishing a plan for the use and development
of the above described properties which shall be held, occupied and conveyed subject to the following
easements and well sharing agreement, and shall be binding on all parties having any right, title or
interest therein, or any part thereof, their heirs, successors and assigns, and shall inure to the benefit of
each owner thereof, and all of which are imposed upon the real properties above described.
1. GRANT OF EASEMENT:
Owners hereby grants to all their successors and assigns, a non-exclusive easement for well and
underground water line use and maintenance as more particularly described on EXHIBIT "B" attached
hereto.
2. USE
Each lot owner agrees to use the well, which is the subject of this Well Sharing Agreement,
primarily for domestic purposes and to reasonably restrict the usage of water so as to not deter the use of
the well and the pump for domestic purposes of the other lot owners. The parties shall cause a separate
electric meter to be installed to the well and pump.
3. PAYMENT OR COSTS:
Each lot owner shall share equally in all utility costs plus all costs of maintenance and repairs
necessary to keep said well and pump in good operating condition. Each owner of each lot shall pay
monthly, its pro -rata share of costs regardless of usage. Each of the owners shall agree upon reasonable
expenditures to be made and each shall submit receipts for all monies received and all expenditures made
within thirty (30) days.
4. DECISION AS TO DIVISION OF COSTS AND WELL MAINTENANCE
Each of the lot owners, their successors and assigns, shall be entitled to one vote with a majority
ruling regarding any and all questions as to necessary maintenance and usage of the well, pump and
related appurtenances which are the subject of this Declaration of Easement and Well Sharing
Agreement.
5. TERM:
This. Declaration of Easement and Well Sharing Agreement shall commence upon its
recordation and shall run until rescinded by the owners of said properties in writing.
6. MODIFICATION:
This Agreement may be modified or terminated a any time during its term by a majority if the lot
owners of the land which is the subject of this Declaration of Easement and Well Sharing Agreement.

7. COVENANT T RUN WITH THE LAND:
This agreement is to be construed as a covenant running with the land and it is further
unaersLood and agreed that this Agreement shall inure to and bind the successors in interest, Whether by
way of sale, assignment, inheritance or otherwise.
.8. PG&E
Upon the installation of P G & E lines and power to the well located on lot 12, at the initial
experice of the owner of lot 10, subsequent hook up to the well by lots 6, 11 and 12, the respective new
owners of those lots will pay to the owner of lot 10, 1/4 of the P G & E construction cost not to exceed
$1,250.00 per hook up.
9. ATTORNEY'S FEES:
Should any litigation be commenced between the parties hereto their personal representative
concerning any of the provisions of this agreement or the rights and duties of any person in relation
thereto, the party or parties prevailing in such litigation shall be entitled, in addition to such other relief
as may be granted, to a reasonable sum as and for their attorney's fees in such litigation which shall be
determined by the court in such litigation , or in a separate action brought for that purpose.

AND "ODDY" PURCHASER, TO PROVIDE "ODDY" WITH AN OPERATING WELL, JET
PUMP, A 3—HP. SUBMERSIBLE PUMP, A 240 GALLON PRESSURE TANK, A 1500
GALLON HOLDING TANK, ELECTRICAL WIRING, PIPING AND GATE VALERS,
WITHIN TWO WEEKS FOLLOWING THE INSTALLATION OF POWER LINES TO THE
WELL LOCATED ON LOT 12 OF THE FLODIN SUBDIVISION.
THE COST OF BRINGING THE POWER LINES TO THE WELL WILL BE AT

Declaration of Grant of Easement and Well Sharing Agreement
This Declaration of Grant of Easement and Well Sharing Agreement is entered into this 6th day
of May, by Terry A. Flodin and Louise E. Flodin, Husband and Wife (hereinafter referred to as
"OWNERS") who own that certain real property more particularly described on EXHIBIT "A" attached
hereto.
The Owners do hereby declare for the purpose of establishing a plan for the use and development
of the above described properties which shall be held, occupied and conveyed subject to the following
easements and well sharing agreement, and shall be binding on all parties having any right, title or
interest therein, or any part thereof, their heirs, successors and assigns, and shall inure to the benefit of
each owner thereof, and all of which are imposed upon the real properties above described.
1. GRANT OF EASEMENT:
Owners hereby grants to all their successors and assigns, a non-exclusive easement for well and
underground water line use and maintenance as more particularly described on EXHIBIT "B" attached
hereto.
2. USE
Each lot owner agrees to use the well, which is the subject of this Well Sharing Agreement,
primarily for domestic purposes and to reasonably restrict the usage of water so as to not deter the use of
the well and the pump for domestic purposes of the other lot owners. The parties shall cause a separate
electric meter to be installed to the well and pump.
3. PAYMENT OR COSTS:
Each lot owner shall share equally in all utility costs plus all costs of maintenance and repairs
necessary to keep said well and pump in good operating condition. Each owner of each lot shall pay
monthly, its pro -rata share of costs regardless of usage. Each of the owners shall agree upon reasonable
expenditures to be made and each shall submit receipts for all monies received and all expenditures made
within thirty (30) days.
4. DECISION AS TO DIVISION OF COSTS AND WELL MAINTENANCE
Each of the lot owners, their successors and assigns, shall be entitled to one vote with a majority
ruling regarding any and all questions as to necessary maintenance and usage of the well, pump and
related appurtenances which are the subject of this Declaration of Easement and Well Sharing
Agreement.
5. TERM:
This.Declaration of Easement and Well Sharing Agreement shall commence upon its
recordation and shall run until rescinded by the owners of said properties in writing.
6. MODIFICATION:
This Agreement may be modified or terminated a any time during its term by a majority if the lot
owners of the land which is the subject of this Declaration of Easement and Well Sharing Agreement.

7. COVENANT T RUN WITH THE LAND:
This agreement is to be construed as a covenant running with the land and it is further
u.,u�,�.�od and agreed that this Agreement shall inure to and bind the successors in interest, whether by
way of sale, assignment, inheritance or otherwise.
.8. PG&E
Upon the installation of P G & E lines and power to the well located on lot 12, at the initial
experice of the owner of lot 10, subsequent hook up to the well by lots 6, 11 and 12, the respective new
owners of those lots will pay to the owner of lot 10, 1/4 of the P G & E construction cost not to exceed
$1,250.00 per hook up.
9. ATTORNEY'S FEES:
Should any litigation be commenced between the parties hereto their personal representative
concerning any of the provisions of this agreement or the rights and duties of any person in relation
thereto, the party or parties prevailing in such litigation shall be entitled, in addition to such other relief
as may be granted, to a reasonable sum as and for their attorney's fees in such litigation which shall be
determined by the court in such litigation , or in a separate action brought for that purpose.
