Dear Mr. and Mrs. Steinecker,
We have reviewed your letter of October 6, 1999, and are taking this opportunity to respond. As
you know, Bill Barron, the Supervising Building Inspector from our Chico office made a site
inspection on October 15, 1999, and discussed the construction related problems you have cited
with you at your home.
During his inspection, Mr. Barron was directed by you to a number of items. I will attempt to
address the items which I understand to be of major concern to you as they were described in
your letter, and to Mr. Barron during his site inspection:
1. Interior walls constructed out of plumb; --1
Ellthough unfortunate and in some=cases-unsightly; this is a matter of workmanship and is
simply not reguiated-by the ccde.

2. Cracking of sheetrock or drywall;
Mr. Barron noted some minor sheetrock cracking, butLnot an unusual amours He noted
no "nail pop," nor was any pointed out to him. Again, this is a matter ofow rkmanship
and is not regulated by the code. Some cracking is common and is found in many homes.
In general, the drywall appeared to be properly applied.

Poor concrete workmanship;
There is apparently a very poorly finished concrete driveway, and the garage slab has an
approximately 12 inch slope from front to back. Unfortunately, the Uniform Codes do
not regulate driveway slabs. The slope of the garage slab is also acceptable. This is
essentially another workmanship issue.
4. The heating system;
Heating may be provided by a free standing unit heater, wall heater, or a ducted forced air
system. Heating units shall be sized to provide a temperature of 70 degrees at a height of
three feet above the floor. Any unit which meets this criteria may be used. At final
inspection, your heating system was in with the California State Energy
regulations in effect at the time.
5. The application of exterior siding;
During his inspection, Mr. Barron noted that our field records contained several
corrections requiring the contractor to complete the siding and to repair the nails or
staples in the siding which were set too deep. In the installation of hardboard panel
siding, it is not uncommon to encounter an installation in which the nails have penetrated
the exterior layer of the material. With some types of siding this creates possible
problems depending on how well the material remains fastened to the building, in that the
nails are not holding the full thickness of siding to the structure. With other types of
siding, it can create another type of problem by allowing water to enter the inner core of
the siding material through the broken protective outer layer.
Although neither of these conditions is desirable, the usual remedy is the same. Add
additional nails which do not over penetrate and which will properly fasten the material to
the building. Properly caulking and painting the penetrations of the exterior skin should
also be done. These remedies together will provide a satisfactory installation in all but
the most extreme cases. In most cases, if nails are properly spaced and driven, it is
assumed a licensed contractor will caulk and paint the building properly, ensuring proper
protection and longevity of the exterior siding. Without these final protective measures,
most siding material will deteriorate over time. Mr. Barron noted that the nail
penetrations and imperfections in the siding do not appear to have been caulked at the
time when the siding was installed, or in the recent past. -
6. The failure of the deck ledger;
When attaching a load bearing ledger to a vertical surface, it is assumed that a licensed .
contractor or builder will anchor the ledger to the framing members in the wall. In most
cases, when an inspector is on a job site for inspection of a single family residence, a deck

is only one portion of the inspection; and generally not the principal focus of the
inspection. A deck is inspected after construction of the primary structure is complete,
and the ledger is visually inspected from the exterior of the building. As such, it is
usually difficult if not impossible to view the rear side of the installation to determine
how many, framing members were penetrated and to what extent. If an adequate number
of nails or bolts are visible, it is standard practice to leave the proper attachment of the
ledger to the wall to the responsible contractor, and to some extent assume good
workmanship practices. Your ledger was attached with 16d nails in sufficient number.
Unfortunately, many of the nails did not penetrate framing members.
In conclusion, items 1, 2, and 3 are workmanship issues, and are not regulated by the Uniform
Codes. In item 4, the residence was finaled with the combination of a wood stove and a gas
heater, which complied with California State energy regulations in effect at that time.
We agree that the exterior siding should not have been penetrated to the extent that it is.
Additional nailing, caulking and painting is the accepted remedy. This should be completed
when the siding is first installed, but it may be done at any time. Continued proper maintenance
will prolong the life of the siding to an even greater extent. We also agree that the deck ledger
should have been properly anchored, but in many situations is difficult, if not impossible, to
inspect.
While we can empathize with your situation, the Uniform Building Codes establish minimum
construction standards and requirements, and we are not able to regulate workmanship issues.

We received the attached letter from Mr. Steinecker and have made some inquiries about the
contractor on this house, Mike Haley. Nothing good can be said about his work. The
Steinecker's bought the home at a fire sale August 15, 1996 for $68,000. (APN 064-210-050)
The house had been repossessed by the bank August 1, 1995. There were notations on this .
house on assessor records. Both times assessors inspected the property, they noted poor
quality/ workmanship, especially in the siding.
We have heard from various sources that Mr. Haley's usual operation was to not get a final
on his homes, but to get the house built enough to occupy and then rent them out. This
seemed to work for a while, until he went bankrupt and the houses were repossessed. Mr.
Haley then left the area.
What is the county's stand on this? Fred would appreciate your contacting the Steineckers.

I purchased my home on Lafayette Cir in August 1996 and in August of this year my deck which
is up approx. 15' fell with me and my husband on it. This home completed construction in August
of 1995. The following day I called a contractor out for a quote on to rebuild it. He had told me
that the deck should never of passed inspection because the nails never were attached to any
studs or headers only to the siding (not to code). He saw this without looking close at it. My
insurance company had come to the same determination. My home has many problems ie .. the
siding installed incorrectly and other items are not to code. My home has drywall coming apart
from the walls. I had my free standing heater checked today and they asked me where my forced
air heating source is. When I told him the Williams is all I have he asked how did the builder get a
certificate of occupancy. I need to know why and how my home passed inspection in 1995:
Three contractors have wondered the same and an HVAC contractor.
I feel my home was grossly neglected when it came to being built and passing codes. The county
should never of let this house pass inspection. My husband and I have $2000.00 in emergency
room visit for this fall. The deck almost fell on me and my husband leg and ankle still have not
healed.
I would like answers and I think someone should come out and inspect this house.
I feel Mike Haley, the contractor (license No. 397803) who has fled the state should somehoWtbe
held responsible.

For your protection, you should be aware that as "owner -builder" you are the responsible party of record
on such a permit. Building permits are not required to be signed by property owners unless they are personally
performing their own work. If your work is being performed by someone other than yourself, you may protect
yourself from possible liability if that person applies for the proper permit in his or her name.
Contractors are required by law to be licensed and bonded by the State of California and to have a
business license from the city or county. They are also required by law to put their license number on all permits
for which they apply.
If you plan to do your own work, with the exception of various trades that you plan to subcontract, you
should be aware of the following information for your benefit and protection:
0 If you employ or otherwise engage any persons other than your immediate family, and the work (including
materials and other costs) is $300 or more for the entire project, and such persons are not licensed as
contractors or subcontractors, then you may be an employer.
0 If you are an employer, you must register with the State and Federal Governments as an employer and you are
subject to several obligations including state and federal income tax withholding, federal social security taxes,
workers compensation insurance, disability insurance costs, and unemployment compensation contributions.
0 There may be financial risks for you if you do not carry out these obligations, and these risks are especially
serious with respect to worker's compensation insurance.
0 For more specific information about your obligations under Federal Law, contract the Internal Revenue
Service (and, if you wish, the U.S. Small Business Administration). For more specific information about your
obligations under State Law, contact the Department of Benefit Payments and the Division of Industrial
Accidents.
If the structure is intended for sale, property owners who are not licensed contractors are allowed to
perform their work personally or through their own employees, without a licensed contractor or subcontractor, only
under limited conditions.
A frequent practice of unlicensed persons professing to be contractors is to secure an "ownerbuildee,
building permit, erroneously implying that the property owner is providing his or her own labor and material
personally. Building permits are not required to be signed by property owners unless they are performing their own
work personally.
Information about licensed contractors may be obtained by contracting the Contractors State License
Board in your community or at 1020 N Street, Sacramento, CA. 95814.
Please complete the "Owner Builder Verification" on the reverse side of this form so that we can confirm
that you are aware of these matters. The building permit will not be issued until the verification is returned.

Dear Mr. Haley:
This is a courtesy notice to notify you that you are in violation of the
Butte County Code, as follows, at the above referenced location:
Failure to obtain approval of previous corrections and failure to obtain
final inspection prior to occupancy and permit expiration for
construction of new single family residence.
Since permits and. inspections are required for the above work, apply for
the required permits to make corrections and complete project and pay the
appropriate fees.
All work must stop until these permits are issued and you are authorized
by our field inspector to proceed. This field authorization cannot be made
until the existing work is inspected and approved.
It is the County's goal to obtain voluntary compliance with the Butte County
Code. However, you should be advised that Butte County has an active Code
Enforcement Program which provides an effective means of enforcement if
voluntary compliance is not obtained. Enforcement may be pursued through
the issuance of citations, fines and the recording of a Notice of Violation
including a description of the action necessary to abate the violation.
You have thirty 30 days to voluntarily comply with the above directions
or to present an acceptable plan for abatement or corrective actions to
be taken by you.

This is a formal warning notice. Pursuant to Butte County Code (BCC)
Section 41-2, we sent you a courtesy notice dated December 15, 1995 notifying
you that you are in violation of the BCC at the above -referenced location.
As of this date, the following violations still exist:
Failure to obtain approval of previous corrections and failure to obtain
final inspection prior to occupancy for. construction of a new single
family residence in violation of the 1988 Uniform .Building Code as
adopted by Section 26-1 of the Butte County Code as follows:
(a) Section 301(a) Permits Required
(b) Section 305(a) Inspections Required
(c) Section 305(d) Inspection Approval Required before Use or Occupancy
Since final inspection is required, prior to occupancy, the building must
be vacated or finaled within ten (10) days from the date of this letter.
This is your final warning. Unless, you contact this office and make the
proper arrangements to correct or abate the violation(s) voluntarily, within
ten 10 days. from the date of. this letter, enforcement shall be pursued
through the issuance of a citation (ordering you to appear in court) for
said violation(s) and for failing to comply with this warning letter.
Upon conviction of said violation(s) or of failing to comply with this
letter, the court shall impose penalties (fines) and a Notice of Violation
shall be recorded in accordance with Butte County Code Section 41-7. The
Notice of Violation shall include a description of the premises the violation
concerns, a description of the violation, the date of your conviction and
the action necessary to correct or abate the violation(s).
