Anderson 395 Richmond Drive, #1 Millbrae, CA 94030 Kliesen #13 October 131 1985 Re: 13936 Rutgers.Court Magalia, CA 95954 Lot 1869 Paradise Pines Unit #15 Butte County Special Inspection #34-85, AP #64-25-28 As I informed Bob in our recent telephone conversation, it has come to may attention subsequent to the closing of escrow thatf.no building permits -from, Butte County or the Paradise Pines Property Owners Association (POA) were obtained for any of the modifications and additions to the house since itt was built in 1981. Specifically, the original deck was converted into a family room, and the small deck with stairs and the larger deck were constructed without the required permits and inspections by either the County or the Architectural Control Committee of the POA. I discovered' the lack of permits when I inquired in September about obtaining a permit for an extension on the larger deck. The POA was aware that a new deck had been added but was not informed that it encroached into the 5 foot "setback" area. When I learned that no permits had been obtained I paid the fee ($50) and had the Chief Building Inspector for Butte County make an inspection. A copy of his report is enclosed. With the single exception of item (1), which pertains to the original construction of the house, all the known defects and uncertainties as to building code compliance relate to.thee additions and improvements you made. As you know, when you listed the house for sale through Goodman Realty (Century 21) you signed a "Listing Information Disclosure Statement" which includes the representations that no room additions,, structural modifications, or other alterations or repairs were made without the necessary permits (item 3)9 that none of the foregoing were made in violation of building codes (item 4) and that there were no violations of "setback" requirements etc. (item 9)• All of these representations were erroneous. You have explained to me that you left it up to your contractor, Thayne E. Atherstone, to secure all the necessary permits and inspections and believed that he had done so. I have attempted to contact Mr. Atherstone but have been unsuccessful. He has moved to. the Riverside, California area but I have not been able to obtain his address or telephone number. If he has a telephone in Riverside, it is not listed. His last known mailing address is: P. 0. Box 351, Paradise, CA. I was given the telephone number (714) 984-9057 as one where he could be reached, but it turned out to be that of a friend who will1not give out information. Mr. Athersone's contractor's bond filed with the State Contractor Licensing Board was suspended in July, 1984. 'You may wish to follow up to see what protection the bond gives you since it was in effect during the March -September, 1983 period when you paid Mr. Atherstone for the additions to the house.. I assume that the work was done at that time. I am sending a copy of this letter and the report of Chief Building Inspector Glander to the Paradise Pines Property Owner's Association, Architectural Control Committee, and will ask their engineer to make an inspection. I want to make sure that the POA does not have requirements in addition to those of the County. I will be retaining an engineer to make the inspections and prepare plans• and cost estimates in accordance with Mr. Glander's report, and any addi- tional requirements the POA may have. I will keep you posted. Needless to say, if Carolyn and I had known that building permits were not obtained and that there were serious defects as noted in Mr. Glander's report, we would have insisted that a sufficient amount be held in escrow to bring the house up to code in all respects, or would have exercised our right to cancel the contract on grounds of material misrepresentations. The fact that you relied on Mr. Atherstone to secure the necessary permits and inspections does not relieve you of your responsibility as sellers to stand behind the accuracy of your representations in the Listing Information Disclosure Statement. California law is very strict on.the necessity for complete and accurate disclosures by sellers in real estate transactions. Buyers are entitled to rely on the representations in the statement. Carolyn and I did so. We must now ask that you bear the cost of bringing the house up to FOA and Butte County requirements, including the engineering work. As soon as I have a cost estimate for work that has the approval of the County and the POA I will contact you. I am sending a copy of this letter and Mr.,Glander's report to Tony Falcone who performed the general building inspection;:for structural soundness etc. prior to -the closing of escrow. He performed his inspection at the request of Goodman Realty but it was for the benefit of the buyers and we paid for it ($168). Mr. Falcone's report not only fails to mention any of the defects which were obvious to Mr. Glander, but makes the erroneous statement that "Thompson stove in den has no apparent problems or defects." .As Mr. Glander's report not6s, the stove is too close to the combustible walls and must. be removed or relocated. Although the imitation stone and black grout behind the stove are designed to be fireproof, heat is conducted to the combustible wall to which they are attached. If Mr. Falcone had detected and reported any of the serious defects that Mr. Glander noticed immediately, we would have been put on notice that we should look into the building permit situation. As it was, Mr. Falcone's report that everything was in good or very good condition (except for the need to have metal flashing around the tree hole in the deck) gave us a false sense of security. The inspection revealed the following items which must be done or resolved: (1) The interior stairway to the underfloor area must be reconstructed or modified to comply with code requirements including minimum tread, width, rise and run. (Uniform Building Code, Section 3306.) (2) The exterior stairway from the deck to grade must be reconstructed to comply with code requirements for rise and run. (Uniform Building Code, Section 3306.) (3) The deck converted to living area does not appear to be structurally adequate. (Please have an engineer review the foundation, post and beam, floor and roof construction systems and present a plan and calculations to us to verify the construction conforms to code requirements and/or to indicate what corrections may be necessary.) (4) Provide skylights in the kitchen and bedroom to satisfy light and venti- lation requirements. (Window area must equal 1/10 floor area, � of which must be openable.)'. (5) The deck construction to the rear and near the property line encroaches into the 5' sideyard setback and appears to have floor joists overspanned. (I suggest same structural solution as #3 above and that you request a sideyard variance from the Butte County Planning Department.) Description: Thompson T-1000 and T-2000 Room Heaters: The units are wood -burning freestanding room heaters designed for use with a - minimum No. 26 gauge, 16 -inch -diameter chimney connector and low -heat appliance chimney system. The stoves are cylindrical in shape and have a heat shield attached to the sides and back of the unit. The stoves are designed to be operated only with the door closed. With the door closed, combustion air enters the firebox through a 4 -inch -diameter No. 10 gauge steel tube positioned vertically within the firebox against the sidewall that pierces and extends 2%4 inches below the bottom plate. A manually operated butterfly damper plate in the tube at the outside air entry regulates the flow of combustion air. As an option, the damper may be automatically operated using a syall thermostat, 24 -volt transformer and motor. The single firebox door is constructed Of cast iron with view ports covered with mica secured by a brass face plate bolted to the door frame. The top section of the firebox is a 3/s -inch cast-iron bell housing with an offset 6 -inch - diameter flue collar for exhaust gases and a solid brass cover plate covering a fuel -loading door. A baffle plate at the firebox top diverts the escaping burning gases before entering the chimney pipe. Overall size of the stoves and additional details are noted in Tables Nos. I and Ii. Except for size,'the stoves are basically identical. Thompson T 2000Z Hearth Insert: The unit is designed to be installed in front of any existing masonry or metal fireplace on the hearth extension. The basic configuration of the unit is the same as the Thompson T-2000, except that the cylindrical No. 12 gauge firebox unit is reduced in overall height to 421/4 inches. A rear 6 -inch -diameter cast-iron flue collar is secured to the back of the firebox unit instead of the top flue discharge. A double No. 18 gauge std'el heat shield is fittud completely around the back, covering the flue collar casting from the top of the firebox down to the horizontal extension of the flue collar that protrudes for connection to a 6 - inch -diameter chimney connector. The inner shield is an extension of the T-2000 unit with an outer shield, installed with a I -inch clearance. TWO 5 - inch by 8 -inch Nedceram glass plates are installed in the cast-iron door frame, unlike the smaller micasheets in the Model T-2000. The upper section of the door frame opening has another single piece of 5 -inch by fl- inch Neoceram glass mounted in a cast-iron frame measuring 7%4 inches by 11 inches. Report No. 3968 September, 1984 Thompson T 1 and T-2 Room Heaters and T 2Z Hearth Insert: The Thompson T- I and T-2 Room Heaters and T -2Z Hearth Insert are the same in design and description as the Thompson T--1000 and T2000 Room Heaters and T -2000Z Hearth Insert, respectively, except the Thompson T- I and T-2 Room Heaters and T -2Z Hearth Insert have painted black cast-iron legs, door face and top, whereas the Thompson T-1000 and T-2000 Room Heaters and T -2000Z Hearth Insert have brass legs, door face and top. All Units: All units followed by the designation SS/TU- I or SS/TU-2 are factory fitted with a stainless steel water tube -boiler system (heat exchanger) according to the manufacturer's specifications. The piping to the water tube boiler system in the stove is field -installed to a water storage tank, either electric or gas -heated with a stainless steel circulating -type pump. The SS/i'U-1 unit is fitted to a 52- or 66 -gallon water storage tank and the SS/TU-2 unit is fitted to a 82- or 120 -gallon water storage tank. Water storage tanks with four toppings, pressure -relief valve and drain valve must be used with this system. Retro -fitting and revamping of old style water tanks are not permitted under this report.
