The home was placed on the lot so as to preserve as many large trees as possible. The contractor, Michael Hays, thought that the home was properly placed within the required setbacks of the RT -1 zoning classification. 1 Low Density Residential BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - June 27, 1990 APPLICABLE REGULATIONS: California Government Code Sections 65905 and 95906; Butte County Code Sections 24-49, 24- 50, 24-150, 24-33, and 24-21.454. COMMENTS RECEIVED: Environmental Health Department: "No requirements for this project." Public Works: "Show hardship." ANALYSIS• This is a request to allow a single family home to be located 45 ft. from the centerline of Oberlin Court in the Paradise Pines area. The required setback as stipulated by Butte County Code Section 24-33 is 50 feet from the centerline of Oberlin Court. A Variance of 5 feet is needed to the Code to accommodate the single family home. The plot plan submitted by the applicant to the Butte County Building Department showed the home approximately 60 to 65 feet from the centerline of Oberlin Court. Location of the home on the plot plan met the requirements of the Butte County Code Section 24-33 and the Building Department stamped the plot plan approved. The applicant then choose not to follow the plot plan and moved the location of the home on the lot closer to the roadway, thus incurring a violation with the Butte County Code Section 24-33. On October 30, 1989, the Butte County Building Department approved the foundation work. The applicant assuming the foundation was placed properly in relationship to the setback requirements, proceeded to construct the underfloor framing and rough plumbing of the home. At the floor inspection point the Building Department recognized the foundation did not comply with the plot plan and also violated the setback requirements of the zone. On December 14, 1989, the applicant was given a correction notice by the Butte County Building Department. The applicant proceeded to construct the home despite numerous correction notices concerning the setback violations. The applicant did not seek to resolve the setback problem until he needed a final approval on the home. On April 16, 1990, four months after completing the home in violation of the zoning code and ignoring the correction notices, the applicant now seeks relief from the zoning laws by requesting the Planning Commission to grant him a variance to the setback requirements of the zone. When considering a variance request, the Planning Commission has to determine whether strict application of the zoning code deprives the property of privileges enjoyed by surrounding properties in the vicinity and under identical zoning classification. An argument is offered by the applicant that the building's alignment with the street was approved by the Building Department at the foundation inspection stage. Thus based on the approval of the foundation, the applicant 2 BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - July 5, 1990 argues that he was released from the responsibility to adhere to the zoning code setback requirements. Granted the approval of the foundation was an oversight of the Building Department, however, the applicant must carry some culpability by placing the home on the lot in blatant violation of the plot plan submitted to the Building Department. In addition, the Building Department caught the oversite immediately and notified the applicant. The applicant had a responsibility to comply with the law immediately or seek a variance. The applicant's actions of ignoring the correction notices for months and not requesting a Variance until such time he had completely finished the home shows contempt of the zoning laws. Variances from the terms of the zoning ordinance should be granted only when, because of special circumstances applicable to the property including size, shape, topography, location, or surroundings, the property is discriminated against by a given requirement of the ordinance. In addition, State law requires any variance granted shall be subject to such conditions as will assure that adjustment by authorized shall not constitute a grant of special privileges inconsistent with limitations upon other properties in the vicinity and zone in which such property is situated. This project is categorically exempt from the requirements of the California Environmental Quality Act in accordance with the Public Resources Code Section 15305, Class 5(a) which states as follows: "Class 5 consists of minor alterations in land use limitations in areas which an average slope of 20%, which do not result in any changes in land use or density, including but not limited Ao: (a) minor lot line adjustment, side yard, and setback variances not resulting in the creation of any new parcels."
