The mobile home was installed in 4/72. Records exist at your office for the septic and in the assessor's office giving this date. The mobile is a 1971 SPA, licensed. The property is now in my name only (Joanne M. Smith). My husband, John H. Smith, died on 9/29/91. The property has been occupied since Dec. 1, 1993 by Alexander and Linda Smith (no relation). They have a lease option which will expire on Sept. 1, 1994 if they do not pay the additional money due to keep the option. They have extended the time to the limit. The property was lease optioned through Help -U -Sell, Paradise, CA. I have had to serve the tenants with payment of rent. They have switched and removed all the skirting without the skirting incorrectly and damaged to replace them. Since they cannot to make the next installment of the the original option money refunded, in an attempt to break the contract a three day notice for late the locks without permission permission. They replaced the back steps in attempts gather the necessary funds contract and will not get they have started harassment (calling the county offices). My present husband, William Payer, has attempted to make repairs and is met with threats and shouting by the tenants. They have refused entry to my electrician.' Bill and a helper have repaired some areas, but we feel at this point in time we are going to have to use legal action. He was atteffip.ting to replace the back steps when we received a notice on July 1, 1994 from the Butte County Building Division to stop all work and obtain permits. We ceased work at that time. Our original plan had been to replace the steps and redirect the gray water by July 8, 1994 in compliance with your 30 day limit. I went to your office, the Assessor's Office, and the Building Division of Butte County during the afternoons of July 5, 1994 and July 6, 1994. My husband called your office on July 6, 1994 Greg Lyon July 8, 1994 so that you would know what had happened. Page 2 I had a meeting with Scott Rutherford of the Building Division on July 6, 1994 and explained the circumstances to him. Our back step replacement falls within the limits that do not require a permit, so we can proceed. The mobile home, deck and garage were installed before permits were required so we can repair them without permits. The tenant also called repeatedly complaining of a gas smell. I had Reliance Propane of Paradise check this complaint, and they went to the property on July 6, 1994. There is no leak. I will send a copy of their report to Scott Rutherford of the Butte County Building Division, as he requested. As previously mentioned, the tenant is now using verbal attacks, shouting and harassment. We have made an appointment with our attorney for July.19, 1994 and hope you will bear with us until we can get legal help to deal with the situation. I am -sorry that Butte County was put to all this trouble by the tenants. I realize your work load is constantly increasing and your staff decreasing. On July 14, 1994 the tenant claimed that his wife, Linda Smith, had fallen at some prior date (I was not given the exact date) on the back steps and that this fall has now caused a permanent condition to her shoulder that will need to be treated the rest of her life, according to their physician (no name). I have referred the claim to my insurance carrier: Foremost Insurance Company, P.O. Box 3100, Redland, CA 92373-0994, Claim # 41-539-1018, Policy # 001771168993 on 7/14/94. My insurance carrier has directed me to leave.the step replacement and skirting in exactly the position it is in until they process the claim. In February the tenants removed the skirting without permission and when they tried to replace the -.skirting and back step, they split the top step. This is the step from which Linda allegedly fell sometime in February or March ?????? They also could not correctly replace the skirting to its original position. The tenants did not pay the POA fees on July 1, 1994 as per the lease option contract, so they will be served with a 30 day notice on July 25°, 1994. I have an appointment with an attorney for August 1, 1994 to assist me in this process. I would appreciate your patience in this matter as I will have the work done as soon as possible. As we also discussed July 6, 1994, a deck of thirty-six (36) square feet or less does not require a building permit. However, aM additional work on the mobile home, decks, or garage will require building permits, including repairs. At this time, I amreferring the violation to the Environmental Health Department and they will determine if the septic system is adequate.
