Forest Hull and I had a verbal contract to build his home at cost plus 10%. The loan officer was aware of this verbal con- tract, including wives, friends, and employees. The building of the house went smoothly until the owner moved all his things into the garage long before the completion of the house. This made it extreamly difficult for the subcontractors, electrician, plumber, and sheetrocker, to complete their work; also requesting more money for the extra work. There are a few things on the list of corrections because of this hinderance. Another problem was with the plumber who was laid up with back trouble. He was unable to hook up the building sewer line. The owner hooked up the line himself, which I was not aware of, and in the process hooked to the wrong compartment of the tank." Several months later problems occured and the owner called me. I had a back hoe expose the tank and part of the system was dug up to the junction boxes to see if waste had entered the boxes, which it had not. The tank was pumped, the line altered, and the tank back-filled. I paid the bill of $360.00 which the owner said he would pay a portion since I felt I was not responsible for the error. He has refused to pay. As part.of our aggrement in building the owner was to use my license on another building he was doing and was to pay me $500.00 for use and instruction. I have spoken to him a number of times and he has not paid me for this either. Another problem in the job was with the septic tank contractor who made an error in his billing. His bill was received by us about two months after the building was completed and the owner refuses to pay this bill in the amount of $1,195.00, not including any interest that might have accrued to this date. The owner felt since the billing was late it was not necessary to pay it. In my conversations with the owner I have stated that I would be more then happy to take care of all remaining corrections so a final inspection can be made as soon as he pays me and the subcontractor what he owes. Also I would like him to put in writing that he will pay my men their hourly wage plus materials for the corrections that need to be done, as this would be in agreement with our original' cost plus 10% contract.
