I After discussion with you on November 5., 1982 concerning the inspection complaint on the above house, I met with Mr. & Mrs. Toepel and. our inspector from Paradise, Bob Keith, on November 8. 1982. We reviewed the structure concerning items 1, 2, 3, 4, 5 and 12 on the Bob Keith inspection correction list dated July 14, 1982 as follows:- (The other items on the correction sheet -were not controversial.) 1. Basement stem walls to be 8" per plans and calca. The basement stem walls were 6" thick instead of 8" shown on the plans; however, they do conform to code requirements. The thickness of the retaining wall at the garage location could not be determined. If the retaining wall is only 6" thick, there could be some overstress in the wall; however, there did not appear to.be any visual problems.resulting from the actual job condition. 7' .. .614,- 2. Provide 2 x 6 studs @ 16" C -C at basement walls. The basement walls were 2 x 6 @ 24" C -C instead of 16" C -C as shown on the plans; however, they do conform to �_ode requirements. 3. Provide wire mesh in slab floor in basement. The slab floor in the basement does not have wire mesh as shown on the plans and is cracking badly in some locations, however, the code does not require basement slabs to be reinforced. 4. Provide approval for cutting glu-lam beams The glu-lama came to the job in two 20' lengths and one 10' length. The two 20' lengths were cut in 10' lengths. This'does not present any .structural -problem with these beams. A5. Provide 6 x 6 post supports for the glu-lam beams. The 4 * x 6 post supports for the glu-lams do not conform to the plans; however, they do conform to code requirements. 12. Provide siding approved for 24" C -C studs. Works Commission (RE: Ray Toe-pel House AP #64-68-20) V*W 12, 1982 TWO siding is 303 19/32" thick plywood which the American Plywood Associa- tion bas gtamped on the panel 16" C -C. -rhe siding does not conform to code requirements and should be corrected. I have talked with the American Plywood Association and they advise the potential problem with the panel would not be structural but buckling and unsightliness. After leaving the Toepel residence, I met with the two inspectors. Jim Clark and Tom May, who were involved in the inspection process. Below is an accounting of what happened to the best of their recollection: 1 & 3 The building foundation system and stem walls were inspected and approved by Jim Clark. He did not realize the foundation was designed by an engineer because the -plans did not so indicate. He therefore approved the changes on wall thickness based upon standard code practice and handout sheets we give people (see attached). My observation is that he did not follow department procedures, and didn't use good judgment in allowing significant construction changes without approval from our plan check section, although the end result does not appear to create any structural problems. 2, 4, 5, & 12 On these items, Jim Clark went to the job for a framing inspection on January 6, 1980 but there were no plans on the job. He went through the job quickly and left an informational correction notice on the items he could inspect without plans, knowing he would need to review plans and make a more detailed inspection on the next trip. Wben the next inspection request was made, Tom May went to the job and approved the corrections made by Clark and signed off the job card. Neither inspector actually conducted a proper framing inspection from the approved plans. (our normal procedure is for a follow-up inspector to only inspect the correction list from the previous same inspection - not to reinspect - unless he sees some obvious hazard. Unfortunately, Tom May did not realize the previous inspector did not make a complete inspection.) This, at least partially, explains why the studs, posts and siding problems occurred. We have long since corrected our paperwork and notes on job records to eliminate this problem, but it does not help this job. Although there was an accumulation of errors made on this job, I believe they were honest mistakes made by inspectors who were trying to do the right job in the most expeditious manner. You can be assured we will stress again with our inspectors the importance of using the approved plans and proper record keeping - using this job as an example. Toepel and our inspector. from Paradise Bob Keith, on November -8, 1982. We reviewed t a structure concerning items 1, 2, 3,'4, 5 and 12 on the Bob Keith inspection correction list dated July 14, 1982 as follows: (The other items on the correction sheet were not controvers:L-al.) 1. Basement stem walls to be 8" per plans and calcs. The basement stem walls were 6" thick instead of 8" shown on the plans; however, they do conform,to code requirementsi. The thickness of the retaining wall at the garage. -location could not be determined. If the retaining wall is only 6" thick, there could be some overstress in the wall; howeve ' r. there did not appear to be any visual problems resulting from*the' actual.job condition. 2. Provide.2 x 6 studs 0- 16" C -C at basement walls. The basement walls were 2 x 6 @ 24'� C -C instead of 16" C -C as shown on the plans; however, they do conform to code requirements. 3. Provide wire mash in slab floor in basement. The slab floor in the basement does not have wire mesh as shown on the plans and is cracking badly in some locations; however, the code does not require basement slabs to be reinforced. 4., Provide approval for cutting glu-lam beams,. The glu-lams came to the job in.two 20' lengths and one 1.0' length. The two 20' lengths were cut in 10' lengths. This does not present any structural problem with these beams. 5. Provide 6 x 6 post supports for the glu-lam beams. The 4 x 6 post supports for the glu-1ams do not conform to the plans; however, they do conform to code requirements. 12. Provide siding approved for 24" C -C studs. * .. . Public Works Commission (RE: Ray Toepel House AP #64-68-20) November 12, 1982 Page Two The siding is 303 19/32" thick plywood which the American Plywood Associa- tion has stamped on the panel 16" C -C. The siding does not conform to code requirements and should be corrected. I have talked with the American Plywood Association and they advi ' Be the potential problem with the panel would not be structural but buckling and unsightliness. After leaving the Toepel residence, I met with the two inspectors, Jim Clark and Tom May, who were involved in the inspection process. Below is an accounting of what happened to the best of their recollection: 1 & 3 The building foundation system and stem walls were inspected and approved by Jim Clark. He did not realize the foundation was designed by an engineer because the -plans did not so indicate. He therefore approved the changes on wall thickness based upon standard code practice and handout sheets we give people (see attached). My observation is that he did not follow department procedures, and didn't use*good judgment in allowing significant construction changes without approval from our plan check section, although the end result does not appear to create any structural problems. 2, 4, 5, & 12 On these items, Jim Clark went to the job for a framing inspection on January 6, 1980 but there were no plans on the job. He went through the job quickly and left an informational correction notice on the items he could inspect without plans, knowing he would need to review plans and make a more detailed inspection on the next trip. When the next inspection request was made, Tom May went to the job and approved the corrections made by Clark and signed off the job card. Neither inspector actually conducted a proper framing inspection from the approved plans. (Our normal procedure is for a follow-up inspector to only inspect the correction list from the previous same inspection - not to reinspect - unless he sees some obvious hazard. Unfortunately, Tom May did not realize the previous inspector did not make a complete inspection.) This, at least partially, explains why the studs, posts and siding problems occurred. 4e have long since corrected our paperwork and notes on job records to eliminate this problem, but it does not help this job. Although there was an accumulation of errors made on this job, I believe they were'honest mistakes made by inspectors who were trying to do the right job in the most expeditious manner. This communication'is to advise you that all of the corrections set out in your letter of February 16, 1984, to Mr. Toepel, have been completed and/or corrected, with the exception of Item 1 which was -the siding which was installed on 24" center studs. I have been informed'that the application of the siding in no way effects the structural integrity of this building and that the recommendation of a different type siding for application to 24" centers on the studs was for cosmeti.c purposes. The maufacturer has indicated that if the type siding which was used is placed -on 24" centers that they have had a warping effect which might not be acceptable for cosmetic purposes but in no way effect the strength of the building. By this letter we are requesting that a final inspection be made of the prop- erty and that no additional permit be required in doing so. Unfortunately, this particular project en'countered.may problems some of which were attribut- able to improper inspection procedures by your department. It is Mr. Toepels' desire at this time that the project be completed by final inspection with no further cost to him for permits and without further accusations or litigations being involved. I also have been communicating with the Department of Housing and Community Development Division of the State of California'and will advise them of our request being made to you and the status of the project. We reviewed the structure concerning items 1, 2, 3, 4, 5 and 12 on the Bob Keith inspection correction list dated July 14, 1982 as follows: (The other items on the correction sheet were not controverstal.) 1. Basement stem walls to be 8" per plans and calcs. The basement stem walls were 6" thick instead of 8" shown on the plans; however, they do conform to code requirements. The thickness of the retaining wall at the garage location could not be determined. If the retaining wall is only 6" thic k, there could be some overstress in the wall; however, there did not appear to be any visual problems resulting, from the actual job condition. 2. Provide 2 x 6 studs @ 16" C -C at basement walls. The basement walls were 2 x 6 @ 24" C -C instead of 16" C -C as shown on the plans; however, they do conform to code requirements. 3. Provide wire mesh in slab floor in basement. The slab floor in the basement does not have wire mesh as shown on the plans and is cracking badly in some locations; however, the code does not require basement slabs to be reinforced. 4. Provide approval for cutting glu-lam beams. The glu-lams came to the job in two 20' lengths and one 10' length. The two 20' lengths were cut in 10' lengths. This does not present any structural problem with these beams. 5. Provide 6 x 6 post supports for the glu-lam beams. The 4 x 6 post supports for the glu-lams do not conform to the plans; however, they do conform to code requirements. 12. Provide siding approved for 24" C -C studs*. t Public Works Commission (RE: Ray Toepel House AP #64-68-20) November 12, 1982 Page Two The siding is 303 19/32" thick plywood which the American Plywood Associa- tion.has stamped on, the panel 16" C -C. The siding does not conform to code requirements and should be corrected. I have talked with the American Plywood Association and they -advise the potential problem with the panel would not be structural but buckling'and unsightliness. After leaving the Toepel residence, I met with the two Inspectors, Jim Clark and Tom May, who were involved.in the inspection process. Below is an accounting of what happened to the best of their recollection: 1 & 3 The building foundation system and stem walls were inspected and approved by Jim Clark. He did not realize the foundation was designed by - an engineer because the -plans did not so indicate. He therefore approved the change's on wall thickness based upon standard code practice and handout sheets we give people (see attached). My observation is that he did not follow department procedures, and didn't use good judgment in allowing significant construction changes without approval from our plan check section, although the end result does not appear to create any structural problems. 2, 4, 5, & 12 On these Items, Jim Clark went to the job for a framing inspection on January 6, 1980 but there were no plans on the job. He went through the job quickly and left an informational correction notice on the items he could inspect without plans, knowing he would need to review plans and make a more detailed inspection on the next trip. When the next inspection request was made, Tom May went to the job and approved the corrections made by Clark and signed off the job card. Neither inspector actually conducted a proper framing inspection from the approved plans. (our normal procedure is for a follow-up inspector to only inspect the correction list from the previous same inspection - not to reinspect - unless he sees some obvious hazard. Unfortunately, Tom May did not realize the previous Inspector did not make a complete Inspection.) This, at least partially, explains why the studs, posts and siding problems occurred. We have long since corrected our paperwork and notes on job records to eliminate this problem, but it does not help this job. Although there was an accumulation of errors made on this job, I believe they were honest mistakes made by inspectors who were trying to do the right job in the most expeditious manner. You can be assured we will stress again with our inspectors the importance of using the approved plans and proper record keeping - using this Job as an example. From our. past experience in laboratory tests on dimensional stability of plywood- siding, any buckling or bowing between studs will appear during initial exposure to high moisture conditions, if'it occurs at.all. Section 26-1 of the Butte County Code states that the County has adopted the.1979 Edition of the ' 'Uniform Building Code. The Uniform Building Code requires that all persons constructing buildings within the County of Butte, except for agricultural buildings, are required to obtain a permit from the County Building' Department. Section 26-6 of the Butte County Code states that: "It sh ' all be unlawful -for any'person, firm, or corporation to erect, construct, alter, repair, move, remove, improve, convert, demolish or equip any building or structure in the unincorporated areas of the County or to cause the same to be done contrary to or in violation of any of the prov,isions of this chapter. "The use or occupancy of any building in violation of any of the provisions of this chapter is hereby declared to be a public nuisance and may be abated in a manner provided by law." Section 1-7 of the Butte County Code provides that any violation of any provision of the Code constitutes a misdemeanor, or in the discretion of the District Attorney, be charged as an infraction. The penalty for a mis ' demeanor is punishment by a fine not'exceeding $500.00 or imprisonment. The punishment for an infraction shall be a fine not to exceed the sum of $500.00. CA 93926 11' K Butte County Grand Jury, Public Works Commi ssion Department of Public Works Ray.Toepel House (AP #64-68-20) November 12, 1982 After discussion with -you on November 5, -1982 concerning the ins' pection complaint on the above house, I met with Mr. & Mrs. Toepel and our inspector .from Paradise, Bob Keith, on November 8, 1982. We reviewed the structure concerning items 1, 2, 3, 4j 5 and 12 on the Bob Keith inspection correction list dated July 14,.1982 as follows: (The other items on the correction sheet were,not controvers#l.) 1. Rasementstem walls to be 8" per plans and calce. LO The basement stem walls were 6" thick instead of 8" shown on the plans; however, they do conform to code requirements. The thickness of the retaining wall at the garage location could not be determined. ,If the retaining wall is only 6" thick, there could be some overstress in the wall; however, there did not appear to be any visual problems.reculting' from the actual job condition. OL- 2. Provide 2 x 6 studs @ 16" C -C at basement walls. 4 - C The basement walls were 2.x 6 @ 2411 C -C instead of '61 -C as shown on the plans; however, they do conform to code requirements. 3. Provide wire mesh in slab floor iri* basement. The slab floor in the basement does not have wire mesh as shown on the plans and is cracking badly in some locations; however, the code does not require basement slabs to be reinforced. 4. Provide approval' -for cutting glu-lam beams. The glu-lams came to the job in two 20' lengths and one 10' length. The two 20.' lengths were cut in 10' lengths. This does not present any structural problem with these beams. 5. Provide 6 x 6'post supports for the glu-lam beams. The 4 x 6 post supports for the-glu-lams do -not conform to the plans; however, they do conform to code requirements. .12. Provide siding approved for 2411 C -C studs. -/,Y le -3 Public Works Commission (RE: Ray Toepel House AP #64-68-20) November 12, 1982 Page Two The siding is 303 19/32" thick plywood which the American Plywood Associa- tion has stamped on the panel 16" C -C. The siding does not conform to code requirements and should be corrected.. I have talked with the American Plywood Association and they advise the potential problem with the panel would not be structural but buckling and unsightliness. After leaving the Toepel residence, I met with the two inspectors, Jim Clark and Tom May, who were involved in the inspection process. Below is an accounting of what happened to the best of their recollection: 1 3 The building foundation system and stem walls were inspected and approved by Jim Clark. He did not realize the foundation was designed by an.engineer because the -plans did not so indicate. He therefore approved the changes on wall thickness based upon standard code practice and handout sheets we give people (see attached). My observation is that he did not follow department procedures, and didn't use good judgment in allowing significant construction changes without approval from our plan check section, although the end result does not appear to create any structural problems. 2, 4, 5, & 12 On these items, Jim Clark went to the job for a framing inspection on January 6, 1980 but there were no plans on the job...He went through the job quickly and left an informational correction notice on the items he could inspect without plans, knowing he would need to review plans and make a more detailed inspection on the next trip. When the next inspection request was made, Tom Hay went to thejob and approved the corrections made by Clark and signed off the job card. Neither inspector actually conducted -a proper framing inspection from the approved plans. -(Our normal procedure is for*a follow-up inspector to only inspect the correction list from the previous same inspection - not to reinspect - unless he sees some obvious hazard. Unfortunately, Tom May did not realize the previous Inspector did not make a complete inspection.) This, at least partially, explains why the studs, posts and siding problems occurred. We have long since corrected our paperwork and notes on job records to eliminate this problem, but it does not help this job. Although there was an accumulation of errors made on this job, I believe they were honest mistakes made by inspectors who were trying to do the right job in the most expeditious manner. New board member LeRoy Biggers was introduced.to.the board. (1) Ray Toepel - Appeal concerning use of plywood on studs 24" on center with plywood grading calling for 16" on center studs. Considerable discussion was held concerning the letter from American Plywood Association, dated 1-19-83, the letter from Frank Tyukos, dated 6-4-86, and with Mr. Tyukos concerning his inspection,and findings. A motion was made by Graves with second by Honeycutt to approve the appeal based upon the above mentioned documents' ' the testimony by Frank Tyukos and the good performance (about five years) of the plywood. Motion carried unanimously. (2) Jim Shaw - Appeal concerning bedroom emergency escape or rescu - e window. Considerable discussion was held concerning firemans ability to rescue being the major reason for the dimensional and area requirements and why Mr. Shaw, did not change windows as advised in writing' and verbally by the department prior to permit issuance, and after note placed on approved plans. Motion by Sirjesse, second by Biggers to deny the appeal. Motion failed - three yes, four no. More discussion held concerning the condition that the remainder of the window assembly constituted a large enough glass which would exceed the code dimensional requirements and probably would ' be broken out by a rescue operation rather than try to use openable window (overall window is 60x3o with 22"x35" openable portion and approximately 4'x3' glass). Section 680-41(b)(1) 1984 N.E.C. requires lighting fixtures and outlets located over indoor spas or hot tubs and within 5' from walls to be a minimum of 7'6" above the maximum water level and be protected by a GFI. Most indoor ceiling heights in residential units have 8' ceiling heights, so to locate the light more than 5' away all but eliminates any. possibility of providing adequate lighting. The. proposed code change, which is recommended for approval by the code committee would add an exception to read as follows: Lighting fixtures meeting the requirements listed below shall be permit- ted to be installed less than 7'6" over a spa or hot tub: (a) Recessed fixtures with a glass or plastic lens and nonmetallic trim, suitable for use in wet locations. (b) Surface mounted fixtures with a glass or plastic globe and a nonmetallic body suitable for use in wet locations. (c) The fixtures shall be protected by a GFI. After considerable discussion concerning the problems of residential ceiling heights and problems 'in trying to obtain compliance, a motion was made by Honeycutt, second by Biggers to approve the department's request and recommend "the above code proposal be used by the department on an interim basis until the N.E.C. change is approved or until the County can adopt the proposed change. The 35 year old house moved from Cohasset Rd. to the present location at the end of Floral Ave. Chico, is presently being re -furbished for occupancy. We are apealing Sec. 1204 ruling of the 1982 Uniform Building Code.. which states, "sleeping rooms shall have a minimum net clear opening of 5.7 square feet. The 5.7 souare feet equals 820 square inches. The present windows are ,square inches for the net opening. They are 43 inches above the floor,and are 21 3/4 inches wide and 35 112 inches high. These dimensions,-:�-e greater than the min. dimensions required in Sec. 1204 of the Uniform Building Code. To meet the requirements of the Building inspector, we would need to grind offf 1/4 inch from all sides of the metal frames which would weeken the windows and make easy air infiltration, or we could replace the windows. Either solution would cost several hundred dollars and would not improve the structure or increase accessibility to that degree of importance. If one can not escape� through a window that is 21 3/4 X 35 112 inches they would not be able to escape through a window 22 3/4 X 35 3/4 inches which is required to meet the Uniform Building "ode specifications. In fact, we have several homes that cannot get final electrical inspection due to this.
