Dear Robert Barkey;,
The Butte County Department of Development Services, Code Enforcement section has determined
by inspection and research that there are currently code violations present on your property at the
above -referenced location. Specifically, the violations include:
1. The keeping of inoperable vehicles in public view.
This is an advisory notice that these uses are in violation of the Butte County Code, as follows:
• Butte County Code, Chapter 24, Section 24-65 - Applicability of zoning regulations.
All uses of land within a zoned district not specifically authorized or permitted by
regulations are prohibited.
Butte County Code, Chapter 24, Section 24-120 - The R-1 (Residential) zone does not
"specifically authorize" large accumulations of junk. The storing of more than 100

square feet of "junk" on a parcel is one of the items used to determine that a "junkyard" 6112
condition exists. A "junkyard" is not an allowed use in the RR=1 zone without a Use Nk
Permit. "Automobiles and other vehicles, dismantled, in whole or in part" are considered
to be "junk." Chapter 11, Section 11-4 forbids people, whether ata licensed junkyard
location or not, from storing junk in public view.
The determination that these violations exist on the property is based on the following definitions in
the Butte County Code:

Butte County Code, Chapter 24, Section 24-305.240 - Junk. Any worn-out and discarded
material in general that may be turned to some use including, but not limited to, any old
iron, wire, copper, tin, lead, rags, paper, bags, lumber, empty bottles, bones, parts of
bicycles, tricycles, baby carriages, automobiles, and other vehicles, dismantled, in whole
or in part, kept, stored, located, situated or piled in public view, and all other similar
personal property ordinarily. defined and classified as "junk" kept, stored, located,
situated or piled in public view and not screened from public view by a fence.
Butte County Code, Chapter 24, Section 24-305.451 - Violator. An adult owner, tenant,
occupant, resident or other person having possession, control or any other ownership
interest in or the right of access to the premises, who is suspected or alleged to have
violated or to be in violation of any Butte County Code provisions of the Chapters
specified in Butte County Code Section 24-305.451.
It is the County's goal to obtain voluntary compliance with the Butte County Code. However, you
should be advised that Butte Countyhas an active code enforcement program which provides an
effective means of enforcement. If voluntary compliance with this notice is not accomplished by
correction or abatement of the violation(s), enforcement may be pursued through the issuance of a
citation to appear in the Butte County Municipal Court. Upon conviction, violators may be fined
and a Notice of Violation may be recorded which will include a description of the action necessary
to abate the violation.
In order to bring the property into compliance with the Butte County Code and avoid further
enforcement actions, you are hereby requested to take the following abatement or correction action:
1. Remove all inoperable/junk vehicles from the property.
You have thirty 30 days to voluntarily .comply with the above directions or to present an
acceptable plan for abatement or corrective actions. Should you have any questions concerning this
matter, please contact me at the address or telephone number listed above.

Dear Mr. Barkey:
I have received your above referenced letter. It is apparent your recent discovery of your
"dilemma", as you refer to it has been upsetting to you. I offer my sincere condolences. I
regretfully inform you, however, that I do not believe that the Building Division can offer you any
relief.
The building inspections conducted on your parcel occurred about 10 years ago, and it appears to
be impossible to determine exactly what occurred. I have reviewed parcel maps of your
subdivision as well as the building permit files for parcel numbers 120, 121 and 122. I would like
to provide you some information about how the building inspection process has customarily been
conducted in Butte County.
The Building Division does not require property owners to provide a survey in conjunction with
an application for a building permit. I am sure that you will agree that to require surveys of every
building permit applicant would add greatly to the cost of homes.
The building inspector visits the property in the company of the owner or the owner's
representative. Frequently, the owner's representative is the building contractor who will
construct the house. When the building inspector visits the property, the owner or contractor
shows the inspector where the parcel property lines are, usually by pointing out survey markers.
I have been to the area where your home is located and I am familiar with the topographical
characteristics and heavily wooded character of your area. As you know, the topographical
characteristics and heavily wooded character of your area make it especially difficult or impossible
to view all four corner markers of most parcels your area at the same time. It appears likely that
the person who constructed your home erroneously assumed that the Eastern and Western
property lines of your parcel ran in a perpendicular manner to the Southern property line and then

misidentified the Western rear corner of your parcel as the Eastern rear corner of your parcel .
Building inspections are carried out largely for safety purposes. The fact that a building inspector
has inspected a particular parcel and home, does not relieve the person who constructs the home
of the responsibility to build the home on the property of the owner.
Once again, I offer my condolences for the situation you find yourself in. If you have any
questions or wish to discuss this matter please do not hesitate to call me.

In January 2000,had I in good faith purchased property in
Magalia,in the County of Butte,on Colter Way,(see assessors
map no 64-70 dated July 21 1994 attached)parcel number 122.
At the time and date of purchase,had I physically looked at
the property on Colter Way,which is approximately .5 acres.
I was under the understanding,that the adjacent property(s)
(property lines)coincided(run parallel)with each other,in a
perfect symmetric alignment,consistent with the County's plot
map,(Assessors Map No 64-70)lot numbers 120,121,122 in
specific.This certainly was"selling"point,in buying the
property.
A few months ago,was it brought to my attention by,my
neighbor that our newly purchased house is encroaching
on her(Mrs.Kvidahl)property,parcel no 121,upon further
investigation,had come to light that her building,was
also NOT located within the property lines,and is in fact
encroaching on parcel no 120.
This recently"discovered"dilemma,has a severe altering impact
on numerous factors pertaining to the properties,with foremost
their marketability,and their property value,and the list goes on.
There have several proposals been made,to remedy the problem
i.e:remove and relocate the houses within the correct property
lines,or adjust the property lines where ALL buildings,are
within the newly proposed property lines.
It is the general consensus,that such an irregular parcel
will be next to impossible to sell,as all properties in
the general area,have geometric sound property lines,which
makes our properties,the•ONLY properties that ZIG-ZAGS.
(see proposed relocation of property lines attached).
Please be herewith advised,that we the property owners,
have under protest tentatively signed the newproposed
relocation of property lines,as submitted to the County
of Butte.(see attached Preliminary Map attached).

It is apparent,that at the time of the first initial building
inspection,when the first stakes to out -line the location of the
building(s)to be build were put in,the County of Butte's building
inspector(s)of that time period,had failed to observe,and recognize
that the building(s)to be build,was(where)NOT within the LEGAL
property limit,which resulted in the now on going dilemma,concerning
ALL three properties.
It certainly apears,that this oversight was repeated on several
separate occasions thereafter,involving parcels 120,121,122,
respectively.
As now County of Butte property owners,have we previously
purchased numerous pieces of property in California,and in
other states alike in our life time,we have however never
encountered such a blunder,with homes encroaching on someone
else's property as the one described,and yet having them pass
ALL pending inspections,during all phases of construction of
the homes.
To say that everyone is very distraught because of the
on going dilemma is an understatement,and certainly is
an unnecessary strain,that no-one needs to endure.
I also believe,that we the"victims",should NOT be held
responsible,accountable,or liable for expenses that have
accrued,or may yet transpire as a result of this negligence.
