FOR RESIDENTIAL DEVELOPMENT
Section 26-8 of the Butte County Code required this acknowledgement to be recorded prior to issuance of a building
permit. The property described herein is adjacent to land or included within an area zoned for agricultural purposes,
and residents of this property may -be subject to inconveniences or discomfort from the use of agricultrual chemicals,
including, but not limited to herbicides, pesticides, and fertilizers; and from the pursuit of agricultural operation's
including, but not limited to cultivation, plowing, spraying, pruning, and harvesting which occasionally generate dust,

until we (Butte County Building Department) receive a check payable to H.C.D. for $ 22.00. The

the mobile from state license rolls and the Butte County Assessor treating the mobile as real property.

5. The following are limitations or requirements for timber operations conducted under a Less Than Three Acre Conversion
Exemption (Notice, Notice of Conversion Exemption, Conversion Exemption):
A. Timber operations shall comply with all other applicable provisions of the Forest Practice Act and regulations, county general plans,
zoning ordinances, and any implementing ordinances; copies of the state rules and regulations may be found on CDF's Web Page on the
Internet at http./Awm.fire.ca.gov.
B. All timber operations shall be complete within one year from the date of acceptance by the Director.
C. All conversion activities shall be complete within two years from the date of acceptance by the Director unless under permit by local
jurisdiction. Failure to complete the conversion requires compliance with stocking standards and stocking report requirements of the Act and
board regulations.
D. The timber operator shall remove or dispose of all slash or woody debris in accordance with 14 CCR 1104.1(a) (2) (D). The timberland
owner may assume responsibility for the slash treatment, provided the landowner acknowledges in writing to the Director such responsibility
at the time of submission of this notice. The specific requirements shall be included with the acknowledgement.
E. Timber operations shall not be conducted during the winter period unless a winter operation plan or in lieu practices required by Forest
Practice regulations are specified within (attached to) this Notice.
F. No timber operations are allowed within a Watercourse and Lake Protection; Zone unless specifically approved by local permit (e.g.
county, city).
G. No timber operations shall be conducted until the Director's notice of acceptance is received and a valid copy of this Notice and the
Director's acceptance shall be kept on site during timber operations.
H. No sites of rare, threatened or endangered plants or animals or species of special concern shall be disturbed, threatened, or damaged.
I. No timber operations are allowed on significant historical or archeological sites.
J. Within one month of the completion of timber operations, including slash disposal, the timberland owner shall submit a Work Completion
Report to the Director.

Winter Operations
Winter period means the period between November 15 to April 1, except for the purpose of installing
drainage facilities and structures, waterbreaks and rolling;dips in which case the period shall be October
15 to May 1.
Timber operations may occur during the winter period. Any. logging conducted during the winter period
will meet the requirements of 14 CCR 934.7 (b) specifically;
1) Erosion Hazard Rating- No winter operations will occur on tractor areas over 50% slope or areas
rated as High EHR. The project area has been rated as moderate EHR and no slopes are over 10% exist.
2) Mechanical Site Preparation Methods- No site preparation activities will occur.
3) Yarding System (constructed skid trails)- Tractor yarding shall be utilized, existing skid trails will
be utilized to the fullest extent possible.
4) Operating Period- Tractor operations will only take place during dry, rainless periods where soils are
not saturated (see below for definition). The following definition for "saturated soil conditions" will be
used. Saturated soil conditions means that site conditions are sufficiently wet that timber operations
displace soils in yarding areas or displace road and landing surface materials in amounts sufficient to
cause a turbidity increase in drainage facilities that discharge into Class I, II; III, or IV, waters, or
downstream Class I, II, III, or IV waters that is visible or would violate applicable water quality
requirements.
In yarding areas, this condition may be evidenced by: a) reduced traction by equipment as indicated by
spinning or churning of wheels or tracks in excess of normal performance, b) inadequate traction without
blading wet soil, c) soil displacement in amounts that cause visible increase in turbidity of downstream
waters in a receiving Class 1, II, III, or IV waters, or in amounts sufficient to cause a turbidity increase in
drainage facilities,that discharge into Class I; II, III, or IV waters, or d) creation of ruts greater than..
would be normal following a light rainfall.
On logging roads and landing surfaces; this condition In `
ay be evidencedby, a) reduced'traction by:
equipment as indicated by spinning or churning,of wheels or tracks'in excess' :4 normal performance -'b)
inadequate traction without blading wet soil, c) soil displacement in amounts that'cause visible increase
in turbidity of the downstream waters in receiving Class I, H, III, or IV waters, or in amounts sufficient to
cause a turbidity increase in drainage facilities that discharge into Class I, II, III, or IV waters, d)
pumping of road surface materials by traffic, or e) creation of ruts greater than would be created by
traffic following normal road watering, which transports surface material to a drainage facility that
discharges directly into a watercourse.
5) Erosion Control Facilities Timing- The requirements of 934.6(a)(2) shall be met which are:
Installation of drainage facilities and structures is required from October 15 to May I on all constructed
skid trails and tractor roads prior to sunset if the National Weather Service forecast is a chance (30% or
rt more) of rain within the next 24 hours, and prior to weekend of other shutdown periods.
6) Consideration of form of precipitation -rain or snow- Most precipitation is in the form of rainfall
but snow does occur in small amounts every few years due to the elevation of the project area is about
2,800 feet.
7) Ground conditions (soil moisture condition, frozen)- See #4 for saturated soil definition.
No operations shall occur on snow covered conditions, operations shall occur during dry rainless periods
as described under #4 above and when the soils are not saturated.
8) Silvicultural System -ground cover- The silvicultural system will result in both overstory and
understory canopy retention in the majority of the exemption area. Some of the hardwood and a portion
of the conifers will be left. The reason for the exemption is for fruit orchard, parking area, and
landscaping.
9) Operations within the WLPZ- No winter operations will occur within any designated WLPZ, no
watercourse is present.
10) Equipment use limitations- Only use of existing facilities will occur during winter period. No site
preparation will occur in exemption area.
11) Known unstable areas- No known unstable areas are present in the exemption area, thus no impact
to unstable areas shall occur.

An Exemption for a less than three acre conversion will be mailed to the California
Department of Forestry and Fire Protection, 6105 Airport Road, Redding,. CA 96002,
(530) 224-2445, on or after October 14, 2007 for the Timberland and Timber owner listed
below. The conversion is a one-time change of use from Timberland to a Parking Area
and turn around. Trees marked with blue paint will be harvested to provide space for all
of above.
A copy of this notice will be posted on the parcel at least five days prior to mailing of the
exemption to CDF. Each property owner of record within 300 feet will be mailed a copy
of this notice immediately prior to the exemption being mailed to CDF.
No watercourses are present in the exemption boundaries:
No archeological sites are located in the exemption area.

Dear Sirs & Madams;
Enclosed is a one-time conversion request for one parcel owned by Julie Greig. She is the
timberland owner for parcel 065-040-008. The intent is to make room for a Parking area
and Turn around for travel trailer and trucks on the parcel. The timber owner is Greg
Osborn. A take tree mark was done with the owner with blue paint marks including butt
mark on the trees to be removed. The LTO will remove the tree. The LTO will also be
responsible for treating the slash generated by the operation to the standards of Section
1104.1(2)(d) of the Forest Practice Rules.
The exemption area boundaries are flagged in pink Timber Harvest Boundary flagging.
Access to the parcel will be by the existing road off Hupp Coutolenc Road. No
endangered or threatened plant or animal species were observed. Habitat for such species
was not noted. This project is in accordance with Butte County regulations and they have
signed off on its compatible use. A copy of the notice posted on the parcel at least 5 days
before submission (copy of notice attached, posted (October 8; 2007). A copy of the
notice was sent to owners of record within 300 feet and the archeological contacts for
Butte County (November 6, 2007).

Watershed Protection Overlay Development Standards
• Firhaven Creek, Paradise Reservoir and Magalia Reservoir Watersheds
Land Use
Current lot or parcel sizes in the Watershed Overlay Zone shall be stringently maintained. No
further division of lots or parcels shall be permitted.
2. Current zoning shall be maintained, other than to allow the consideration of zoning proposal to
a larger minimum parcel size.
3. No change in zoning shall be made and no use permit shall be issued unless and until the
individual and cumulative impact of additional sewage disposal and surface water runoff
created by new development which such zone change or use permit might allow can be proven
to the approving authority by the applicant(s) to have no adverse effects upon the water quality
of the watershed.
Sewage Disposal
1. A 100 -foot sewage disposal setback from a perennial stream, a 50 -foot setback from an
ephemeral stream or drainageway, and a 200 -foot setback from a lake or reservoir shall be
strictly enforced, regardless of the date the lot or parcel was created.
• 2. Appendix VII of the Butte County Improvement Standards for Subdivisions and Parcel Maps
and Site Improvements pursuant to Chapter 20 of the Butte County Code which now applies
only to single-family residential lots or parcels created after April 4, 1974, shall also apply to
all other development, including multi -family residential, commercial, and industrial, on all
lots or parcels regardless of date of creation.
The gallonage of sewage application shall be pro -rated in proportion to the useable area of the
lot or parcel as determined in accordance with Appendix VII, using the Table I value of 350
gallons/day area requirement.
a. A variance may be granted only on an existing lot or parcel when special circumstances are
applicable to the property involving the soil characteristics, topography, or surrounding
property characteristics. Variances may be granted only to the useable area requirements
of Appendix VII, Table I. Cumulative effects within the hydrologic basin shall be
considered prior to issuance of any variance. In no event shall a variance be granted that
would provide less useable area than the requirements of Butte County Code, Chapter 19,
Section 19-12.
b. An application for a variance shall be made in writing on a form prescribed by the health
department. Upon receipt of the application, the Health Officer together with the Manager
_ of the Paradise Irrigation District, and the Chairman of the Water Committee of the Upper
• Ridge Coordinating Council, shall make an investigation to determine whether a variance
should be granted. At the conclusion of the investigation, the Director of Environmental
Health shall prepare a written order granting or denying the variance, and shall include in
such written order specific findings of fact and reasons for its granting or denial.
c. If the Environmental Health Division of the Health Department denies the application for
• Variance, the applicant may file an appeal with the State Regional Water Quality Control
Board within ten (10) days after denial. The decision by the State Regional Water Quality
Control Board shall be final.
Erosion Control Measures
All roadways or driveways for new home sites on new or existing lots shall be surfaced with at
least 2 inches of class 2 aggregate base, unless required to be developed to a higher standard.
2. All roads and driveways shall meet the minimum requirements as prescribed by Public
Resources Code 4290 and 4291 and Butte County Fire Safe Regulations, or as prescribed by
the Butte County Department of Public Works.
3. Erosion and sediment control plans prepared by a qualified professional shall be submitted
with all building permits, discretionary development projects, and grading plans. All
construction activities shall comply with the provisions of the erosion and sediment control
plan. The plans shall include both temporary (fust year) and permanent erosion control
protection measures that prevent sediment and other pollutant discharges from reaching
watershed drainages and streams. At the end of construction, and prior to building occupancy,
the qualified professional shall certify to the Planning and Building Divisions that construction
was in accordance with the erosion and sediment control plan.
• 4. The erosion and sediment control plan shall include the time of year for construction activities.
No construction shall occur after November 15 or before April 1 unless the preparer of the
erosion and sediment control plan certifies that the conditions are suitable for such construction
activities. Should grading be permitted during the rainy season, the smallest practicable area
of erodible land shall be exposed at any one time during grading operations, as directed by the
qualified professional, and the time of exposure shall be minimized. All areas where land
clearing has been completed between April l and November 15 shall be stabilized and/or
planted no later than November 15.
5. No structures shall be placed within 200 feet of the high water mark of the Paradise or Magalia
Reservoirs or within 50 feet of the top of the bank of any perennial or ephemeral water course,
as shown on the most recent edition of USGS 7.5 minute topographic maps, in the Firhaven
Creek, Paradise Reservoir, and Magalia Reservoir watersheds. This provision shall not
preclude development on a parcel that would otherwise become undevelopable due to this
provision, provided that a variance is obtained pursuant to Section 24-50 of the Butte County
Code.
6. The location of homesites (building envelopes) shall be shown on all future parcel and
subdivision maps located in the Watershed Protection Overlay Boundary.
7. Erosion and sediment control plans shall be prepared by a qualified professional involved in
the preparation of erosion control plans and shall be submitted for all three -acre conversion
exemption timber operations within the Watershed Protection Overlay Boundary.
•
8. Three -acre conversion timber harvest operations shall not be conducted in the Watershed
Protection Overlay Boundary during the period from November 15 to April 1.
