The court, having considered the evidence and heard the 3 arguments of counsel and being fully advised, issues the following 4 Judgment: 5 6 STIPULATIONS 7 Counsel for Plaintiff and Defendant stipulated that 8 interest should be inserted on the Judgment from the date of the 9 ruling on Defendant's Motion to Amend Pleadings According to Proof. 10 11 FINDINGS 12 The court makes the following findings with regard to all 13 issues: 14 1. In 1984, Plaintiff was a widowed woman in her late 50s. 15 She owned real property located in Magalia, Butte County, California. 16 A small house was on the property, which was Plaintiff's principal 17 residence. 18 2. In 1984, Defendant, a young man in his early 20s began 19 doing odd jobs for Plaintiff, including repair and maintenance on her 20 cars, repair and maintenance on her house, and other odd jobs on the 21 property. 22 3. Defendant was to be compensated for these jobs by the 23 job completed. 24 4. In the summer of 1987, Defendant inherited $30,000.00. 25 5. In November, 1987, Defendant invested in a backhoe and 26 other heavy equipment, with the intent to start a backhoe business. 27 6. On November 7, 1987, Plaintiff executed a deed .281 transferring a joint interest in her real property to Defendant, the 2 JUDGMENT (Bargsten v. Camacho) 1 Deed reciting that the transaction was without consideration. 2 7. At about the same time, oral agreements were made 3 between Plaintiff and Defendant whereby Defendant would develop the 4 property, including doing extensive grading and building a garage. 5 The exact nature and detail of the oral agreements is not supported 6 by credible evidence one way.or the other. 7 8. In the spring of 1987, Defendant began grading the 8 property. 9 9. Defendant kept no time sheets, and did not bill 10 plaintiff. 11 10. The driveway was done in late 1985 and 1986, which was 12 more than two years before the filing of the answer, even if the 13 amendment is deemed to relate back to the original answer. 14 11. As to the dirt moving and grading, it occurred in 1987 15 and is within two years of the March 14,. 1989 answer to the 16 complaint. 17 12. The Defendant admittedly used smaller equipment for 18 the job than would normally be used which would have lengthened the 19 time on the job. 20 13. Defendant was not really experienced at earth moving 21 and had just acquired the equipment. 22 14. For various reasons the grading of the property and 23 building of the garage were never completed. 24 15. In the spring of 1987, Defendant constructed a small 25 cabin, which is removable from the land and began residing there as 26 his principal residence with the.approval of Plaintiff. 27 16. There was no evidence as to any increase in the value 28 of the subject property. 3 JUDGMENT (Bargsten v. Camacho) 1 17. There was no evidence as to any increase in the value 2 of the subject property. 3 4 DECISION 5 1. With regard to the issue of whether or not Defendant 6 obtained an interest in the.subject property as a result of fraud, 7 the court's decision is that he did not. 8 a. The court based its decision on the following 9 facts: On November 7, 1986, Plaintiff executed a Deed conveying a 10 one-half interest in the real property which is the subject of this 11 action. Prior to executing the deed, Plaintiff held title as fee 12 simple solely in her name. About the same time, Plaintiff and 13 Defendant entered into various oral agreements regarding development 14 of the property and the building a garage. The court finds that 15 there is not sufficient credible evidence to establish the exact 16 nature and details of the oral agreements. 17 b. The legal basis for the court's decision is as 18 follows: The elements of fraud are as follows (1) a false 19 representation or concealment of the material facts susceptible of 20 knowledge; (2) made with the knowledge of its falsity or without 21 sufficient knowledge on the subject to -warrant a representation; (3) 22 with the intent to induce a person to whom it is made to act on it; 23 (4) the person must - act in justifiable reliance on the 24 representation and (5) to his or her damage. In this case there was 25 no false representation or concealment of a material fact, made with 26 the knowledge of its falsity with the intent to induce Defendant to 27 act on it. 28 2. With regard to the issue of whether Defendant obtained 4 JUDGMENT (Bargstea v. Camacho) 1 an interest in the subject property as a result of any undue 2 influence, the court's decision is that he did not. 3 a. With regard to setting aside or canceling deeds, 4 undue influence must amount to coercion which is calculated to 5 destroy or hamper the free agency or will of the grantor and it must 6 exist at the time of execution of the deed, must bear directly upon 7 execution of the deed, and must be a controlling influence in 8 impelling it. Such facts were not present in this case. 9 3. With regard to the issue of whether Defendant holds on 10 interest in the subject property under constructive trust in favor of 11 Plaintiff, the court's decision is that he does. 12 a. The court based its decision on the following 13 facts: Plaintiff did not intend to permanently give Defendant an 14 interest in the property, Defendant did not live on the property and 15 protect Plaintiff as he had agreed to do before receiving the 16 property, and Defendant did not build a garage as he had agreed. 17 Therefore, Defendant breached his contract with Plaintiff. 18 b. To impose a constructive trust the following 19 elements must be present: (1) the existence of property or some 20 interest therein; (2) Plaintiff's right to the property; and (3) 21 Defendant's gain of the property by a wrongful act. 22 4. With regard to the issue of whether Defendant owes 23 money to Plaintiff for any transaction between Defendant and 24 Plaintiff after January 13, 1987, as a result of a breach of contract 25 or common count, the court's decision is that Defendant owes 26 Plaintiff for the following loans, as represented by the checks as 27 indicated: 28 (1) Check #112, dated March 30, 1987, in the 5 JUDGMENT (Bargsten v. TOTAL AMOUNT OWED TO PLAINTIFF BY DEFENDANT: $9,200.00 a. The court based its decision on the following facts: On March 30, 1987, Plaintiff gave Defendant a check, payable to Defendant in the amount of $2,000.00. Plaintiff and Defendant agreed that this was a loan to Defendant and that he would repay Plaintiff when he was able. On April 30, 1987, Plaintiff gave Defendant a check payable to Defendant in the amount of $6,000.00 Plaintiff and defendant agreed that this was a loan to Defendant and that he would repay Plaintiff when he was able. On October 6, 1987, Plaintiff gave Defendant a check, payable to Defendant in the amount of $1,200..00. Plaintiff and Defendant agreed that this was a loan to Defendant and that he would repay Plaintiff when he was able. Defendant repaid none of the amounts of these loans to Plaintiff, therefore, the amount due and owing to Plaintiff is $9,200.00. 5. As to the issue of Defendant's affirmative defense that he is entitled to an offset for work he had done or improvements he made to the subject property against any amounts he may owe to Plaintiff, the court's decision is that Defendant•is entitled to an offset of $3,030.00. a. The court based its decision on the following facts: Defendant testified he put in hundreds of hours of work; twenty five hours a week for April, May, June, July and August (which would be 500 hours); that he moved 900 cubic yards of dirt, digging 6 JUDGMENT (Bargsten v.
