Dear Property Owner:
An application for a building permit has been submitted in your name listing yourself as the builder of the property
improvements specified.
For your protection you should be aware that as "owner -builder" you are the responsible party of record on such a
permit. Building permits are not required to be signed by property owners unless they are personally performing their own
work. If your work is being performed by someone other than yourself, you may protect yourself from possible liability if
that person applies for the proper permit in his or her name.
Contractors are required by law to be licensed and bonded by the State of California and to have a business license
from the city or county. They are also required by law to put their license number on all permits for which they apply.
If you plan to do your own work, with the exception of various trades that your plan to subcontract, you should be
aware of the following information for your benefit and protection:
o If you employ or otherwise engage any persons other than your immediate family, and the work (including materials
and other costs) is $200 or more for the entire project and such persons are not licensed as contractors or
subcontractors, then you may be an employer.
o If you are an employer, you must register with the state and federal government as an employer and you are subject
to several obligations including state and federal income tax withholding, federal social security taxes, workers'
compensation insurance, disability insurance costs, and unemployment compensation contributions.
o There may be financial risks for you if you do not carry out these obligations, and these risks are especially serious
with respect to workers' compensation insurance.
o For more specific information about your obligations under federal law, contact the Internal Revenue Service (and,
if you wish, the U.S. Small Business Administration). For more specific information about your obligations under
state law, contact the Department of Benefit Payments and the Division of Industrial Accidents.
If the structure is intended for sale, property owners who are not licensed contractors are allowed to perform their
work personally or through their own employees, without a licensed contractor or subcontractor, only under limited
conditions.
A frequent practice of unlicensed persons professing to be contractors is to secure an "owner -builder" building
permit, erroneously implying that the property owner is providing his or her own labor and material personally. Building
permits are not required to be signed by property owners unless they are performing their own work personally.
Information about licensed contractors may be obtained by contacting the Contractors' State License Board in your
community or at 1020 N Street, Sacramento, California 95814.
Please complete and return the enclosed owner -builder verification from so that we can confirm that you are aware
of these matters. The building permit will not be issued until the verification is returned.

Dear Mr. Kroschel,
The Butte County Department of Development Services, Planning Department, has reviewed the
submitted Building Department Permit Application 05-0313 for a garage. Your property is
located in a Watershed Protection Zone and therefore the requirements of this zone must be met
when any construction activities occur in this area. I have attached a copy of the policies,
procedures and standards for these Watershed Protection Zones.
In these regulations it states that erosion and sediment control plans, including provisions for wet
weather conditions, are required to be submitted with all building permits, discretionary
development projects, ... The erosion and sediment control plans shall comply with the
recommendations of a qualified professional involved in the preparation of erosion control plans.
Additionally, no soil disturbance shall occur after November 15 or before April 1 unless the
director of development services (Yvonne Christopher), or her authorized agent, determines
project soil conditions to be adequate to accommodate development activities. In order to grant
this request, an erosion and sediment control plan will be needed to address construction
activities during these wet weather conditions.
Please submit an erosion and sediment control plan for the Butte County Engineer to review for
approval. In your file, I found an Erosion Control Plan that was submitted when you received
your new single family house permit. You may want to work with Sierra West Surveying again,
since they are familiar with your site; however, you are free to work with any qualified
professional to complete this Plan for you. Should you have any questions please feel free to call
Lana Adler, Assistant Planner, between the hours of 8:00 a.m. and 4:00 p.m. Monday through
Friday at (530) 538-7601.

Chapter 24 ZONING*
24-235.10 Policies, procedures and standards forth ' e Firhaven Creek, Paradise
Reservoir, and Magalia Reservoir watersheds.
(a) Land use.
(1) Current lot or parcel sizes in the Firhaven Creek Watershed shall be stringently maintained.
No further division of lots or parcels shall be permitted.
(2) Current zoning shall be maintained within the Magalia Reservoir, Paradise Reservoir and
Firhaven Creek Watershed. Consideration of zoning proposals to a larger minimum parcel size is
allowed.
(3) No change in zoning shall be made and no use permit shall be issued unless and until the
individual and cumulative impact of additional sewage disposal and surface water runoff created
by new development which such zone change or use permit might allow can be proven to the
approving authority by the applicant(s) to have no adverse effects upon the water quality of the
watershed.
(4) Notwithstanding the permitting requirements in any zone district which underlies the
watershed protection zone, a second dwelling unit pursuant to section 24-280 shall require a use
permit within the boundary of the watershed protection zone.
(5) Notwithstanding the provisions of any zone district which underlies the watershed protection
zone, the use of the flexible lot size provisions in section 24-82 shall not be allowed within the
boundary of the watershed protection zone.
(b) Sewage disposal:
(1) A one hundred -foot sewage disposal setback from a perennial stream, a fifty -foot setback
from an ephemeral stream or drainage way, and a two hundred -foot setback from a lake or
reservoir shall be strictly enforced for all lots or parcels within the Firhaven Creek, Paradise
Reservoir and Magalia Reservoir watersheds regardless of the date the lot or parcel was created.
(2) Appendix VII of the Butte County Improvements Standards for Subdivisions and Parcel Maps
and Site Improvements pursuant to Chapter 20 of the Butte County Code which now applies only
to single-family residential lots or parcels created after April 4, 1974, shall also apply to all other
development, including multi -family residential, commercial, and industrial, on all lots or parcels
regardless of date of creation. The gallonage of sewage application shall be pro -rated in
proportion to the usable area of the lot or parcel as determined in accordance with Appendix VII,
using the Table I value of three hundred fifty (350) gallons/day area requirement.
a. A variance may be granted, pursuant to section 19-21 of the Butte County Code, only on an
existing lot or parcel when special circumstances are applicable to the property involving the soil
characteristics, topography, or surrounding property characteristics. Variances may be granted
only to the usable area requirements of Appendix VII, Table 1. Cumulative effects within the
hydrologic basin shall be considered prior to issuance of any variance. In no event shall a
variance be granted that would provide less usable area than the requirements of Butte County
Code, Chapter 19, section 19-12.
b. An application for a variance shall be made in writing on a form prescribed by the health
department. Upon receipt of the application, the health officer together with the manager of the
Paradise Irrigation District, and the chairman of the water committee of the Upper Ridge
Coordinating Council, shall make an investigation to determine whether a variance should be
granted. At the conclusion of the investigation, the director of environmental health shall prepare
a written order granting or denying the variance, and shall include in such written order specific
findings of fact and reasons for its granting or denial.
c. If the environmental health division of the health department denies the application for
variance, the applicant may file an appeal with the state regional water quality control board
within ten (10) days after denial. The decision by the state regional water quality control board
shall be final.

(c) Erosion control measures.
(1) All driveways for new home sites on new or existing lots shall be surfaced with at least two (2)
inches of Class 2 aggregate base, unless required to be developed to a higher standard.
(2) All roads created as a result of any land division shall be surfaced with a minimum of two (2)
inches of Class 2 aggregate base, to a minimum width of twenty (20) feet, unless required to be
developed to a higher standard by other code requirements. This standard shall apply from a
maintained county road, or existing road of a higher standard, through the parcel being divided.
(3) All roads and driveways shall meet the minimum requirements as prescribed by Public
Resources Code 4290 and 4291 and Butte County Fire Safe Regulations, or as prescribed by the
Butte County Department of Public Works.
(4) Erosion and sediment control plans, including provisions for wet weather conditions, shall be
submitted with all building permits, discretionary development projects, and grading plans,
excluding structures that fall under the provisions of section 26-3.1 of the Butte County Code.
The erosion and sediment control plans shall include both temporary (first year) and permanent
erosion control protection measures that prevent sediment and other pollutant discharges from
reaching watershed drainages and streams. The erosion and sediment control plans shall comply
with the recommendations of a qualified professional involved in the preparation of erosion
control plans. Said plans shall be reviewed and approved by the department of development
services.
(5) The erosion and sediment control plan shall include the time of year for construction activities.
No soil disturbance shall occur after November 15 or before April 1 unless the director of
development services, or his or her authorized agent, determines project soil conditions to be
adequate to accommodate development activities. All such areas where land clearing has been
completed between April 1 and November 15 shall be revegetated, hydroseeded, mulch
protected or otherwise stabilized no later than December 1. Should grading be permitted during
the rainy season, the smallest practicable area of erodible land shall be exposed at any one time
and the time of exposure shall be minimized. Temporary erosion control measures shall be in
place on a daily basis.
(6) No structures shall be placed within two hundred (200) feet of the high water mark of the
Paradise or Magalia Reservoirs or within fifty (50) feet of the top of the bank of any perennial or
ephemeral water course, as shown on the most recent edition of USGS 7.5 minute topographic
maps, in the Firhaven Creek, Paradise Reservoir, and Magalia Reservoir watersheds. This
provision shall not preclude development on a parcel that would otherwise become
undevelopable due to this provision.
(7) The location of homesites (building envelopes) shall be shown on all future parcel and
subdivision maps in the Firhaven Creek, Paradise Reservoir, and Magalia Reservoir watersheds.
(8) Erosion and sediment control plans prepared by a qualified professional involved in the
preparation of erosion control plans shall be submitted for all three -acre exemption conversion.
timber operations in the Firhaven Creek, Paradise Reservoir, and Magalia Reservoir watersheds.
(9) Three -acre exemption conversion timber harvest operations shall not be conducted in the
Firhaven Creek, Paradise Reservoir, and Magalia Reservoir watersheds during the period from
November15 to April 1. (Ord. No. 3431, § 2, 6-9-98; Ord. No. 3536, § 3, 7-13-99; Ord. No. 3560,

County Storm Water Permit Compliance
By signing below, I, the project architect/engineer of record, indicate that I am aware that a
construction project that disturbs more than 1 acre of land requires a Construction Storm Water
Permit from the State Water Resources Control Boar4. I, additionally, understand that it is the
project owner's/owner's agent's responsibility to submit a Notice of Intent (N.O.I.), a Storm
Water Pollution Prevention Plan (SWPPP) and a fee of $700.00 to the State Water Resources
Control Board to obtain such a permit. I, further, certify that this project will not disturb more
than 1 acre of land. I have also reviewed the Best Management Practices Handbooks, California
Storm Water Quality Task Force, Sacramento, CA. I certify that appropriate BWs will be
implemented to effectively minimize the negative impacts of this project's construction activities
on storm water quality. I acknowledge that it is my obligation to make the project owner and
contractor aware that the selected BNIPs must be installed, monitored, and maintained to ensure
their effectiveness. If, at any time, site conditions and/or observations by a County official
warrant reevaluation and revisions of the chosen BNTs, the appropriate changes will be made
without unnecessary delay. I am aware that failure to properly implement and maintain the
BMPs necessary to prevent the discharge of pollutants from this project during construction
could result in significant penalties and/or delays.

OWNER BUILDER INFORMATION
Dear Property Owner:
An application for a budding permit has been submitted in your name listing yourself as the builder of property
improvements specified.
For your protection, you should be aware that as "owner -builder" you are the responsible party of record on such
a permit Building perm are not required to be signed by property owners unless they are Personally performing their
own work If your work is being performed by someone other than yourself, you may protect yourself from possible
liability if that person applies for the proper permit in his or her name.
Contractors are required by law to be licensed and bonded by the State of California and to have a business
license from the city or county. They are also required by law to put their license number on all permits for which they
apply.
If you plan to do your own work, with the exception of various trades that you plan to subcontract, you should
be aware of the following information for your benefit and protection:
♦ Ifyou employ or otherwise engage any persons other than your immediate family, and the work ('Including materials
and other costs) is $300 or more for the entire project, and such persons are not licensed as contractors or
subcontractors; then you may be an employer.
♦ If you are an employer, you must register with the State and Federal Governments as an employer and you are
subject to several obligations including state and federal income tax withholding, federal social seciaity taxes,
workers compensation insurance, disability insurance costs, and unemployment compensation contributions.
♦ There may be financial risks for you if you do not carry out these obligations, and these risks are especially serious
with respect to worker's compensation insurance.
♦ For more specific h&nnation about your obligations under Federal Law, contract the Internal Revenue Service (and,
ifyou wish, the U.S. Small Business Administration). For more specific information about your obligations under
State Law, contact the Department of Benefit Payments and the Division of Industrial Accidents.
If the structure is intended for sale, property owners who are not licensed contractors are allowed to perform their
work personally or through their own employees, without a licensed contractor or subcontractor, only under limited
conditions.
A frequent practice of unlicensed persons professing to be contractors is to secure an "owner builder" binding
permit, erroneously implying that the property owner is providing his or her own labor and material personally. Budding
permits are not required to be signed by property owners unless they are performing their own work personally.
Iuforination about licensed contractors may be obtained by contracting the Contactors State License Board in your
community or at 1020 N Street, Sacramento, CA. 95814.
Please complete the "Owner Builder Verification" on the reverse side of this form so that we can confirm that you
are aware of these matters. The building permit will not be issued until the verification is returned.

Watershed Protection Overlay Development Standards
• Firhaven Creek, Paradise Reservoir 'and Magalia Reservoir Watersheds
Land Use
1. Current lot or parcel sizes in the Watershed Overlay Zone shall be stringently maintained. No
further division of lots or parcels shall be permitted.
2. Current zoning shall be maintained, other than to allow the consideration of zoning proposal to
a larger minimum parcel size.
3. No change in zoning shall be made and no use permit shall be issued unless and until the
individual and cumulative impact of additional sewage disposal and surface water runoff
created by new development which such zone change or use permit might allow can be proven
to the approving authority by the applicant(s) to have no adverse effects upon the water quality
of the watershed.
Sewage Disposal
1. A 100 -foot sewage disposal setback from a perennial stream, a 50 -foot setback from an
ephemeral stream or drainageway, and a 200 -foot setback from a lake or reservoir shall be
strictly enforced, regardless of the date the lot or parcel was created.
2. Appendix VII of the Butte County Improvement Standards for Subdivisions and Parcel Maps
and Site Improvements pursuant to Chapter 20 of the Butte County Code which now applies
only to single-family residential lots or parcels created after April 4, 1974, shall also apply to
all other development, including multi -family residential, commercial, and industrial, on all
lots or parcels regardless of date of creation.
The gallonage of sewage application shall be pro -rated in proportion to the useable area of the
lot or parcel as determined in accordance with Appendix VII, using the Table I value of 350
gallons/day area requirement.
a. A variance may be granted only on an existing lot or parcel when special circumstances are
applicable to the property involving the soil characteristics, topography, or surrounding
property characteristics. Variances may be granted only to the useable area requirements
of Appendix VII, Table I. Cumulative effects within the hydrologic basin shall be
considered prior to issuance of any variance. In no event shall a variance be granted that
would provide less useable area than the requirements of Butte County Code, Chapter 19,
Section 19-12.
b. An application for a variance shall be made in writing on a form prescribed by the health
department. Upon receipt of the application, the Health Officer together with the Manager
of the Paradise Irrigation District, and the Chairman of the Water Committee of the Upper
• Ridge Coordinating Council, shall make an investigation to determine whether a variance
should be granted. At the conclusion of the investigation, the Director of Environmental
Health shall prepare a written order granting or denying the variance, and shall include in
such written order specific findings of fact and reasons for its granting or denial.
c. If the Environmental Health, Division of the Health Department denies the application for
• Variance, the applicant may file an appeal ,with the State Regional Water Quality Control
Board within ten (10) days after denial The decision by the State Regional Water Quality
Control Board shall be final.
Erosion Control Measures
1. All roadways or driveways for new home sites on new or existing lots shall be surfaced with at
least 2 inches of class 2 aggregate base, unless required to be developed to a higher standard.
2. All roads and driveways shall meet the minimum requirements as prescribed by Public
Resources Code 4290and 4291 and Butte County Fire Safe Regulations, or as prescribed by
the Butte County Department of Public Works.
3. Erosion and sediment control plans prepared by a qualified professional shall be submitted
with all building permits, discretionary development projects, and grading plans. All
construction activities shall comply with the provisions of the erosion and sediment control
plan. The plans shall include both temporary (first year) and permanent erosion control
protection measures that prevent sediment and other pollutant discharges from reaching
watershed drainages and streams. At the end of construction, and prior to building occupancy,
the qualified professional shall certify to the Planning and Building Divisions that construction
was in accordance with the erosion and sediment control plan.
• 4. The erosion and sediment control plan shall include the time of year for construction activities.
No construction shall occur after November 15 or before April l unless the preparer.of the
erosion and sediment control plan certifies that the conditions are suitable for such construction
activities. Should grading be permitted during the rainy season, the smallest practicable area of
erodible land shall be exposed at any one time during grading operations, as directed by the
qualified professional, and the time of exposure shall be minimized. All areas where land
clearing has been completed between April 1 and November 15 shall be stabilized and/or
planted no later than November 15..
No structures shall be placed within 200 feet of the high water mark of the Paradise or Magalia
Reservoirs or within 50 feet of the top of the bank'of any perennial or ephemeral water course,
as shown on the most recent edition of USGS 7.5 minute topographic maps, in the Firhaven
Creek, Paradise Reservoir, and Magalia Reservoir watersheds. This provision shall not
preclude development on a parcel that would otherwise become undevelopable due to this
provision, provided that a variance is obtained pursuant to Section 24-50 of the Butte County
Code.
6. The location of homesites (building envelopes) shall be shown on all future parcel and
subdivision maps located in the Watershed Protection Overlay Boundary.
7. Erosion and sediment control plans shall be prepared by a qualified professional involved in
the preparation of erosion control plans and shall be submitted for all three -acre conversion
• exemption timber operations within the Watershed Protection Overlay Boundary.
8. Three -acre conversion timber harvest operations shall not be conducted in the Watershed
Protection Overlay Boundary during the period from November 15 to April 1.

BEST MANAGEMENT PLAN
v FOR APN 065-190-034
INTRODUCTION:
This Erosion Control Plan has been prepared on behalf of Kraig Kroschel at
the request of the Butte County Building Department for Lot 444 as shown on that
certain Map entitled "Fir Haven Subdivision", recorded on May 19, 1955, in. the
Office of the Recorder of the County of Butte, State of California, in Map Book
21, at pages 31, 32, 33, 34 and 35.
This plan was developed to reduce.or eliminate any substantial erosion and
sedimentation resulting from earth disturbances caused by project construction
activities. This plan is intended to mitigate average rainfall events.
Material from construction work shall not be deposited in the No
Disturbance Setback Area as shown of the map or where it could be eroded and
carried into drainageways by surface runoff. Surface runoff shall be diverted or
directed to protected areas.
The following are typical measures to be followed to achieve the required.
results:
A. Soil Stabilization:
Erosion control during construction- shall be achieved by
applications of straw mulch to a uniform depth of 2 to 3
inches. The straw blanket shall be placed in such a way that
the soil will not be visible from the ground surface. Mulch
shall be anchored in place by using a tackif ier, netting or
crimping into the soil mechanically.
_y
B. Sediment Control:
Install straw waddles and silt control fences along contour
lines downstream of areas disturbed by construction.
Fences shall be monitored, maintained and replaced if they
become ineffective. Sedimentation shall be removed from
behind the fences when it has accumulated to 1/3 of the
original height.
Cut and fill slopes shall be -seeded with native grasses and shrubs to prevent
erosion. Said slopes shall be maintained to prevent erosion.
These temporary measures will greatly reduce the possibility of erosion and
sedimentation from the projects construction sites. When homes are completed
and have landscaping features established, the erosion and sedimentation potential
will not be of any major concern.
