I was referred to your office by Mr. Dill Patterson, Contractors State License Board, Reddinq. My case is quite long and involved but I will try to be as brief as possible. I contracted with a licensed contractor to build a house for me in Magalia, Butte County. The contractor did vary from the approved pians on file with Butte County Division of Buildings and Public Works. I took' the contractor to Civil Court in Paradise but the attorney that I hired lost my case and then let the appeal deadline date pass. I had filed a complaint with Mr. Patter -son's office but the outcome of the. Civil case stopped that case. I wrote a letter to Mr. James F. Glander,Chief Building Inspector, Butte County, and asked him about the many -deviations from the plans and the contract with the builder. When he did not respond to my letter I telephoned him, and his response was negative. He said that once the house had been' inspected that was the end of it. I invited him to the property to see what was wrong and got the same reply. The Inspector had passed items that did not agree with approved plans on file and that did not mal::e any difference to the Chief Inspector. The items that did not agree with the plans on file (I have a certified copy) as stated in my letter dated June 151 1987 to Mr. Glander (copy enclosed). The front of the house has a porch with the front entry door 4 feet above ground level, and the plans call for a "concrete walk" from the front of the garage to the entry door. I had the front entry door recessed .? feet on the plans so that I would not need' an overhang. The 16 foot garage door was to be as'far north as possible and that was shown on the plans as 18 inches from the outside wall but it measures 37 inches. The rear stairs and deck were also moved 18 inches " because of a cedar tree" per the contractor, but that just put the rail of the stairs against the tree. The firewall between the garage and the house is shown as a County change' on the plans to include the shower and toilet in the house part. The actual wall includes the toilet on the garage side. The Energy Plan called for a 2.5 ACOP heat pump and a 2'"0 was installed and called for a 7.5 EER heatpump on the hot water heater which was removed the same day as the inspection. The anti -siphon valves on the outside hose connections also left after the inspection. I will include the comments page of Green's report made by Charles_. D. Chojnack:i, certified building inspector 419360. These are the major- problems that I have complained about and I find it hard to accept that this contractor is still doing business_. and in the same county area. His line I'hear is that he has done nothing wrong and that has been proven or he would not be in business. Mr. Patterson'said that he has all of the reports upto and including the inspection made by Mr. David Hurd for Mr. Patterson's office 10-3-87. I was paid $500. OC-) for the difference in the heatpump size which was less trouble than the rest of the problems. I have the contractors deposition that was taken for the civil case and he contradicts himself several times regarding deviations from the plans. There are somethings that have been changed by myself that are nearer to what should have been. But i have photos and other- documentation to show what had passed inspection in addition to the taped testimony of the on sight inspector and Mr.Schreder of the State License Board. These plans and specifications copies were used in. court and will be exhibits for case .#NP14.0450, California Department of Consumer Affairs and California Attorney General Complaint® Testimony regarding gross deviation from the blueprints and specifications was given on the witness stand'under oath by: Ms. Eve Johnson, Butte County Building Inspector, for the project; Mr. George R. Schreder, Department of Consumer Affairs, Contractors State License Board, State of California, Deputy Registrar; Mr. Charles D. Chojnacki, Greens Building Inspections, Certified by ICBO & IAMPO, and others. The main reason for some of my requirements and specifications, at the time they were drawn, was because I am Disability Retired and expect to get worse in time. For instance the placement of the 164 garage door as close to the outside wall as posible was to make it easier for exit and access of automobile in the garage. The possibility of future wheelchair requirements had to be considered also. The plans call for 146" from the outside wall and then 164 for the garage door. The actual structure measures 37 inches (vice 18 inches), and also required an extradd.00r in garage bathroom, which is not on the blueprints, to allow access to workbench area and outside back door with cars in the garage. The structure has a pine deck with overhang and 4 feet elevation at the entrance (vice concrete walk). Ms. Eve Johnson testified that an additional building permit or plan change written permission was required, but not obtained. The rear stairs and deck were also moved 18 inches, without written -permission, "because of the cedar, tree" per contractor, but that put the stairs against the tree. Someone from the county required a banisteron the stairs next to the cedar tree, which was installed on January 30,.1985, by the contractor. This was more than 2'weeks after the fimal inspection. The tree is now 40 inches from the back deck and against the stair banister. If the stairs and deck had been built according to plan, the tree would be centered more or less with 18 inches minimum clearance in any direction. The contractor was questioned during construction and gave excuses including "county required", for garage door movement and'work- bench requirement. The workbench requirement is on the approved plans as is the hotwater heat pump requirement (which :the contrac- tor removed after final inspection), but no change on approved plan in 16 foot garage door location. In fact the plans and, specifications had very little change but the house many. I have just stated the major overt changes as there are more. The contractor made the original plans with these points ref.ered"to C'wrote the original contract and specifications after seeing the property so he was quite aware of the requirements.
